the legality of clones and seeds in socal?

so my buddy and i had a question. dispensaries and what not can get away with selling clones and seeds, but how? and how come patients cannot donate their clones and seeds to other patients?

whats to stop someone, me, from setting up a prop 215 seed exchange?

Actually this is totally feasible but it would be a bit hard to do by mail. This is actually closer to the intention of prop 215 then a dispensary is. You and your fellow patients will all have to make your own growing collective. You or your friend can be the leader and collect everyones recs and have them fill out the signature list, this collective agreement is on ASAs website somewhere but you can email me if you cant find it. Its pretty good to have original signatures with a pen so in case you get into any trouble you can show that you are a genuine collective of patients trading amongst each other. With this you can even have your own mini farmers market/"meeting" but it cant be public and you should have people signed up before you give them the address to your meeting place. If you are trying to mail something around etc then I would recommend registering a non profit collective for $500 and then you'll have a bit more freedom on how you interact with patients. There is a dispensary website out there that mails out meds etc... but you have to use an in state delivery company.

If pollen has half the genes of cannabis, is it still considered to be part of the plant? like the seeds, leaves, buds, stems that have the full set of chromosomes.
 
If you are worried about having to fight this in court you can win if you bring in an expert witness to say that pollen does not contain THC, but not everyone has that kind of money to go around. Otherwise it will be counted as marijuana. A friend was arrested with clones and the weight of the cubes along with the plants was included in his charges noted as just marijuana.

San Fernando Valley, CA when there was 7 dispensaries on one square block LOL. It was a bit more complicated then that, This was a little over a year ago he was trading with a patient from online but didnt pre verify. When he showed up to meet the patient it turned out to be a cop and they arrested him as soon as they saw plants. He hadent even gotten a chance to ask for their recommendation and ID, he was charged mainly on transporting with intent to distribute. Which meant as soon as he left his house intending to distribute an illegal substance or product. So to anyone who plans to have a collective of any sort, before dealing with new members you meet online you have to check and double check patient info. If you can, get a scan of the recommendation and ID before you speak to them about joining.
 
Yes he had a recommendation, non profit collective paper work and 12 recommendations with him. You have to be real careful... LA has only gotten worse since.
He was actually one of 10 or more people arrested in a sting that went on for months. This recently happened in San Jose also. Just goes to show you that even if you think you are doing it all right you have to double check every move or you might get sucked in.

In the law, is says everything on the cannabis plant, but does not include the words "pollen" in it.

No one else is in tight with the law?
