Still waiting on my card

I sent in my paperwork and payment(money order) way back at the beginning of Feb, my money order wasnt cashed until June!, but I still have not received either a denial letter or my card, or any sort of confirmation. Nada, nothing. So Ive got my paperwork on hand since I wasnt denied, and all my paperwork was good. I know it takes them a while to get this stuff processed, but damn! I assigned a caregiver at the time I started my paperwork, but would like to remove that caregiver now. This state run stuff is a fucking mess! Im not even sure whats going on, so Im just quietly doing my own thing now. Im not sure what the legality is of me growing a few plants while I have a caregiver assigned, but have always had the intention of becoming self sufficient as soon as I could.

So what are we supposed to do, legally, if we dont have a caregiver, harvest more than 2oz from our own 3 plants, and are not a caregiver for someone else? Are we supposed to just trash good bud since we cant store it or distribute it, or even give it away to card holding friends? I consume about 1oz per month, and would like to be able to harvest enough to hold me over until my next harvest. And with some practice 1-2oz per plant should not be a problem. The law is really ambiguous about that. To be honest, if I maintain my 6 plants and dont sell the shit, Im just gonna keep my head down and do my own thing quietly. The laws change every year and I want to distance myself as much as possible from the whole thing. Thats why I wanted to grow in the first place, to have total control over the whole process, and to save money and not have to rely on others to get what I want.

dont worry if they took your money then you are golden, it took 9 months for me to get my card! nice thing is they will send out your card with an exp. date of when it was printed and sent not when you sent it in :)

Just be careful about sitting on too much overage.

2oz is what you can hold under the simple red card exception. If you get caught with anything over that then it becomes an affirmative defense and you have to prove your need in court.
Yeah, it sucks that you can't chop 3 plants at once and stay within the law. But on the plus side, if you stay under the limits, you are LEGAL!

It took me 8 months to get my card . The only good thing is that your one year starts from the date they actually send you your card , not when you applied .

Ive been looking over the MMJ laws that I can find and still cant find a clear answer about the whole caregiver thing. Legally, if I have a caregiver assigned, can I grow the plants if he isnt? Or do I need to have him removed from my record as caregiver to legally grow my plants. I still get bud from him though in the meantime while my plants are growing. And he offered to store my excess over 2oz for me if necessary since he is allowed to have more on hand. Id be happy if I could have maybe up to 5oz legally. That would be more than enough to last me between harvests.

Between you and your cg you are allowed 6 plants lawfully. You can divide that up how you and cg decide. ie: you grow 6, cg none. Or you grow 2 and cg 4.
You can legally have however much it takes to treat your condition. The difference being if you stay within 6 plants and 2 oz., you can claim an exception to criminal prosecution. If you have over 6 and 2 oz. then you can defend with an Affirmative Defense. That means that you go to court and show you need that much. That is all on your dime though.
In your case you may be able to state that you use 5 oz between harvests and your harvest are xx days apart. That could/may work for you. But remember that if they charge you, it's on your dime in an Affirmative Defense. In an exception, the prosecution must prove that you don't need MMJ. I haven't heard of anyone being charged or taken to court under an exception instance. Some have gone to court under the Affirmative Defense and some have won. I don't know what it costs to defend that though.
Lawyers are itching to go to court over 1284 but they claim there's no money to do it. They claim no one is stepping up to pay for any lawsuits.

Cool, thats good to know. My cg is the one who hooked me up with some of my equipment too. He's a stand up guy and I know his grow is within legal limits, so the number shouldnt be an issue and he can store my excess for me if need be I guess since he's allowed to have a lot more.

Oh, I just received my card in the mail today! only took 7 months :D But you guys were right about the expiration date, I gots me a year! Im very happy. I showed it to my plants, and they were happy as well.

On your paperwork there is a phone number to the offices of the health board and if you call it, they will tell you in a recording what "day" they are shipping. The "day" they are shipping means the date your application was recieved by thier offices in your certified mail receipt. it took me to 8 months aswell to get mine.... btw

Ah, to be in California. :D... I go to my local "Pot Doc" , pay my dues, get my reccomendation and I'm on my merry way. Renewals are half that initial price or so.. I keep hearing about all the trouble it is for everyone else. Almost sounds not worth it. I give you my money and medical records and you let me know what's up eventually? I don't think so.
