Here's a nice little story. Me and my friend were on our way to a spot and when we encountered a police checkpoint. We had just come over the hill and we had almost no time to clean up properly. It was only 11pm, i didn't think they would be cracking down, especially on this road we were on. To make a long story short, i took responsibility for the pot found, 5.5 grams of some decent beasters, and got charged with Simple Possession. I tried reasoning with the cop, acted all nice..but he sent me to jail because i gave him an "attitude" because i tried explaining to him that it seemed like a joke that i have to go through with this AGAIN, for smoking a plant. Also i told him that he should look up the real facts on marijuana, but i guess arguing with an ignorant prick is like talking to a wall. I ended up sitting in jail watching commercials for 6 FUCKING hours with other people before the magistrate saw me and released me. I felt so out of place sitting with all the other folks in there. Most of them were in for DUI's. One dude had shit himself lmao. Every county cop in the building was overweight, and by god i tell u they were everything you've ever heard of about cops. Every bad story you've heard about cops is true..they treat u like shit, regardless of what you've done, no matter how petty or trivial the "crime."

The judge suggested i plead not guilty, he said in front of him i wasn't guilty..i'm not 100% on what he meant. But i know i still have to pay the 570$ ticket, and if i am found guilty, i lose my license for 6 months... So i'm going to plead not guilty, and 6 jury people or w/e will decide my fate on the court date, march 23rd.

What i want to know is, do you think if South carolina eventually moves to de-criminalize marijuana to some extent, that, i may be able to expunge the charge from my record? I work for the United Parcel Service just as a laborer for now, but had plans of driving in the future, kind of a fallout plan if college didn't go well.
Or after several years, do i get the chance to expunge it? Maybe if i move states?


Any advice, sympathy, is appreciated lol. I've been through hell. Pre-trial intervention was a joke..the state just wants my money, and i don't want to give it to them. Us weed smokers arent criminals, Prohibition is the REAL danger, Cops are not defenders of society, This system is BEYOND CORRUPT and unjust, i hope some1 above smites every fucking douche cop that has ever charged some1 for something marijuana-related. Thanks.

my son was busted w/ a possession charge he plead for a deal 40 hrs community service and 3 mounts drug testing and the charge is dropped. did you ask for a court appointed attorney

I would much rather do community service and drug testing then give money back to this government. But no.. i didn't ask for a court appointed attorney, i was really tired and out of it when he was explaining things, and i didn't know of the benifits of an attorney. Is it too late to get an attorney you think? i saw the judge only 14 hours ago. And what state do you live in ??

South Carolina strikes again! man that really sucks though. I've had many nights that I got stopped the the checkpoints and gotten through. I say we pack it up and fly on over to cali cause our state isn't getting any better.

No joke man, i've made it through checkpoints before when i was blitzed out of my skull, but not this time. You don't think because of how broke our state is, that maybe we'll decriminalize marijuana? I would love it. I'd be sitting on just a fine right now, instead of 570$, and a simple poss. charge. Life was going pretty good until this shit, i go to school and work..as well as stay in shape at the gym. I'm about to drive over to the district office to try my luck and see whats up as far as court attorneys go.

To make my story short, I plea bargained down to probation and was given a choice. 2 years regular, which would have stayed with me for life, or 5 years of what they called probation 710, which is expungeable. 2 years later I was moving out of state, petitioned to dismiss rather than transfer and it was granted. The whole deal cost me about $10K, but I was busted with substantially more than you were.

Hope it all works out for you.

I am going to get a court attorney i think, i don't know how much one costs..but hopefully it will be worth it. I want to try and make a case by explaining my situation with school and my current money situation. While i'm in the court house explaining my situation do you think it would be wise to try and educate the jury( 6 people i think) on marijuana in general? That it doesn't kill braincells, and that i was not harming society in any way? he said i could be charged with DUI, but we all know there's a huge difference between driving under the influence of alchohol then with weed. When you're driving high, many people including myself, drive slower and more carefully. On alcohol one is not as aware of the influence and tend to drive faster, with over confidence. If they don't want to hear the other side of the truth, then they are ignorant, and i might kill them all in the courthouse with my bare fucking hands, cuz im a violent criminal apparently.

splinter a court appointed attorney is free ,so you have to do some research to tell him what you want to do remember you get what you pay for don't think the court appointed att.is going to do more then he has to

I got nailed with 10# of pot, an oz of coke, about 200 hits of acid and 6g of PCP. The $10K was for the attorneys. Check the Chicago Tribune from March of 1978 if you think I'm talking shit.

I got "Abdul", the bong, in 1979. I have never seen anything like it since.

Yep i second that one! Though iv never been but my mom just got back from a week long vacation. She went with a bunch of old friends and they stayed in Charleston.She said SC is like an entirely different country! That it was like going back in time a good 40 years. soo yea there is probably no way they would decrim it in any form

its so true. where im at its not bad bc im near charleston but most of sc is sooo far behind the rest of the country. but if i got to tennesee to see my family i go back yet another 30 years. i went into a place and they couldnt take my debit card, i was like wtf? why not? they didnt even have a machine. but i guess alot of sc is like that too

But every pot smoker should know to just smile and shut the fuck up , cuz preaching to the Cop's about the law just makes them angry.They think it's the Devil's Pubes so you ain't gonna get anywhere with them.Where I'm from a simple possesion charge isn't that bad of a charge and can easily be removed with a pardon (sort of).

Does anyone know how much a Norml lawyer costs? or how to even get one? i went to court today and now i'm waiting for a letter on the new court date, where i'll be in front of a jury..If i'm found guilty i will lose my license for 6 months, and have a criminal record. Since i've already done PTI..i can't do it again. But still i want to talk to someone on my level about my options or if they can sort of sway the penalties for community service and drug testing instead of no legal driving for so long(and the 570$ ticket). my parents would have to drive a 20 yr old around to school, gym, and work for 6 months. The penalty seems a bit too much if you ask me..it's not like i was "driving under the influence" when they got me, they just found what i had on me. Il try and manifest a good outcome for this trial..

Your looking for a trial lawyer, look for someone specializing in DUI or Illegal search.

However I'm quite confused. You have said that you have gone to court already? Was this a bail hearing? I need more info to help you out. ALSO have you entered a plea yet? If the charge is a simple possession you will not be going in front of a jury. I mean you will always have the option but any lawyer worth his salt will tell you no dice (expense + lawyers fees + jury = no win) From what I know south carolina is a blue state, that being a jury trial would be very very bad for you.

*edit ok I just re read what you posted eariler. I need some info. How did they find the droe, was it in the open, or did they search your car? Did they smell the pot and then search?

Also apperently from what the justice of the peace said to you, he believes if you were to plea not guilty you would win. Give me some info so I can help you out.

But yea the day the ticket was given to me, the court date was March 23rd. I went there today, and basically told an officer that i wasn't going to plead guilty(not yet at least) and that i was gonna look for a lawyer. So the lady at the desk said they'd mail me when the new date was decided. And i think the jury is like 6 people..
I was sitting in the room and the judge called up some crazy old hag for whatever offense, she requested something, and the judge walked into a different room after meeting with her. That's why i spoke to an officer, he was offering reductions..my ticket would of been reduced to $350 or something, if i pleaded guilty. Thus losing my license..and clean record. The lawyer fees and expenses i am prepared for because Even if i end up not being able to toke for a few months due to drug testing; as long as i keep my license and clean rec. i consider it a win.

Need more information about the arrest. Please be clear about dates and who you spoke too.
