Reasonable Preparation for the Unthinkable

This thread is intended as advice for PERSONAL growers.

A few months ago, I read some advice that might be helpful to some of you.

We all take great care to protect our grows from detection by the cops. This involves a lot of forethought and planning. And rightly so. And it's worth it.

But it would also be advantageous for us to prepare as much as reasonably possible to limit the damage should we get busted.

Getting busted is bad. But we can preemptively do things to limit the damage, such as:

1. Knowing how to keep your mouth shut. Always use the 5th amendment and refuse to be a witness against yourself. Don't lie. Don't tell the truth. Don't say anything except "I want a lawyer". Because the FIRST thing your lawyer will ask you is "what have you told the police?". And the lawyer's job will be much easier if you can honestly say "nothing".

You must realize here that the cops will try to get you to say anything that gives them an advantage. Did you know that cops are allowed by law to lie to you during interrogation? They are also allowed by law to fabricate evidence to try and coerce you into admitting to something that will surely hang you. Don't believe anything they say. And say nothing to them.

2. Which lawyer would you call? I'd call Saul Goodman if he was real (lawyer on Breaking Bad). But since he's not real, I've went to the (minor) inconvenience of discretely identifying a local lawyer who is very experienced and skilled in providing defense for MJ violations. And I've memorized his phone number.

3. Limit the possibility of being charged with dealing or trafficking, by getting rid of two things in your house that the cops would surely use to try and prove you're a trafficker: food scales and plastic baggies. As petty as it may seem, the cops will invade your kitchen looking for these two items, and if they find them, you'll see them again in the court room as exhibits A and B. I'm not BS'ing here. I know this may seem hard to believe, but it's true.

4. Make your grow op look "small time". 30-site cloners and SOG grows (high number of plants) make you look more "big time" than "small time". Keep it as simple as possible. I know it's cool to think about "harvesting a pound a month", but such a grow op could never be defended in court as a "small, personal grow".

This is meant as friendly advice. I hope you all take it as such.

Yes, the bastards are allowed BY LAW to lie to you during interrogation, and fabricate evidence, in order to coerce a confession. The bad thing is, some innocent people end up confessing when they did nothing wrong.

Consider this hypothetical example. A guy commits a minor felony, like shoplifting. He serves 6 months in prison, and gets paroled. He gets his life back on track, and his life is good until a couple years later, when a minor robbery occurs in his apartment building. Since he lives in the building and has a criminal record, he gets questioned by the cops. He's actually innocent, but for some reason, the cops believe this guy is probably guilty. So they (legally) lie to him and pressure him in interrogation to see if he will "crack" and confess. And of course, they threaten him with his parole being revoked. They promise they will help him if he will just confess. And they tell him if he doesn't confess, then he will be convicted at trial; and not only will he serve prison time for the apartment robbery, BUT HE WILL ALSO SERVE THE REMAINDER OF HIS SENTENCE FOR HIS SHOPLIFTING CONVICTION YEARS AGO.

Then, they again promise him they will "speak to the prosecutor" on his behalf and help him if he will just confess. So, the guy ends up confessing to a crime he didn't commit, considering it the lesser of the two evils he faces.

The reason lawmakers say this shit is "justifiable" is because they assume that most people who commit a crime would lie to cover it up, so the cops are allowed to lie to "make the playing field level", or some shit like that.

This all goes away if the suspect simply tells the bastard cops "I have nothing to say. I want a lawyer NOW".

If you don't talk to them, you greatly reduce their power over you. Most of the time, they're just on a fishing expedition anyway, hoping you will hook yourself.

The other thing to limit, no large sums of cash in your house. This is a huge red flag and evidence to show you're dealing. Doesn't matter where you say it came from, it will be seized and held until the case is resolved. You may even lose that money depending on what state your in.

Some good advice. Thanks for posting.

My question is: in a legal state, where Im expected to stay below xx amount of ounces to be in compliance with the law, how am I supposed to accomplish this without a scale?

If your state goes by weight then you have a defense. The big thing will be the actual weight you have (under or over allowable by law). Keep the scale away from your grow, stored someplace else in your house, and only bring it out when you need it.

This is true if you want a completely sanitized site. If you had a scale with a legal grow, I was just trying to point out that you would have a defense to having it, arguing it was necessary like your nutes, scissors, drying jars. I don't disagree that you shouldn't have anything extra, I guess it depends on how sanitized you want you house to be. I think your right that not having it in the house is the safest plan.

Pretty good advice.

You don't want to get stuck pleading to something just cause your on the inside with no bail.

"Hey will you take a misdemeanor and time served and 2 years probation if we let you out now?"
"Yes I will." I'm tired of watching my kids cry through the glass.

Ask me how I know.

This happens all the time, plea bargains are common practice because the courts are way overloaded. The downside for any drug conviction is a loss of being qualified for any student loans and most states impose at least a 6 month drivers license suspension. The risk of turning it down is a tougher sentence at trial. Most times the plea bargain is your only option.

It wasn't drug charges.
The deputy was friends with the guy pressing charges.
My piddly misdemeanor was charged as class b felony.
I'm going to try to get it expunged for pleading under duress.

Money can go a long way.

Getting it expunged is a good option, my state require so many years from the conviction date. Make sure to read and understand anything they want you to sign. If you use duress, at least in my state, they could vacate the conviction (plea bargain), reinstate the charges and then push for a trial on the theory that your guilty plea was not legally and knowingly entered into because of the duress.
