Gotta say the more I examine the law I have to agree that P2P is legal and I refer you to

333.26428 Defenses.

8. Affirmative Defense and Dismissal for Medical Marihuana. Sec. 8. (a) Except as provided in section 7, a patient and a patient's primary caregiver, if any, may assert the medical purpose for using marihuana as a defense to any prosecution involving marihuana, and this defense shall be presumed valid where the evidence shows that:


(3) The patient and the patient's primary caregiver, if any, were engaged in the acquisition, possession, cultivation, manufacture, use, delivery, transfer, or transportation of marihuana or paraphernalia relating to the use of marihuana to treat or alleviate the patient's serious or debilitating medical condition or symptoms of the patient's serious or debilitating medical condition.

That's pretty plain language there...

BTW, just because somebody is charged with a crime doesn't mean they're guilty. You may want to read up a bit on due process. Charges are dismissed by judges as often as people our found not guilty through jury trials because people are unjustly charged with erroneous crimes.

You have to understand there is a lot of opposition from the far right in this state who hate this law and are resisting change at all cost. It's called bullying plain and simple. They think if they can bully enough people, they can resist the change & will of the people. Our own elected attorney general is against the law that 63% of the voters approved...and he's supposedly a representative of the democratic will of the voters of Michigan.

Every single county in michigan right now is treating the MMMA differently. Places like ann arbor and lansing are flourishing with co-ops and dispensaries yet authorities in oakland county are acting as though the mmma was never passed. It's a political war plain and simple...
Yes the patient or caregiver have the right to aquire it, even from an illegal source, nowhere does it give anyone the right to sell it in that passage. I read some of your laws (i think) and the only mention of the acceptable selling of marijuana is strictly primary caregiver to patient.

Good. It is illegal or even if its a "grey" area if you're stupid enough to try to bend em then pay the price. Idiots like this is why we have to fight so hard for MMJ to stay or even evolve.

Stop using the word sell and you are correct. "compensation for services rendered" would be a better way to put it

I'm tired of people trying to tell me what to do. If you went to the dr and are legal read your paperwork. Oh and if you don't have the paperwork you are illegal!

I think everyone who has there card would be better off doing it themselves. And the ones that grow for others give 4 free oz every crop is done and sell the rest to the dispensary's, but they better be paying there taxes on every dollar the dispensary makes. This is where the state wants there cut for making it legal. People are cutting out the state and thats who is getting pissed off, so they send out the cops to start busting the people that are trying to sneak around trying to fuck them. There is plenty of money to be made! I honestly think if your selling it between each other there should be something against it for the fact there is not tax being payed and again thats where the state wants there cut. This is the only reason they are making a big deal. It should be grow it yourself for yourself or have a caregiver who grows you 4 oz every crop and sell the rest for there fees. As far as regulating the dispencary's let them be if they are paying there taxes let them sell as much as they can push out......For patents with overages tuff luck unless when you file your taxes you are self employed and claim every dime. Again the state wants there money.

And I'm going to either eat it or sell it. Taxes are voluntary the IRS sends you a blank form every year. And you fill it out like a good little slave. People make great pets, so docile. Wouldn't that be considerd "entrapment". I think that would be illigal for a cop to do? Although reality is strange.
entrapment is a special circumstance occurring only when a LEO coerces you into actions you WOULD NOT HAVE BEEN LIKELY to undertake without the interference of said LEO

LOL....... No the market pays taxes on the money they make for the day!! Or Year! Nice try m8. Where are you from that you can get away with out paying taxes? Everywhere you go you pay TAX!! On gas, Cigs, Internet, phone, so I dont know what your talking about Voluntary? If this is the case I dont want to its voluntary! This one guy on the internet told me so........... HAHAHA Sorry! Update: The owner of Utilized Space was investigated by HUNT, Huron Undercover Narcotics Team and was charged with selling marijuana to users not registered to her facility. I know the owner and I know how strict she was with membership and staying within the law.
She was also charged with maintaining a drug house.
She was released after posting a $100,000 bond on June 24.
She is also set for an appearence notice for a civil hearing July 12 at the Alcona Co courthouse in Harrisville, Mi.

HUNT is a multi-county, multi-police agency undercover drug eradication task force operating in Alcona and other northern Michigan communities.

In my view there were rotten apples in the barrel, Alcona does not want a dispensary.

Yes, it's seems to be a strategy, inflitrating a compassion group or club, posing as growers or caregivers, using medicine that has been confiscated in other illegal arrests. Typical and not surprising at all.

Federal tax not state tax. you will always have to pay sales tax. If you have a land patent you don't have to pay land taxes. ever read the constitution? indians are exempt,but today they politically correct them selves out of exemption by calling them selves native americans.Ever go to detroit or flint ?look at all the gas station owners and taxi drivers they are indians and don't pay tax. When you fill out a w4 to get a job there is an exempt box that says if you are dismembered or disabled check this box. It never once said you have to be disabled or dismembered. the book federal maphia has docket numbers from court cases from people that have won.
