I now a lawyer who lives in a small town in Mississippi. She is the town's public defender. She says that people on probation who must attend hearings are oftentimes tested on the spot and somebody definitely goes into the bathroom with the person being drug tested.
I don't think in your case they will test you on the spot. But if they sentence you to probation or house arrest, then you'll be tested at regular intervals and whenever you have to go back to court.
As for smuggling in clean urine, here are my tips. I once had a job where I was routinely tested, but I was always tested in a private bathroom. Nobody watched me pee. Today, that company does hair tests and so urine tests don't apply anymore.
Anyway, if you know you're getting a urine test, I'd suggest buying a plain condom--no spermicide, no lube. Put the clean pee in the condom. Also see if your drug store sells temp. strips because you'll need these. Urine should be around 96-98 degrees on the temp strip.
Place the urine-filled condom near your nutsack or inside your vagina if you're female. You might want to double-up on the condom. Walk gingerly and carefully. Practice it out with a condom full of warm water first. Keep it close to your body for the duration. At the time to pee, put the contents of the urine-filled condom in the specimen bottle or jar, and then go on and pee in the toilet so the person conducting the test will hear you pee and will see urine in the toilet (they tell you not to flush).
You could get those hot hand packets that hunters use and affix it to the condom filled with urine. If you're using a hot hand packet to keep it warm, you can go online and buy a pouch that you can tape to your inner thigh. Wear baggy pants or a skirt if you're female. I knew a guy who wore a kilt on drug test days--but he also wore a kilt pretty darn regularly because he was weird like that. A cool guy, but somebody who marched to the beat of his own drummer.
There's all kinds of ways of beating a standard pre-employment drug test--provided it's a urine test. Companies around my town are doing the hair tests now. Zero tolerance, and unemployment and underemployment is up! Now I work for the city and I don't have to do drug tests anymore. Go figure that--warehouse supervisor gets drug tested routinely, but city accountant does not!! I have way more opportunities to abuse my position with the city, but little ways to do the same when I worked for a private warehousing company.
All bets are off with the courts and the military. They do shit their own way, which usually means somebody will be watching you while you pee.
