New tactic by the AzDHS to stop home cultivation

Got a call from the AzDHS today after renewing...

Was told - you must remove the request to cultivate or we will be unable to issue a card.


If a patient makes a request the AzDHS can not show favor to the dispensaries by denying your cultivation rights!
Conflict of interest! As a result, forcing patients to remove the request to cultivate is against the spirit of the AMMA!

AzDHS calling and giving suggestions to patients/caregivers... Where is this written in the AMMA? Conflict of Interest!

I don't get it. Is that because you are within 25 miles??

The odd ting about this headtreep is that he is within 25 miles of a dispensary and they are not outright denying his rights to grow. He still checked the box on the renewal application that he wants to grow, and the DHS is, instead of denying the authorization to cultivate, are telling him to uncheck this box or they will not send him a new card.

It does not make sense and I am not quite sure y they would be doing this other than maybe its a new person at the DHS office that doesn't understand procedures?

i was under the impression that if you were within 25 miles, the do you want to grow question wasn't supposed to be offered.

probably a software fuckup.

trust me, the state has bought millions worth of useless software over the years.

I don't believe it is within their power to deny my application due to my request...


36-2804.05. Denial of registry identification card
A. The department may deny an application or renewal of a qualifying patient's registry identification card only if the applicant:

1. Does not meet the requirements of section 36-2801, paragraph 13. (Aka "Qualifying patient")
2. Does not provide the information required.
3. Previously had a registry identification card revoked for violating this chapter.
4. Provides false information.


We are restrained by these terms and so should the department.

imo, this.

first off, fighting beerocrats is like arguing with a deaf person. 2nd, they will always take the most conservative legal opinions and go from there.

enjoy the fight. bring plenty of money and tums. you'll need them.

as i used to tell contractors who thought they could piss on my contracts, i'm with the federal gubment. we have dozens of lawyers sitting around waiting for something to do. you want to take us to court?

.....just because your address may be within the 25 mile zone......who says you're growing there?
I live in north scotts, but my girls are growing outside of wickenburg......the azdhs does not
have anything that asks you where your girls are located......

They go by the address that's on your card not where you are growing.
