Medical marijuana from unlicensed outlet shouldn't be covered: N.S. court

HALIFAX - Nova Scotia's Court of Appeal has overturned a lower court's ruling that ordered the provincial government to cover the costs of medical marijuana for a woman who bought the drug from an unlicensed outlet.

The Nova Scotia Supreme Court ordered the province in February to reimburse Sally Armstrong $28,376 after she provided invoices for marijuana she bought from the Cannabis Buyers' Club of Canada.

The appeal court has set aside that decision, ruling that the receipts Armstrong provided do not constitute proper documentation for medical marijuana because the Cannabis Buyers' Club does not meet the criteria to legally supply the drug.

In their ruling, the three appeal court justices said the money that the province has paid should be returned without delay.

Armstrong, who is on social assistance, has a prescription for medical marijuana.

The appeal court says a previous ruling that requires Nova Scotia to pay for Armstrong's medical marijuana remains in effect with the condition that the receipts provided are from Health Canada or a legitimate supplier.

I live in Nova Scotia and do get my meds from a licensed source... So I should be getting my meds for free right?

Call health canada and ask where to send your reciepts to be reimbursed.

Wow! The welfare rates in NS are pretty good if this person can spend $28K+ on meds. Did they inquire where she got the money in the first place?

that was over years and years..

I'm not sure if this applies directly to everyone in Nova Scotia as an extension of this womans case, or if it just applies to her. If just to her, then atleast there is an avenue for other NS patients to do the same things she did (not sure which court she appealed etc) and get them to pay for your MMJ as well

It did not state how many years. If she has been buying from CBC since their inception in 1996, she would have spent about $1600/yr on weed (with receipts), however since Canada did not have a medical program until 2000, she would have to be claiming for over $2000/yr. I live on disability and that amount to almost 1/4 of my yearly income...no way I could use it for meds unless I was living under a bridge.

Does this amount that CPP pays vary from province to province?As i am also getting CPP after 30 yrs of working.,but is more than $789/ mo
No,it's federal. It is based on the amount you have paid in over the years. I never earned great money when I worked for wages and I didn't pay in when I was self-employed, so that's what I get.

Ok thanks,i get CPP and LTD,so it may be different pay scale...I also paid my own insurance premiums when i was working....often wondered how some people cope with disability's that keep them from working.
