I just heard on the radio the SCoC struck down the mandatory minimum for gun possession as unconstitutional. So goes MJ mandatory minimums?

OTTAWA - The Supreme Court of Canada has ruled that the Harper government's law requiring mandatory minimum sentences for gun crimes is unconstitutional.

By a 6-3 margin, the high court has upheld the 2013 Ontario Court of Appeal ruling that labelled the law cruel and unusual and struck it down.

The ruling is a setback for the government's tough-on-crime agenda.

Harptler just can't seem to get it right. He thought he was going to,change the way this country was run and on the surface he has....no wonder he hates the Trudeau's as much as he does....they be living rent free in his little head!

that was part of the big BS omnibus bill wasn't it? so does that throw out all of the bill then or just that part? they couldn't vote on just certain parts, so how do they change only certain parts? (that be so bloody great to see that backfire on them like that - tried to stuff it all in, but one thing is wrong.. so it/they completely fail)

i think we get to pick it apart piece by piece because Harper wouldn't listen to the people. with all the push back, how can he say most Canadians support C51?

Know I may be wrong..... but this...."tough on crime shit"..... was the last elections big

so they are finally getting to court on this stuff.....after a whole term of ineffectual leadership..,..and actually accomplishing what??????? did they do anything at all....?????

Where are the mandatory minimums for governing officials abusing there possition of authority?

Politicians should be held liable for ripping off and taking advantage of Canadian citizens. Finish there elected term + another full term behind bars in the worst conditions.

The MJ mandatory minimums will be just as unconstitutional as the gun laws. The arguments used, basically that the punishment does not suit the crime, is the same no matter what the charge. The courts have said a judge needs to have the ability to judge a case on an individual basis. Someone with a huge grow and a dial-a-dope operation may be a candidate for the M.M., but ma & pa growing 10 plants beside their tomatoes for personal or even sale to a CC would not.

The gun law has been used as well. These guys just had the money and lawyer to challenge it. Those who have already been sentenced will appeal as will those sentence for pot. If mandatory sentencing for gun crime is unconstitutional and deemed cruel or excessive, the same would go for mj. Not what Harpshit wants to hear, but that is the reality. You have to remember, we will have legal rec weed in a few months under Trudeau and decrim under the NDP. Harper will bring in his version of decrim should he steal another election. The laws around marijuana are being discarded around the world...even a backwoods hick like Harper can't force his christian extremist propaganda on the population forever. The average age of his 'base' has got to be about 80.
