Legal Moderator: Cranker's Legal Corner

Legal Moderator, Esq.
Greetings, I am Cranker and I am now moderating this forum. First off I'm not a lawyer, but the low traffic in this area means I will be looking into finding information for you in any way I can. Second off, I'm mainly here to make sure the forum rules are enforced here, which is a fairly easy task in this area. The only thing I ask is that you not make comments about killing anyone. This being a legal forum, suggesting or inferring should be killed could end up biting back. Pretty much all I'm here for is to help keep things smooth. If you wanna yell fuck the police and vent, I've already gotten the OK from the big guy for you all to rant on about it.

I hope that I am able to help and make this one of the best resources for legal information on the web.

Also, read the stickies. They are FULL of info, at the very least the NORML law page is a very good tool.

Only thing I see different is Tax system and Marijuana. Neither work: State received $2.50 on the $50 I spent to grow tomatoes. Sell a State Permit to grow Marijuana and I will pay tax sale on produce and have money to spend. A Flat Tax and a New Tax vehicle. Cut the Marijuana crime population in prison: "it is legal now". Set up a $100 fee like my gun permit to grow legal Marijuana and set up a State and Fed tax account when you register. Would I be the first to boast I just paid how much tax on Pot sales? Same OLd Aint Working!
Thank you for any progress! grizlbr

Dear Mr. grizlbr : Here is the SAme Old BS. They Know It Is NOT WORKING! 16 States are at least moving? We need to do Something, We are going to be Neck deep in SHIT if we wait till Nov. I will stay legal until things change but I do not have to sit on my one"1" good hand till then!

Thank you for contacting me regarding our government's fiscal crisis. It is good to hear from you, and I appreciate your thoughts on this most important issue.
Washington is currently spending over $1 trillion more than it brings in each year, and our national debt is now $14.5 trillion and growing. No less an authority on national security than Admiral Mike Mullen, chairman of the Joint Chiefs of Staff, has said that the greatest threat to our country is our growing debt and deficit.
Last year, the government spent at a rate of 25 percent of GDP (gross domestic product), and took in revenues of 14.5 percent of GDP. Each number is, respectively, a historic high and low. Coupled with the aforementioned $14.5 trillion debt that must be repaid, this is obviously unsustainable. It is fundamentally unfair to require future generations to pay our bills when we have not found the will to do so ourselves. In the midst of this debate Congress was forced to address the United States' statutory debt limit to prevent a default on our fiscal obligations.

After months of intense negotiations, the President and Congressional leaders announced a compromise to raise the debt limit. S. 365, the "Budget Control Act of 2011," increased the borrowing authority of the government by $2.1 to $2.4 trillion. In exchange for this increase, the bill imposes spending reductions over the next ten years by the same amount as the increase through discretionary spending caps and from additional savings identified by a newly created Joint Select Committee on Deficit Reduction.

On August 2, 2011, the Senate joined the House of Representatives to prevent a potential default on our nation's fiscal obligations by agreeing to the passage of S. 365. Although the measure passed, I voted against the bill for several reasons including the provision to enable the largest debt-ceiling increase in America's history. In addition, the bill lacked the necessary enforcement mechanisms to ensure that proposed spending reductions will actually be realized, and failed to make much-needed reforms to the way our government budgets the expenditure of taxpayer dollars.

Even more disappointing is that our nation is still borrowing $4 billion a day, and with the passage of this legislation, the debt will actually increase, not decrease, by approximately $10 trillion over the next decade. Furthermore, this bill does nothing to address our accumulated debt.

Prior to final debate and passage of S. 365, I was a proud co-sponsor of, and voted for, the Cut, Cap, and Balance Act, which passed the House of Representatives, but, despite my support, ultimately failed to pass the Senate. Additionally, I have long been a supporter of the enactment of a Balanced Budget Amendment (BBA) to the U.S. Constitution. Of importance, as a part of S.365, we are now guaranteed a vote on such an amendment before the end of 2011. However, the passage of a Constitutional Amendment is an extremely high hurdle and lengthy process. Therefore, we should pursue additional avenues to fiscal reform along with a Constitutional Amendment.
Congress must maintain its focus on a real and serious long-term solution to America's debt problem. Recently, five of my colleagues and I developed a proposal to reduce the deficit by $3.7 trillion over the next 10 years, stabilize our publicly held debt by 2014, and impose tough and honest budget enforcement. We achieve these objectives by reducing discretionary spending, reforming entitlement programs, and simplifying the individual and corporate tax code. Our solution to this crisis uses spending reduction and increased revenue from economic growth. These are the principles that I have always believed in, and that are reflected in my voting record.

Our proposal eliminates the alternative minimum tax that ensnares the middle class. We broaden the revenue base significantly — lowering all individual and corporate tax rates — to make our tax code more competitive for U.S. businesses here and abroad. This is a proven path to prosperity that President Ronald Reagan implemented in the mid-1980s.

When it comes to tax policy, the government has picked too many winners and losers. Nevertheless, I am in favor of keeping tax deductions that provide real benefits to Americans. For example, there is no question that deductions for mortgage interest, charitable giving, and health care expenses have provided a significant benefit to many Americans and should continue.

Americans have demanded that their leaders make the necessary changes to put our nation on track to sustained economic growth and real job creation. These choices may not be ones we would like to make, but they are ones we must make — now.

In most states a cop wouldn't give you a DUI, frankly because there's not a sobriety test. I'm not sure about being parked, honestly never heard of a case like that, but from what I've read in most states they would get you on possession, but you almost never see them try and get a DUI to stick. Since alcohol is metabolized so quickly, and marijuana and a lot of other drugs more slowly, you see things like Lindsay Lohan, get caught in a wreck and charged with DUI due to alcohol and possession but the drugs never enter into the DUI count. I don't know if you are legal or not, but I've been in an accident and had a bottle of xanax in the car and the officer asked if I'd taken them, I say yup, the only thing he charged me with was an illegal left turn. The steering column went out and on a lazy right turn the car kept going straight and that was the only thing he could think to charge me with. I ended up getting the charges dropped completely. That was about 10 years ago.

Funny thing is now (I've been out of the country working for a while) I just bought a new car, and finding insurance was a bitch, because they ask if you are employed and I have to put disabled, then they make you list what you are taking. 9/10 won't take me because of medication even if it's labeled "as needed." That is one of the worries I have is that insurance companies may try to refuse insurance to people who are legally prescribed MMJ.

Anyway, there are states where they can charge you with dwi if you fail a sobriety test, but I mean it's a lot easier to pass stoned than drunk so most of the time they'd just stick with possession. If you're not legal, you got off lucky. I think there's been a lot more stress put on finding meth abuse and meth labs and a lot less stress being put on officers for marijuana.

To be honest I'm not totally sure, let me look into it. If you have plants I'd suggest a camo screen or something, even putting up a wooden trellis with and get some cheap quick vine growth that goes high. I'm not sure if it's a state or a federal, I'm trying to find out, if I don't get you a good answer by tomorrow I have a couple lawyer friends I'll check with.

Here in Ca you can get a DWI( driving while under the Influence).... If your keys are in the ignition then technecly you can get a DWI.....However proving it is another story..... They would have to prove that you where under the influence of Cannibas at the time you where driving.... Cannibas will test postive for weeks so just having it in your system dosent prove you where under the influence at that time you where pulled over so it becomes more of a hassle to get convitions....Usually they will go for the postion ticket first then go from there.....But yes it can happen atleast here in CA it can....

Right, but seeing as he was parked, and as hard as it is to get a DWI with MJ to stick...when they have a possession stone cold, they usually don't want to waste time with a dui. DWI they can't usually get to stick, a DUI doesn't take as much evidence in most states, just a failing of a sobriety test. A DUI in most states requires a BAC of .08 to stand up in court. If they try to give you a DWI then you can almost always plead that down to a DUI, or outright refuse it. It's usually a scare tactic into thinking you are getting lucky if they drop that charge if you plead on the possession charge.
