Just wondering if anyone from Aus can shed some light as to the pot laws here (mainly for QLD) I know you can grow it in SA, but im a little worried.. if i have 10-15 plants going would that be jail time? or a fine and a slap.. Had a friend who recently got fined for having 0.02 grams in a little bag, just crumbs, but he got fined for that. Any info is appreciated, cheers

Mate for starters your friend with the crumbs must have been done before because that amount only attracts a "Drug Awareness course" for first offenders.

Now I don't know for sure excactly about quantities etc but almost all of me mates say "Having one plant is no different to having ten" or "What the hell are ya paranoid about its a worse offence to drink and drive" etc. But seriously regardless of the fines or Jail or whatever the rule of thumb is to be vigilant and shut your mouth or better still pick your friends well............And I hate to say this (And all due respect to the forum) but you are dealing with dumb ass potheads..........Even more reason to be on your toes...!!!!!

Lets be realistic here bro there's not too many potheads who went on to be rhodes scholars.............And there you go I probably didn't even spell rhodes properly........LOL!!!!!!

Queensland has a reputation within Australia for the harshest cannabis laws. Curious, as Queensland also has a reputation for harbouring the biggest cannabis users. Drug laws in Queensland are governed by the Drugs Misuse Act 1986, possibly one of the most obfuscated pieces of legislation in history. The disclaimer still holds, I have no legal training or expertise, if you're in trouble call a lawyer yada yada yada.

It seems that in Queensland all marijuana offences are indictable offences, but some may be treated summarily. A general rule is that if the maximum penalty on conviction is 15 years or less, then the charge may be made summarily. A person convicted of a summary offence is liable for a maximum penalty of A$6000 and/or 2 years imprisonment. All penalties for indictable offences may be supplemented or replaced by a fine of up to A$300,000.
The maximum penalty for simple possession of marijuana is 15 years imprisonment for an amount less than 500g, otherwise 20 years imprisonment. Possession of anything for use in connection with consumption of cannabis carries a maximum penalty of 2 years in prison. Permitting your home, office, warehouse, toilet etc. to be used as a marijuana smoking venue has a maximum sentence of 15 years in prison.
Cultivation of less than 100 plants with an aggregate weight of less than 500g carries a maximum penalty of 15 years imprisonment. Any more than that and it becomes a maximum of 20 years.
Queensland law draws a distinction between normal supply and aggravated supply. The offence is one of aggravated supply if the offender is over 18 and the person supplied to is under 18, is intellectuallY handicapped, is within an educational institution, is within a correctionAL institution or does not know he or she is being supplied with a drug. Aggravated supply carries a maximum penalty of 20 years imprisonment and normal supply carries a penalty of up to 15 years imprisonment. Carrying on a business of cannabis supply carries a maximum sentence of 20 years imprisonment. Receiving or possessing property from aforementioned business has a maximum penalty also of 20 years imprisonment. I am unsure of whether you could be tried for all of these charges at once, but I assume it's possible.

As I remarked upon in my previous writeup, Marijuana Laws in Victoria, there is a rather notable absence of information regarding these laws easily available and relevant outside the US. To help combat this, I am covering Australia state by state. As before, if you are facing criminal charges relating to cannabis I urge you to seek legal advice. I am not a lawyer and it is entirely possible that I have misconstrued the relevant legislation.
Summary offences include possession of cannabis, possession of implements for the cultivation or administration of cannabis, use of cannabis, administration of cannabis to another person. All of these offences carry a maximum penalty of A$2000 and/or two years incarceration. Perpetrators of these offences may not be charged when the amount concerned is not more that 30g of leaf, 5g of hashish, 2g of hash oil or five cannabis plants.
Indictable offences include cultivation of cannabis, supply of cannabis and possession of more than the small amounts mentioned above. Indictable offences involving amounts no greater than these small amounts can be dealt with summarily, with a maximum penalty of A$5000 and/or two years prison. Indictable offences involving 30-1000g of leaf, 5-90g of hashish, 2-10g of hash oil or less than 50 plants can also be dealt with summarily, with a maximum penalty of A$10,000 and/or two years imprisonment. However this is just a possibility, you can still be indicted.
If you are indicted for a quantity no greater than 25 kg of leaf, 2.5 kg of hash, 500g of hash oil or 250 plants there is a maximum penalty of A$200,000 and/or 10 years imprisonment. If the quantity is between 25-100 kg of leaf, 2.5-10 kg of hashish, 500g-2 kg of hash oil or 250-1000 plants there is a maximum penalty of A$350,000 and/or 15 years imprisonment. For amount larger than this the penalty is up to A$500,000 and/or 20 years imprisonment.
In the case of supplying to a person under the age of 16, an extra six months is added to the prison term for summary offences, otherwise an extra 20% is added to the fine. If the amount involved is greater than 25 kg of leaf, 2.5 kg of hashish, 500g of hash oil or 250 plants, there is a maximum penalty of $420,000 and/or 25 years imprisonment. Of course, this section only applies if you are over 18.

Old mate Ezra is quoting the law, but have you ever heard of anyone getting what the legislation say's..............I have never heard of anyone getting 25years for 250 plants...........But the law is there,

My experience and from word mouth (from extremely credible sources) I can tell you that QLD is extremely backward and behind when compared with the rest of OZ in the area of law inforcement......

Mate don't be paranoid.....!!!

Nahhh... because if you got 250 plaNTS... you would have to have some coin! SO LAWYER up you wont get 25yrs....
With the state of the world and the current MJ debates going on in the states!
Your lawyer would probably find a way out of it with a slap and a fine even if you had 500 plants ! ( i have heard of that! )

But I guess the blokes that got busted with that much are probably still doing time ! LOL
