I just got caught.. but is it illegal?

I live on a college dorm. i was playing a computer game and i heard a knock on the door. when i opened i door i saw 2 campus security officers and 2 RD's (residental director). they said they smelt marijuana in the room. (which infact there was no weed in the room, we didnt smell like weed, and there was no weed smoking in like 3 days. i had seeds in a moist baggie sitting in a cd case. they found the cdkcase and looked in it and found a wet napkin with 7 seeds in it. they asked me what was in the cd case and i told them "seeds".

they said they where going to send it to the local PD and have them come and see me and my room. i dont think seeds are illegal in the state of maine, but maybe im wrong. can i get some opinions please.

Seeds are just as illegal as the bud itself, at least that's how it is in cali. Had they rooted yet in the cd case?

yeah I'm pretty sure they're illegal all over the U.S. (not 100% sure though)

they where in there for like 1 day, they wernt even moist

well my state laws state tahat 1.25 oz or under is a 250-550 fine. i wasnt possessing the raw material of the herb. i dont know how they can fine me for possession of seeds. my record is clean and i havnt even been pulled over. i wonder how this will look on my record.

yea its a civil violation, i dont have any problems for me to use medical marijuana.

Marc Emery is from Canada, the US is trying to extradite him where he faces a possible life sentence on charges of selling marijuana seeds and using the profits to fund pro-cannabis legalization activities.

So, yeah, I wouldn't look to Marc Emery for a legal precedent for a few seeds here in the US.. You should have just closed the door in their face and eaten the seeds before the real cops got there.

honestly i thought it was a friend fucking around in the hall banging on the door. as soon as i opened the door they had there foot in the door. i dint even have enough time to blink.

I've never lived in a dorm before, but I would assume that one has an expectation of privacy there, security guards aren't cops and as such I don't believe they can collect evidence in that manner (ie. without a warrant). You need to weigh your options, call a lawyer and see if he can get a motion to suppress this improperly collected evidence. In the mean time, if a cop does visit, don't admit anything to them, don't say anything at all, it's your right.

You don't have to explain anything to them, lying will just bring more charges. Refuse to answer any questions without an attorney.

That will just piss them off, so I'd advise you not to do it... Besides, they can't arrest you for something you might do in the far distant future.

Anyway, I checked out your state on NORML Maine - NORML and they are pretty damn lenient on marijuana use and possession.

What you really need to worry about is, if they do decide to be dicks and arrest you or if you act like a dick to them and they arrest you --- you will lose any gov't college funding, that is if you are getting grants and loans. I attend nursing school in the States and I know a couple of kids that have lost their grants and can't get anymore gov't backed student loans either.

Just be really nice if the cops do come and say that the CD case is not yours and that you really don't know whose it is or who could have left it there. Give good eye contact and don't change your story one little bit. You should have no worries.
