How to stay legal in Michigan

Like it or not, person to person transfer are now illegal. So the only ways to be legal are:

1..grow your own meds..no care giver..destroy your overages.
2. appoint a caregiver and get your meds from them.
3.If you are a care giver, supply only your named patients...and only legal amounts.

Wow..they just made it safer to be a dealer, than to try and stay legal. A care giver, growing multiple strains, to help multiple conditions..would have to destroy all overages beyond his 2.5 oz per patient.

Granted, a care giver CAN receive a donation to offset the cost of the grow...so long as he is registered keeps books, AND operates as a small business. And receives those donations only from his named patients...

You try and grow multiple strains, only be able to get a donation for 10 oz per month, (assuming the care giver keeps 2.5 oz for their condition) and try to come close to breaking even.

Now granted..there is a lot of abuse going on..but couldn't they make a ruling that allows even the legal, legit medical users to be safe?

They have essentially said grow your own, have no overages, or there is no way to stay compliant.

All I've got to say for now is...stay small, stay legal...and wait out the storm.

If 2.5oz will not last you until your next harvest you can fight a charge for having overages in court. Like it or don't but it's true.

I wouldn't fall back on that, it sounds like a suicide mission if your in one of the lovely places that seem to have little to no care about mmj. Those types of people see that if your getting consistent overages you obviously dont care to follow the law itself in their perspective. In the case your house gets searched and things are confiscated the police are obviously going to over estimate the yield per plant and say you blatantly were disregarding the limit on how much medication can be in possession of a patient. The only way i could maybe see some light at the end of the tunnel is if it is a first or second grow but once its obvious you have a pretty regular schedule for a constant supply they'll think all of the pieces to the puzzle have been found. I guess that just worse case scenario but the way things are going this is what i see coming down the pipeline. But it is good to know the defense is available.

i waited almost three years before getting my recomendation here in mich. wanted to see how people and law enforcement handled it. Ive seen people do some stupid shit and lose that privelidge. I can easily keep myself in the legal limits for myself with the 12 plants and 2.5 oz. I just keep 2 moms pop a clone ore two every two weeks and a few in bloom and have a constant supply. and i love growing froom seed here and there. getting those from othere farmers who play around with pollinating or clones from friends when I wanna try something diff seems a whole lot safer than driving around with jars or bags of weed. everyone thinks they can drive around with the shit and think there safe. well why are you driving around with it if you grow for yourself. your either taking it tosomeone or just got it from someone. caretakers and patients im sure its different for but for myself since i grow only for me i would never drive around with any quantity, just a few pre rolls for the day.

You can drive around with 2.5oz all day long if you have the card. They can't do shit.

I really hate to see you use a nasty word like destroy, so i'll help you out.
The term useable marijuana allows for some flexability
Since you've obviously thought out most of the growing to stay legal process, replace that nasty word "destroy" with a much more creative and beautiful word -- HASH
There, no more overages, no more destroying, no more waste, no more green plant material hogging up all the weight, and at most a few minor adjustments to modify your grow.
As a caregiver though, you're on your own. This is more patient growing their own advice.

I thought about making hash, I don't want to invest in all that shit though I don't have room for anymore clutter. I'll probably get a good grinder and make a bunch of keif though....

all you need to make simpson oil is VM&P naptha or 99% iso alcohol, a rice cooker or water distiller, a few funnels and coffee filters, a couple heat resistant containers, and a coffee cup warmer. In a couple hours and very little labor you can distill down an entire plant to a few grams of highly concentrated cannabinoids.
I hear you, but I don't have a safe place to do that.

I understand. There are people in the state that take donations of bud to still down for cancer patients and provide it to them free of charge. If any of you ever have any overages that you need an outlet for, this is a great cause to donate to. If any of you need help connecting to them, let me know.
Wouldn't that still be a P2P transfer?

I can't believe that some people love to live in grey areas. It is the opposite of what the medical movement is about. Maybe the recreational movement will gain some steam eventually, but you have to not screw it up for those in need. Let's put compassion back into the law and let the suits figure out how to exploit me later.

I'll have to read the entire opinion before I can be certain but the summary seems to be that commercial sales are illegal and p2p transfers involving a SALE is illegal, however donations and transfers without a sale are legal. For instance my wife's dispensary is now only accepting donations per their lawyer's advice after the appeals court ruling and they have shut down their storefront dispensary and are changing their model to a members only co-op which will operate out of the same location as their hydro shop. No new members are allowed so existing clients are the only members that will be served and donations are the only accepted form of payment transfer.

MMJ is not going to do anything but get bigger in michigan. So be it if the courts and legislature want to play games. We'll call payments donations and the world will continue to turn.

You could have 2.5 oz of hash..

Tommy, I don't consider wanting to have enough to get me through between grows "loving to live in the grey area" and YES it is what the medical movement is about. I'm not selling shit. It would be cheaper for me in the long run to grow enough to get me by for 6 months and not grow in between rather than having grow lights blazing every single day of every month, all year long. And it's fucking impossible to harvest just 2.5 oz. Unless you want to grow some stunted, impotent plant that only yeilds an ounce or something. It wouldn't be medical quality though. Screw that.

Hey Northern, I know it's a little more expensive, but I hear you can get 190proof everclear shipped here. That way you can keep away from the petroleum products, it's a lot nicer to cook down fume wise, and I think you'll notice a difference in flavor and more a long the lines of organic.

Seems to me that you'd be less likely to be accused of driving while under the influence if you had whole bud in a jar in the back seat versus a bunch of joints rolled up and ready to go.

Not everyone can or wants to grow for themselves. You're fortunate that you can. Transporting it is part of the law, there is nothing wrong with driving around with it especially if you're within your limits.

Concentrates are a great way to stay under weight. making simpson oil is much simpler and more efficient than making hash. If you have surplus simpson oil and know someone who is dire need, you're then in a great position to help them.

if you made hash would that be considered as weight its still usable.
Yes it would be considered weight, but it would be weight consisting of closer to 100% of what you as a patient are ultimately growing the plant for I.E. the medicine, and getting rid of the excess weight of the plant used to grow the medicine
would reduce unneeded weight in those 2.5oz you are allowed by 80% or more. Allowing you to actually possess more of the medicine,
which in this case, is the only truely useable part.
The same goes for making oil, as mentioned above.

So much for the Democratic vote. Thanks to our AG who by the way was on the losing side of this issue in 2008...fast forward three years and he changes the law that over 60% of the voters passed in the previous election.
I don't understand this logic, why destroy a new growing segment of our economy before it gets started, we need jobs not more "family values" dogma, leave that campaign gimick alone...please it's been beaten to death.
What he has done is force people to deal with the criminal element, instead of keeping the money here to benifit the community and our State economy we will be sending it to the cartels or other criminal orgs.
The ACLU has appealed the judges ruling...this is BS and I for one am disgusted with our state government, it's broke.
