Help with mmj card

Hey guys ive been using marijuana as a medication for a host of ailments for a few years now, mostly sports related injurys, and for pain managment i have from a car accident that broke my hand, also a biking accident when i was younger that fractured my eye socket. As well as deep depression and insomnia.
Ive been intrigued at the idea of trying to get a medical card for legality reason but have been hesitant because of the minimal acceptance in our state on many levels. I dont want to labeled as a drug abuser by my docter or on my medical records for asking for a mm script. I was wondering if soprts related injurys. IE knee pain, shoulder pain and ankle pain. played soccer and hockey competitivly for 15 and 17 years respectivily now. Along with medical documentation i broke my hand and fractured my eye socket seem like it would be enough to get a script. I was just worried at the amount of anti inflamitorys and pain releavers i was taking at 22 years old and have started to smoke and use edibles since then. Just overall worried i wont qualify for a card and it will affect me in a negative way for trying. I also feel that because im only 23 that a doctor will think im just trying to abuse "weed".
ANY AND ALL SUGGESTIONS DOCTERS OR ORGANIZITONS THAT CAN HELP ME WITH THIS WOULD BE MUCH MUCH MUCH APPRECIATED!

Don't go to a regular clinic, go to a medical marijuana clinic. The medical marijuana clinic will ask for your doctor's name and adress but I don't think that they call them unless something happens to you. Pretty much only you and your marijuana doctor knows about your liscense.
Don't worry about not qualifying. Your having chronic pains, depression, and insomnia. Thats already 3 different diseases that marijuana is perscribed for. If he tells you no, then its because you look like a drug addict who can't take care of himself.

i live in maine and allthough depression and insomnia qualify me in other states, i dont think it qualifys in maine as our list is still pretty small for illneses that qualify, basically its like legit illnesses, ms and aids and chrons right now. or chronic consistent pain that cant be cured by surgery and has lasted longer then 6 monthes, which is waht i would be shooting for.

And Marlboro47 i was planning on not seeing my primary to obtain a liscense thats why i asked for any docters or organizations willing to help in maine man hahahahahaha, and im not some drug dealer or abuser either im 23 years old i work 35-45 hrs a week and im a part time student. im clean cut and well taken care of hahaha

I was wondering the same thing

I think the old law (went into effect jan '11) had the list that you see on some of the Maine doctors that are open to recommending medical marijuana. I'm not sure but I think to add "qualifying conditions" to this list , doctors have to petition or something and eventually they'll possibly add a condition.

Now I think that LD1296 amended this. I believe after LD1296 goes into effect that the doctor decides himself what a "qualifying condition" is... I'm going to go through the law today and report back

no, one must still meet the qualifying conditions.....only dhhs can add new conditions by a petition process

MPA: the proposed law was as you state - it removed all qualifying conditions and left the decision to a physician. The reform law that actually passed still has the same list of qualifying conditions and an amended process for adding new conditions.

The legislature page does still feature the proposed law more prominently than what was actually passed. You need to find the amendments page. I posted a link to it earlier this week in another thread - i'm in a bit of hurry and don't have time to repost it right this second.

so it is official.. even once LD 1296 goes into effect there is still a State list of qualifying conditions? it's not up to each individual doctor's discretion?

the above seems to be the general consensus

If you were in California, you just walk in.. tell the doc you have headaches and smoke marijuana. 20 mins later you're on your way to the dispense.

Honestly it is not all that difficult, people tend to think to much about it. I sat down with the doc, told him I have been smoking for years, going to smoke anyway & want it to be legal.

RawBudzski is correct, though it will depend on the doc of course. Helps the doc if you have *something* to go on, however thin it may seem.

um go to a naturopathic doctor and ask about your options for pain management.

go to a place that is known to qualify patients for medical cards. lot of them run ads on the radio or newspaper. costs a bit of money but is worth it. anytime anyone has a history of severe and chronic pain it's pretty easy to get. you can ask your normal doctor but they probably wont help you. it doesnt hurt to try. personally mine said he doesnt do it but hes not against it. they have to keep it confidential by law.

lots of maine doctors do not advertise for mmj patients on the radio or newspaper.....how about giving proper advice for maine patients...

D. Any other medical condition or its treatment approved by the qualifying patient’s physician pursuant to section 2423-B. "


ok, so it sounds like the decision of what a qualifying condition is would be up to the qualifying patient's physician... prior to the amendment it read as follows...



"D. Any other medical condition or its treatment approved by the commissioner as provided for in section 2424, subsection 2"


so IF there is NOT some other piece of information in section 2423-B (that would lead us to believe there are limits on what the physician can think is "qualifying condition") THEN we can assume that the list of qualifying conditions has been abolished and it is now solely up to the physician on a case by case basis

here is section 2423-B below...


"Sec. 18. 22 MRSA §2423-B, as enacted by PL 2009, c. 631, §22 and affected by §51, is amended to read:

§ 2423-B. Authorized conduct by a physician

A physician may provide a written certification for the medical use of marijuana under this chapter and, after having done so, may otherwise state that in the physician's professional opinion a qualifying patient is likely to receive therapeutic benefit from the medical use of marijuana to treat or alleviate the patient's debilitating medical condition. Prior to providing written certification for the medical use of marijuana under this section, a physician shall inform the patient of the risks and benefits of the medical use of marijuana and that the patient may benefit from the medical use of marijuana. A written certification for the medical use of marijuana under this section must be written on tamper-resistant paper. A written certification for the medical use of marijuana under this section expires one year after issuance by the patient's physician. Nothing in this chapter prevents a professional licensing board from sanctioning a physician for failing to properly evaluate or treat a patient's medical condition or otherwise violating the applicable standard of care for evaluating or treating medical conditions."


I dont see anything mentioning the list they had.... Also the ENTIRE paragraph that I list below has been crossed out under the new amended law... further leading me to believe that the list of qualifying conditions has been abolished (come 1296 being enacted).

"C. Except with regard to a qualifying patient who is eligible for hospice care, the commissioner or the commissioner's designee has approved an application for the medical use of marijuana by the qualifying patient. Prior to approving an application under this paragraph, the commissioner or the commissioner's designee must have received confirmation from a pediatrician and a psychiatrist chosen from a list maintained by the advisory board established under section 2424, subsection 2 that the pediatrician and psychiatrist have reviewed the medical file of or examined the qualifying patient and that in their professional opinions the qualifying patient is likely to receive therapeutic or palliative benefit from the medical use of marijuana to treat or alleviate the qualifying patient's debilitating medical condition or symptoms associated with the debilitating medical condition. If the commissioner or commissioner's designee fails to approve or disapprove a recommendation under this paragraph within 10 days of receipt of the statements of the pediatrician and psychiatrist under this paragraph, the application is deemed approved."

1. It allows a physician to determine whether a condition requires the use of medical marijuana."








so case closed? after LD 1296 goes into effect physician will determine what a qualifying condition is.

this will make it more like the other states that people have mentioned... and also means that depending on the physicians evaluation of you he may find insomnia qualifies you for a medical marijuana perscription

Hello, I am very intrigued in assisting you with this process, I will shoot you a PM, but I will give some information here, so that everyone can see the basics. I received mine 11 days ago.

I am 20 years old. I have been living in Maine as a resident for 19 of those years, I spent a year off at college.

I was struck by a car when I was an adolescent, causing many hip surgeries, that 7 or 8 years later, turned into chronic back pain.

My left leg is a quarter inch shorter than my right, due to the accident. Having a slight limp for years, totally F***ed my back.

I've been going to different doctors, physical therapy, chriopractors ... I've been on 6 different pain reliever (Tramadol, Ultram, Totidol, Vikodin, Percocet, and imbuprofen 800mg) The only thing that ever worked was the percocet, but after 3 months, the state wrote an audit to my primary doctor not allowing him to perscribe me narcotics anymore, because i had an "undiagnosed" condition.

So theres my history, I suffered severe trauma when i was young, and now its turned into chonic pain.

This is what I qualified for.

"The following chronic or debilitating disease of medical condition or its treatment that produces intractable pain, which is pain that has not responded to ordinary medical or surgical measures for more than 6 months: Chronic Lumbar."

Car Accident: Caused Perthes Disease, which led to chronic back pain.

Ive seen 4 different doctors, physical therapy, chiropractor, and tried many types of prescription medication.

I've been seeing doctors sense I was 15 years old about my back, I had a solid 5 years of medical history.

The Process:

-Called a marijuana clinic here in maine.
-Scheduled an appointment, paid $300.00 to hold the appointment. ( Doesn't Accept Insurance )
-Went in and filled out a 7 page new patient intake forms.
-Saw the doctor. She took my vitals, and we spent the rest of the time reviewing the answers I had given on those intake forms.
-Finished with the doctor, watch a 15 minute video, and went home.
-2 weeks later I received a call telling me that I had qualified, and he had decided to certify me.
-Told me I had 2 options, one was registering with the state, or wait until the 28th of September, and I would be able to just be registered with their office, not the state.
-I told him I would like to wait and just stay registered with their office
-He said that I would recieve an email in the next day or so as a temporary certificate (proof that im a med patient now) and that I would be getting a legit one once the new law went into effect.

2 minute phone call, greatest, most relieving phone call I've ever had. I no longer have to be afraid of The Man, for enjoying my cannabis for medicinal purposes.
