Happy Valley-Goose Bay RCMP charges woman under Cannabis Control Act

On April 17, 2019, at approximately 1:00 a.m., Happy Valley-Goose Bay RCMP were conducting patrols in the community.

Police conducted a traffic stop and a 30-year-old woman, who was the sole occupant of the vehicle, was found in possession of cannabis that was not in the package it was purchased in and was therefore not properly sealed.

She was charged under the Cannabis Control Act for transporting improperly packaged cannabis in a vehicle.

RCMP NL reminds motorists that when transporting cannabis in a vehicle it must be in the package that it was purchased in and the seal must be unbroken or the cannabis must be stored in an area of the vehicle that is not readily available to any person in the vehicle.

So if you had purchased an ounce, and you are on your way somewhere where you plan on smoking a joint, perhaps a friends house, you must keep the rolled joint IN the one ounce package, in your trunk? You can't just put the joint in the trunk, you have to carry the whole ounce, just to legally have the joint with you?

Hell, I never put my stuff in the trunk, but as a medical user, I understand I can carry it on me as long as the driver does not have access... (I don't drive) and I don't have an LP container to put it in either, LOL...

I don't think a lawyer would be required. They charged her with " transporting improperly packaged cannabis in a vehicle" which is not a statute in the law books as far as I know. I think they combined 'cannabis in a vehicle' and 'illicit cannabis' to come up with a offense that doesn't exist. It's an open and shut dismissal. I'd have the cops tested though, they're either really, really stupid, or they were high!

It’s simple. It’s a simply legal argument.

They need to prove that it’s illicit cannabis. Which they can’t. No you don’t need a lawyer. You could hire a paralegal.

What the cops just did is charged someone without knowing where the cannabis came from. If we grow our own. Which we can. How do we transport it? So if I’m in a car with my own grown bud how do you know? You don’t. If I testify it’s home grown. Not illegal. Then I have raised doubt as to if it’s illicit cannabis or not. Or is the government now telling me I need to put my home grown weed in their special containers? How do I get their special containers? I have to order the government bullshit weed first? Doesn’t make sense. Laws will be challenged very shortly. And I hope she does. If it was Ontario I would do it for free.

I agree with you. However, if faced with $200 fine MOST are going to pay the fine than go through all that shit.
The police are willfully ignorant of the law and will do what they want. They will slowly be educated but, in that time, they will extract as many fines as possible.
That's why just play safe and keep it packed properly (ie; jars with your own label) and out of reach. If you find yourself in a situation just be polite and try and educate the officer in a civil manner.

I'll carry it in my pocket, in my altoids tin, as usual, and I always carry a copy of my HC Grow registration. If they see criminal intent in that, then so be it...

This attitude doesn't surprise me. The " other " side " NOW thinks that they have to go around and find illicit cannabis. This is of course cannabis that they didn't make any
money on. Same plant of course...different goals.
These morons need some nice slaps to school them properly. As you guys have said, we can grow our own and all that means.
Proper packaging....how ridiculous. That's just part of their quest to get anyone who doesn't buy theirs. So their simple brains assume, no jar, must be illicit.
They really don't care what it's in. They just want to screw us as they always did.
Nothing has changed really in my mind anyway.
Put it in the trunk...carry under an ounce if you can.

She more than likely didn’t think about it. Majority are uneducated which is sad. Cause they are the ones to be taken advantage of.
