Growing my plants at a friends house

Right now, they way I read the laws about it, I can grow my six plants at my buddies house where he has grow space for 12 plants - 6 his and 6 mine. I'm curios if people see the situation a different way. I don't see any restrictions on the amount that can be homegrown at any one place.

I am also interested to know if you think this situation will last or whether we will see legislation sooner than later to restrict our rights.

I think you are straddling a very thin line saying your assisting your friend from Kansas. Are you a red card holder? Growing of course is still illegal under federal laws, so I would caution you not to get sucked into the "green rush". The laws for recreational do not go into affect until Jan 2014, if you are not a red card holder currently, you are taking a fairly big risk, IMO. Good luck.

If anyone ever wonders why there are so many restrictions and laws such as 1284 one only has to look at this guy to see why.

Currently, I believe you are correct. Technically, all one needs is an individual over 21 to claim the 6 plants as their own, and there are really no restrictions on that for the time being. The only laws that regulate personal grows are Amendment 64 itself and SB 283.

However (and this is a big however), the world is watching. Doing something like growing for a friend in Kansas, while technically not illegal in Colorado at present, is exactly the sort of thing that will result in overly onerous restrictions on home grows and may jeopardize the national movement toward legalization. If you insist on doing so, tread lightly and, perhaps, don't advertise doing so online. Kansas law enforcement isn't one to be screwed with when it comes to weed, nor is the DEA for interstate trafficking of schedule I controlled substances.

Jus - I appreciate your perspective and I don't think I was insisting on anything. I think the biggest threat to Colorado homegrowing is going to come from Colorado's retail pot industry not from federal or outside law enforcement or movements or some guy talking about the possibilities :).

i guess we will agree to disagree on this issue, I also don't believe that the recreational marijuana will be a threat, not at first. I think the small growers will always have the better quality of weed. The crap that will be recreational will be bottom shelf smoke, not medical marijuana quality, but that is my opinion. We will have to see how it plays out.

we have a responsibility to stay within the law and not let one person fuck it up for all of us. we are the leaders of a growing movement and we must show the country and the world that we can handle this responsibly. if we ever want to be truly free we cant look to take advantage of every single loop hole possible. its time now more then ever to grow up and be the model for the rest of the country to look to. so many already look at colorado as how not to go about legalizing let us not give them more fuel for that fire. dont even get me started on all the fucking bhotards in this state.

Do you think a friend growing his plants in my home is a loophole? Would it make a difference if I leased him space in my home or rented him a room?

I really do believe this is a great topic, which needs frank discussion, but I have two questions: (1) How would said theoretical Kansan friend obtain the grown marijuana? I ask because, if it truly is for use while in Colorado only, without transporting it out of state, I don't know that as many people would balk at the idea. Much like growing for a fellow Coloradoan: some may not like it, but many may not care since its in compliance with existing law. (2) Is it really "Kansan?"

Yup, it is really "Kansan". I was just using the Kansan as an example of the furthest extent of our right, though that outer limit might actually be growing for a Turkman. As for theoretical Kansans ability to obtain the plants, I guess they are free to some load them up and drive them wherever they would like. They are also free to store the grown marijuana at the premises where it is grown and take it away in 1 oz. increments. They would also be able to gift it to anybody they like - so I suppose they might send 100 of their closest friends over to get their 1 oz. gift.

If you would enjoy bending your head try this one: I park an old school bus on the street in front of my house and turn it into a grow room, I grow 10 lbs. of pot and drive around visiting nursing homes and give away marijuana.

But, I am most interested assisting a Coloradoan in growing their 6 plants, if we're not unified on this right it will probably be one of the first to be taken away.

I'm going to grow for every adult out of state because its legal to grow in Colorado, considering it can't leave the state after its harvested, considering a resident constitutes someone who has paid taxes in this state for at least a year maybe two.. Starting to sound stupid yet? You are trying to manipulate Colorado "residents" marihuana laws to suit your scam... Stay the fuck out of Colorado Lebowski

I'm sure there is a 'school bus' parked in front of your house at times, but I don't think they're going to let you grow anything on it.

There is no residency requirement in the law regarding growing marijuana. The Governor, legislature and retail industry are already planing on growing and selling marijuana to the Kansan or the person from Turkministan - and many seem very upset that I might want to do so as well out of the goodness of my heart. Are people upset by the possibility that I might give marijuana to someone from Kansas or is it just helping them grow it?

And like I said earlier, the focus of my posts are on people thoughts about one Coloradoan assisting another Coloradoan to grow marijuana.

If it were me and I intended to grow plants for a friend I'd damn sure want that friend on premises at all times due to they'll still flashbang your ass for weed and at the very least a knock on the door with a warrant. Suddenly you're over count with no one to speak up.

Now I would say being its recreational you can grow for a friend if there unable to grow for themself and if there a Colorado resident and have paper work stating I'm unable to grow blah blah blah such and such is growing my six plants and if you have a copy of there identification card with a phone number you prolly can do it I don't see why not but the again I have no clue

Keeping track of who is growing what where is going to be a problem for anyone trying to police the law we have. I think the only way to effectively do that would be for the state to create a registry and require everybody growing to register their live plants, while their at it they could require you to record the yield you got off the plant and thereby track how much marijuana you might be storing on your premises.

The idea that we need to be ever present during the grow doesn't seem very feasible. Under the current situation, I think that having masking tape on each plant with the name of the person your assisting to grow it is going to give you as much protection as having a stack of documentation about it - I say this because I think that if law enforcement wants to come into your house and rip up plants they are going to do it regardlessly.

Many people seem to be willing to make up requirements where I don't think they exist. With regards to residency requirements what do you think they are or should be.. 24 hrs, 1 mo., 3, 12 mo.s??
