The Marijuana Regulation and Taxation Act
The legislation Sen. Krueger is filing today would regulate marijuana in a manner similar to New York’s current treatment of alcohol, and would empower the State Liquor Authority to act as the primary regulatory agency. In brief, the bill:
  • Removes penalties for possession of 2 ounces of marijuana or less;
  • Makes 18 the minimum legal age for marijuana possession and consumption;
  • Establishes that smoking marijuana in public and possession of marijuana by persons under the age of 18 are violations;
  • Allows for home cultivation of up to six marijuana plants;
  • Empowers the State Liquor Authority to grant licenses for marijuana production, transport and retail sale;
  • Prohibits sale of marijuana to persons under 21;
  • Allows communities to opt out of retail sale for off-premises consumption through a referendum process similar to what is now in place for alcohol sales;
  • Allows communities to opt in to allow retail sales for on-premises consumption through a vote of the local legislature, in addition to the local c
  • Community board in the case of New York City;
  • Establishes an excise tax of $50.00 per ounce of marijuana, and authorizes localities to charge a sales tax on retail sales; and
  • Directs a portion of the state tax revenue collected to be directed to re-entry programs, substance abuse programs, and job training programs in low-income, high-unemployment communities.
Sen. Krueger is expected to file the bill immediately following Wednesday’s press conference. Assemblymember Crystal Peoples-Stokes (D-Buffalo) will be introducing companion legislation.
 
Sucks that the governor is being leaned on by lobbyists to keep it illegal. However, atleast now I know who I'm NOT voting for next time theres an election. I forget what they can do if the governor continously vetoes these types of bills, I know they can do something but I forget what bongsmilie

Well Patterson Vetoed medical because it involved spending when we our budget was tight. He vetoed all bills that required spending that year

so why is our gov against this bill. too tight w/law enforcement and corrections and dependent on their union backing. he seems to have compassion to many causes, but not this one. perhaps this could provide some insight into why the president seems stuck in the same rut...

The only thing I have ever heard him say about the bill is the 'non-starter' statment

But he says he is pro medical marijuana ....... 'he says ??'

I believe their is a proposed medical bill also from about 6-9months ago , But of coarse no vote or even dissucsion

ny is just like pa. they will be two states surrounded by medical or legal states long before they come around to it. I mean ny decriminalized in 1978 but that was a long time ago. It would be nice though since there are a ton of growers in ny

Legalizes the possession, acquisition, use, delivery, transfer, transport or
administration of medical marihuana by a certified patient or designated
caregiver for a certified medical use; prescribes procedures for such

practitioner, and that, in the practitioner's professional judgment, the
serious condition should be treated with the medical use of marihuana; provides
that possession or acquisition of marihuana shall be lawful under these
provisions provided that the marihuana possessed does not exceed a total
aggregate weight of two and a half ounces; directs the department of health to
monitor such use and promulgate rules and regulations for registry
identification cards; provides for reports by the department of health to the
governor and legislature on the medical use of marihuana.

The medical marijuana bill passed the Assembly but was amended in the Senate and was sent back the te Assembly for a second vote
