Father Had Stroke, Hospital Wants Search Home

So my father had a stroke on New Year's Eve (great way to start the new year..) and now apparently the hospital wants to search my home and if they smell marijuana they are going to 'report it'. This is because my dad tested positive for marijuana cause he smoked one joint on new years eve...

So I don't know who is searching my house (hospital, cops, etc.) or when. I've been charged with possession of marijuana once and am off good behavior for it but it's still on my record for a few years. I have a safe that I have everything in but I'm afraid they're going to ask me what's inside and to open it and I will have no choice and then I will be fucked...

Basically I'm wondering if anyone else has experience with hospitals wanting to search your home.. I'm not sure if they're just going to search it when he is ready to return, or what the deal is. But I've already been having a LOT of anxiety just because my father had a stroke and this adds tremendously, suicide has become an option to me now.

All the cops in my town are assholes, and hate me, if that information helps at all. I hope to get quick responses. I hope people understand the seriousness of what I am going through. Thanks in advance.

tell the hospital to get fucked. The hospital can't search your shit.there's no rreason for a warrant, your fathers a grown man why cant he smoke? if your towns that corrupt you should move.

Why would the hospital even test for thc? I'm with klassify, tell that hospital to get fucked. If all this shit is true I'd talk to a lawyer, not to defend you but to sue fuck out of the hospital.

well was he coughing when he got the stroke? How the hell would marijuana be the cause of that. That sucks tho. On more than 1 level. Stinks your dad had a stroke and that the cops may come. I've never heard of anyone getting their house searched from going the hospital high. If they are coming they will bring dogs if they aren't underfunded and your safe will be barked at and so on. So calm down... go bury anything you cant eat if the cops come. And just take a walk to dig up a little bud when your low. I dont know what to tell you but its definitely not worth killing for. These types of thing happen everyday. You just have to deal with it and go on about your life.

elementary, NO ONE can search your house without a WARRANT & a hospital isnt going to do that. They are just trying to rile you up & brow beat you. Your fathers choice to smoke, as an adult was HIS choice & has nothing to do with you or your home, even if he is living there. The MJ didnt cause the damn stroke & if his doctor wants to try to get on your dad for smoking well that is between them & he can either listed to the doc or tell the doc he will continue to LIVE HIS LIFE the way he wants while he can. Suicide, are you serious. Grow a back bone, because that is a cowards solution to not dealing with life. If you are THAT worried, get any & all MJ out of your house, period. You cant be busted for a smell in your house.

First of all i would like to wish your dad well and i hope that he can pull thru the stroke and recover enough to live a normal life again .

Hospital has zero rights to search your home , They can however inform the police !...But i don't see how telling you they will search you ( giving you a chance to remove anything ) will do them any good in the end ?

Did the hospital them selves tell you direct that they will search your house ...or did the message come via someone else ?

Not sure i get the actual story ... But i can't see any reason for the hospital to want to do something like this .

My advice is this .... Clear your house of any MJ ( Just in case ) .... But don't worry about it or let it get you down ... I think its just a threat ... or somone is bullshitting you .

Just try and relax ( I know thats easy said ) don't let it get you down ... and go and be with your dad as much as you can :)

Things will look different in 6 months time ... Just try and cover your ass ... relax ...and care for your dad :)

1. marijuana was not the cause of the stroke.
2. like everyone else said, tell the hospital to get fucked, they themselves cant search your house. i dont even know if they can make a police report, doesnt doctor patient confidentiality cover that? it may not due to the legality of marijuana. i highly doubt the cops would waste all the time and money to search a home of a man who was positive for thc....if they would have found a quarter pound on his person or something then it may be a different story.
3. do yourself a favor and talk to a lawyer.

i hope your dad pulls through ok, along with you and the rest of your family.

He was coughing when he went into the emergency room. I'm sure if the did a lab test on his urine like any hospital probably would THC would have come up. "Smoking constricts blood vessels".

I've already decided to move everything out of my house.

And I can't afford a lawyer.. can't believe that was really suggested.

They are not coming to search for drugs, they are coming to help make the area safe for your dad who might now have trouble with balance. Trust me, the hospital wouldnt give a shit about THC.

It was suggested because it is the best advice I have seen on this thread.

An attorney can advise you of your rights based on the facts and the law. And if the attorney tells the hospital to go fuck themselves, he will do so because the law is on your side.

And it seems to me based on what you have said on your own background and relationship with the local coppers, you can't afford not to talk to an attorney either.

Go to Legal Aid if you can't afford a lawyer.

Research published in this week's Proceedings of the National Academy of Sciences demonstrates that naturally occurring compounds in marijuana may protect brain cells during a stroke.

Researchers at the National Institute for Mental Health found that THC, the chief psychoactive compound in marijuana, and cannabidiol (CBD), a nonpsychoactive component that previously showed promise as an anti-convulsant, both appear to be potent antioxidants in laboratory studies. Doctors rely on antioxidants to protect stroke victims from exposure to toxic levels of a brain chemical called glutamate. Head trauma and strokes cause the release of excessive glutamate, often resulting in irreversible damage to brain cells.
Scientists asserted that CBD could hold advantages over other antioxidants because the compound is fast acting and nontoxic. "We have something that passes the brain barrier easily, has low toxicity, and appears to be working in animal trials," lead researcher Aidan Hampson said. "I think we have a good chance" to help patients with this compound.
The U.S. study follows earlier research conducted in Israel demonstrating that Dexanabinol -- a synthetic analog derived from marijuana -- protects healthy brain cells against glutamate. Israeli researchers declared this May that the drug will undergo Phase III human trials shortly. They hope to begin marketing the drug by the year 2000.
Allen St. Pierre, Executive Director of The NORML Foundation, said that the new research strengthens the need for medical marijuana reform. "This research highlights the therapeutic value of compounds in marijuana besides THC," he said. "Patients find maximum relief from whole smoked marijuana because the plant contains several therapeutic properties unavailable elsewhere. Federal law must change to allow patients access to these naturally occurring compounds."
Federal law currently prohibits the medical use of marijuana and all the plant's active compounds other than synthetic THC.
Harvard Medical School professor Lester Grinspoon said this research represented the "tip of the iceberg" as far as the medical potential of the marijuana plant. "When science gets serious about investigating cannabis as a medicine, we will discover many more such findings," he said. Grinspoon also stressed that the scientific community has come full circle regarding marijuana's effects on the brain.
"The debate has moved from alleging that marijuana destroys brain cells to finding that cannabis is clearly neuropathic," he said.
The findings indicate that marijuana may also hold medical value in the treatment of brain diseases such as Alzheimer's and Parkinson's, the team of U.S. scientists said.

They're only concerned about the possibility of my dad smoking. I'm not entirely sure.
Smoking constricts blood vessles and they are worried about blood clots, stroke, smoking interferring with his medication, etc...

But I agree you should re-locate everything if possible. It doesnt hurt to be safe. But when they show up, dont freak out because this thing is normal and does happen.

oh well you should have said that before dude, that is very standard for hospitals to send someone out to tell you what you need to do to make the house livable for your father. although im sure you can deny that, the hospital has no right to forcefully search your home. if they're coming to check out the house then moving everything out is a smart plan.

you cant believe it was suggested? best advice you'll get bud. its much better than getting advice from a bunch of people that can only guess at what could happen (myself included). by the way, lots of lawyers have free consultations. i talked to a lawyer about my case for almost 2 hours, no charge, then ended up going with a different lawyer.

sorry bout your pops.... but if/when you allow the hospital to come to your house to help you make it easier for your dad. if they say anything about about pot deffff tell the hospital to blow you. It's none of their business. besides..even IF they did smell/find something its all hearsay to the cops. I could walk in to the local pd and say i was in my neighbors house and saw some pot on the table- they won't care. they aren't going to waste time trying (and failing) to get a warrant from a judge to search your home. EVEN if they did come to your house (cops) without a warrant you can tell them to suck it too. - its your right as an american (assuming you live here) if not you might just be fucked... Anyways good luck to ya.
 
Ok, Hope your Pops gets better fast. They told you about the THC cause they had to. A blood test for drugs and problems is a normal procedure.The hospital is going to your house to verify that it is safe for your dad to live there.They told you about the house visit because they must have your permission to enter. They will look for unsafe conditions and tell you about any problems they find. Like they want the shitter to have a rail so he can sit and stink, etc. No electrical cords on the floor that he may trip over and a way to get into and out of bed easily, things like that. They can , after their "inspection" call the cops if they find anything illegal, so put your goods away in a safe place. Like maybe a friends house or outside. Here's an interesting note.. If you put your stash in a garbage can outside of your house the cops cannot bust you because its in the GARBAGE. (not easily or readily available for use). The can should be as far away from the house as possible without losing anything. They may try but ultimately they can't do shit. Its best to leave it at a friends tho, less hassle. Be strong ,be smart, things will get better. N

The Hospital personnel only have to sign a affidavit that what they saw was the truth and getting a warrant is a done deal. But your right about just anyone coming off the street saying shit usually won't fly. Oh and you don't have to let anyone in your home if you don't want to, the hospital has ZERO legal standing to force their way in. You can call the cops on the hospital if they try to come in without your consent and the police will have to arrest them if you press charges.
