This is from Dr. Bobs facebook page
I am putting this out here and would like to ask all of you to spread the word, on every site in Michigan where you are active.
Background- both the MMMA and LARA's own rules require that cards be sent out within 20 days of receipt and rejections be sent within 15 days of receipt. Clearly the department is not following the law and by suing them, we have the ability to FORCE them to follow the letter of the law, just as we have to. Here is how we are going to do it.
I have a group of attorneys that will file this action, there will be no charge to any patient involved, nor will there be any recovery of money, so I am asking you to do this to help the movement and force action on the part of LARA to stop putting patients at risk by their CHOICE to delay putting out cards for 4-7 months.
There are two groups of patients I need to collect. To be a part of the case, you must have proof in the form of a cancelled check to show the department got your payment on a certain day. Then you must have proof in the form of a letter and hopefully postmark on an envelope to show the department did one of two things-
1. They did not issue your card within 20 days of the cashing of your check.
2. They did not ISSUE YOU A REJECTION within 15 days of cashing your check.
That obviously is a very large group of people. The ones I REALLY REALLY want to hear from are those that
GOT A REJECTION AFTER THE ALLOWED TIME OF 15 DAYS- SOMETIMES MONTHS AFTER THEIR CHECK WAS CASHED
AND
HAD TO DESTROY PLANTS, GOT INTO LEGAL PROBLEMS, OR OTHERWISE RAN INTO TROUBLE WHEN THEY, MORE THAN 15-21 DAYS AFTER THEIR CHECK WAS CASHED, SUDDENLY FOUND OUT THEY WERE REJECTED AND NO LONGER LEGAL....
Contact me directly at [email protected]
I will provide you with proof of the suit (so you know I am not just looking for information about your card status) in the form of a letter from the lead attorney and ask you to fill out an affidavit describing your difficulties with the late rejection or late card, copies of the proof of when your check was cashed and the rejection or card received, and any further information the attorney needs.
Please make this go viral through the MMMA related websites.
