The latest in Arizona’s crackdown on illegal immigrants focuses on what some refer to as ‘anchor babies’ – a label that describes children born in the U.S. to illegal immigrants.

Next on the agenda for border security in Arizona is a bill that would deny birth certificates to children born in the U.S. whose parents are not legal U.S. citizens.

Spurred on by the recent public opinion polls that show support for the recently passed SB 1070 -- a law that allows police offers to ask about anyone’s immigration status under ‘reasonable suspicion,’ the bill targeting ‘anchor babies’ is primarily authored by Arizona state Sen. Russell Pearce (R),one of the leading authors of SB 1070.

While the initial bill requires adult migrants to have proof of their citizenship, the planned “anchor baby” bill would prevent the “next generation from ever being able to obtain it,” – in an attempt to make the citizenship process difficult enough to make illegal immigrants pull up the "anchor" and leave.

However, the planned bill raises questions on its constitutionality – in particular, whether it goes against the 14th Amendment. The amendment states that "all persons, born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States."

Originally, the amendment was intended to provide citizenship for freed slaves and also served as a “final answer to the Dred Scott case,” which spelled out the federal government’s authority over citizenship.

Pearce, however, says the 14th Amendment has been "hijacked" by illegal immigrants.

"They use it as a wedge," Pearce said. "This is an orchestrated effort by them to come here and have children to gain access to the great welfare state we've created."

Though Pearce said he is aware of the constitutional challenges that will be raised, he vowed to introduce it despite the obstacles.

"We will write it right," he said.

Pearce draws support from feedback on public polls– according to a Rasmussen poll, 58% of Americans polled think illegal immigrants whose children are born here should not receive citizenship – 76% among Republicans polled.

Opponents of the bill say it would lead to further discrimination and division in the community.

Susan Vie, a Phoenix resident who leads a citizen group opposing the ballot initiative, says she sees a lot of hate and racism behind it.

"Consequently, I believe it will create — and it's creating it now — a separation in our society,” said Vie, who moved to the U.S. 30 years ago from Argentina and became a naturalized citizen. "When people look at me, they will think, 'Is she legal or illegal?' I can already feel it right now."

The citizen imitative proposed by Vie’s group would prohibit SB 1070 from taking effect and place a three year moratorium on any related laws, including the anchor baby bill, in order to buy more time for immigration reform at the federal level.

The group is currently working to collect 153,365 signatures by July 1 to qualify for the Nov. 2 general election.

Despite opposing viewpoints, both sides expect the anchor baby bill to go before the U.S. Supreme Court before it is enforced.

"I think it would be struck down as facially unconstitutional. I can't imagine a federal judge saying this would be OK," said Dan Barr, a longtime Phoenix lawyer and constitutional litigator, in an interview with Time Magazine.

Though SB 1070 is set to on July 29, the bill may also end up before the Supreme Court, with five courtroom challenges filed against it to date. Senator Pearce, however, says he will win them all.
It scares me to think that one day the majority vote required to change the laws in the country will be tipped in favor of anchor babies themselves to further their amnesty agenda. If measures aren't taken soon, I'm convinced that it will be too late. Since state laws are limited it is up to the nation as a whole to put in new immigration policy in hopes of a better tommorow.

I want this to go through. It will bring an outrage from California, channeling immigration through the San Diego/Imperial area. It will be a testament to the fact that things are different when they are personally involved.

the Constitution says that everybody that's born within the United States of America is an American citizen.

this applies everywhere in the United States, including outlying territories, even military installations.

illegal immigrants ain't stupid. they'll just cross state lines, have the baby in the next state, get the birth certificate, and drive back to arizona...... they sat through 20+ hours cramped with 40+ people in their own filth just to make it to this country.... that's doesn't even count as an inconvenience.....

what this law will do is make Arizona's health care system loose federal funding that's available for this very purpose, to provide care to 'anchor babies'.

when the state's budget starts loosing federal money because of it's targeting of this large ethnic minority, the first program to get cuts will be, you guessed it, education.... making the next generation of Arizonan's even dumber than this one.... :mrgreen:

I think we should go even further and strip anyone whose grandparents weren't born here of their citizenship and deport them as well. Actually.....fuck it, let just cut right to chase and toss out anyone who isn't white or doesn't believe in baby jesus, shall we?

wouldn't it be easier to sterilize the undesirables, a la Hitler?

this kinda reminds me of the escalation of nuremberg laws in pre WWII germany

first they came for the papers.
then they came for the classes.
now they are coming for the children.

how long before vigilantes line the border, shooting first and making judgments later?

Actually the intent of the Constitution was very clear in not allowing anchor babies but Congress, pandering for votes, twisted the meaning like all good agenda filled people do.

"In 1866, Senator Jacob Howard clearly spelled out the intent of the 14th Amendment by stating: Post-Civil War reforms focused on injustices to African Americans. The 14th Amendment was ratified in 1868 to protect the rights of native-born Black Americans, whose rights were being denied as recently-freed slaves. It was written in a manner so as to prevent state governments from ever denying citizenship to blacks born in the United States.

"Every person born within the limits of the United States, and subject to their jurisdiction, is by virtue of natural law and national law a citizen of the United States. This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons. It settles the great question of citizenship and removes all doubt as to what persons are or are not citizens of the United States. This has long been a great desideratum in the jurisprudence and legislation of this country."

This understanding was reaffirmed by Senator Edward Cowan, who stated:
"[A foreigner in the United States] has a right to the protection of the laws; but he is not a citizen in the ordinary acceptance of the word..."
The phrase "subject to the jurisdiction thereof" was intended to exclude American-born persons from automatic citizenship whose allegiance to the United States was not complete. With illegal aliens who are unlawfully in the United States, their native country has a claim of allegiance on the child. Thus, the completeness of their allegiance to the United States is impaired, which therefore precludes automatic citizenship.

The correct interpretation of the 14th Amendment is that an illegal alien mother is subject to the jurisdiction of her native country, as is her baby."

it's not too long ago just such a thing was done in pre WWII germany....you needed all 4 grandparents to be German citizens (not jews or gypsies, either) back to 1871 otherwise you were a half breed or an untermensch...

so i say yeah, let's take this thing to the limit with racial/nationality purity laws. it is the only way to get rid of ALL the 'anchor babies'

Restrictions on immigration to america are actually something fairly recent. The first immigration laws passed in the United States in the late 19th century were blatantly actually racist. The point was basically to keep chinese out. Before that anyone was free to come to america. What followed was a series of xenophobic and racist immigration policies that prevented all asians, most italians, jews and pretty much anyone who wasn't white and preferably protestant. In fact, these laws are the reason that the US didn't admit more jews escaping the holocaust...

if the appropriate thread ever appears, ill tell you about the time my team and i found a group of nomadic bedouin people murdered by iraqi troops,
and what we did to the iraqis after we tracked them down.

now i read storys about illegals entering our country and killing innocent u.s. citizens, so yes, give me a good spotter, an elevated position with good cover a couple klicks from the border, and ill show you how 2 people can effectively control a large chunk of real estate. and believe me, you wont have to kill many at all. after word hits the street back in mexico that hectors head popped of his neck and they dont know how? they wont be trying to sneak in too kill, rape, and molest our citizens.

i also understand that some of you are fully capable of defending yourself, kudos to you! ill just defend the citizens that are unable to defend themselfs.

funny. that this is coming from someone that put on a uniform that represents the struggle and success of free men against tyranny/oppression/persecution.
someone that once was part of a "professional" military wants to KILL civilians...

If u are in the service you got to do that u are told. i havent seen Obama call anyone to the border to secure it. u dont get to pick what u do, u just do it. (right now its securing oil/pipelines/ and to maintain a strong show of force in the region)
if u guys have such a boner for protecting the borders, join the border patrol or shut the fuck up.

as far as supporting illegal immigrants... who said i did? i simply know that almost everyone in the united states is the product of immigration. and if u were to ask a native american they would say it was all illegal. but who cares right? no one is going to check that shit.

i merely understand why they come. the "west" gangbanged the rest of the world for cheap resources and now those poor people want a place to go. naturally they are going to want to come here. after all its the land that was built by immigrants and exploited by the rich.
if u really want them to stop coming here, allow their governments to do what they want and not be puppets of the west. (we also know thats not gonna happen)
so i guess they will want to keep coming and if u put up a fence they will simply find another way, maybe north. once thats secured they will come by boat.
as long as they want to risk everything for a better life they will come.
