If you mean the Tribe/Luttig piece in The Atlantic, that is no academic publication. The Atlantic is not a peer-reviewed academic journal, but journalistic in nature. It’s important to use terminology without license.

Abstract
Section Three of the Fourteenth Amendment forbids holding office by former office holders who then participate in insurrection or rebellion. Because of a range of misperceptions and mistaken assumptions, Section Three’s full legal consequences have not been appreciated or enforced. This article corrects those mistakes by setting forth the full sweep and force of Section Three.

First, Section Three remains an enforceable part of the Constitution, not limited to the Civil War, and not effectively repealed by nineteenth century amnesty legislation. Second, Section Three is self-executing, operating as an immediate disqualification from office, without the need for additional action by Congress. It can and should be enforced by every official, state or federal, who judges qualifications. Third, to the extent of any conflict with prior constitutional rules, Section Three repeals, supersedes, or simply satisfies them. This includes the rules against bills of attainder or ex post facto laws, the Due Process Clause, and even the free speech principles of the First Amendment. Fourth, Section Three covers a broad range of conduct against the authority of the constitutional order, including many instances of indirect participation or support as “aid or comfort.” It covers a broad range of former offices, including the Presidency. And in particular, it disqualifies former President Donald Trump, and potentially many others, because of their participation in the attempted overthrow of the 2020 presidential election.

That might be another consequence of this trial and J6 precedent, others in congress could get snarled up in it too, if J6 was good enough for Trump to be disqualified why not others who could be brought to civil trial where the evidence standards are not as high. The various J6 criminal cases might aid in this too. Gym Jordan is nervous about something ya can smell the fear and he might be one rat away from indictment, I figure Jack wants his ass if he thinks he is guilty, and Gym wanted that pardon for something.

Imagine after Jack locks up Trump in DC and he is disqualified too, who might his coconspirators in DC be? The usual suspects for sure, but what if Jack goes into congress before the election and there are some prime targets there. A big criminal conspiracy case has many advantages and makes it easy to get convictions when the rats start squealing and dealing, Gym Jordan's ass should be good for a walk or close, if someone needed to sell it to Jack.

If anybody in the DC conspiracy case looking at 20 years needs a deal, congress people would fetch the highest bid, get in early though!

Judges can threaten gag order violators with fines or jail time, but jailing a presidential candidate could prompt serious political blowback and pose logistical hurdles.

I think we need to take this one head-on. We need to find out by doing it. The bolded, if heeded, places candidates above the rule of law. Were that man anyone else (like Teixeira) he’d be jailed pending trial after all his judicially proscribed behaviors, such as the infamous “if you go after me” post.

The above looks to me like a distortion of the legal process grounded in politics. This is an opportunity for Judge Chutkan to show courage in containing that man’s ongoing criminal defiance against already existing restrictions.

Yes, but the appeal court has more reason to side with an opinion for trump if the time is moved up. I do not want to see him given even a slim hope.
If an appeal is deemed frivolous, that could get expensive. I have a hunch that expensive is not so good for defendant and co. at this time.

If he is disqualified from running starting in November with a ruling in Colorado and then finalized by the SCOTUS in December, it would cut Trump off at the knees as far as a gag order is concerned. Infact, getting disqualified might make Donald freak out and get himself jailed as well as disqualified! :lol: His two co-defendants in Georgia should be found guilty by December too and a lot more people will plead out.

I'm wonder what will happen when they slomo disqualify him one court level at a time until the SCOTUS gives him the boot. I would be surprised if they didn't disqualify him and so would a lot of legal experts and pundits. Politics will no longer be a factor in his prosecution should be one result of disqualification.

Reinforcing my amazement that this cowardly lion of a man has confounding veteran and service support I read a NY Times letter to the ed. in the Op-Ed section. A ret. LT. Col. Westmoreland from LA. said he was miffed and went through Trumps outright disses from his treatment of a gold ribbon family of Sikh Indian descent to Sen Mc Cain to his refusal to visit graves in France calling them suckers. This Lt. Col. said Trumps right "There are suckers in the military,just not those buried in Normandy".

Head scratching,hair pulling,while his sense of reality is clearly distorted (the shit that's come out of his mouth during Covid and NATO meetings just to name a few),yet Biden is questioned,all the while crowds of admirers STILL show up for his disconnected ,discordant,ramblings,that increasingly resemble a night club act for a Presidential run have me wondering if my reality is distorted somehow as it's increasingly feeling like I'm in a 'Twilight Zone " episode

From other articles, I get the sense that Shvarty left Canada because the heat was on and he couldn't take it. Miami was a much better place to run a money laundering operation.
