Criminal penalties for selling in skool

Sup, my cousin is a dumbass. He is a massive pothead and recently got into sum deep shit by getting caught selling pot in high school. He is a sophomore and is still a minor. Not only did he get expelled for a full year, but he got the cops called on him too. I was wondering if anyone on here could tell me wat his punishments would be( community servise, probation, juvie). We live in Connecticut and here are the charges the polices put on him: 1) possesion of weed under 4 oz. 2) possesion of weed with intent to sell. 3) possesion of weed within 1500ft of a school. 4) possesion of tabacco by a minor in a public place. Do u guys have any idea wat kinda truble he is in?

Was he in the school when he got caught? I think its a felony in most states to be caught selling around a school, that might only be for adults though...

2 words: He's fucked. Tell him to enjoy gaurding his asshole for at least 5 years. AT LEAST. At most, 10. It depends on if he can get some of the charges dropped or reduced. lol good luck to that guy.

I don't know if he's a first time offender he might get like probation and community service and random uas or something. Who knows?

Probation, community service, and a fine. Possibly some sort of juvinile detention center for 6 months or hes 18.

In 5 years, it will be like this never happened, if he learned anything.

a few factors need to be determined! like someone said, is he a first time offender (obvisously, he is not if he is doing all this, so most likely he got caught for something else before)????... secondly, juvenile's receives certain protection under the law... third, all depend on your state juvenile system...


1) possesion of weed under 4 oz.

Guilty!

2) possesion of weed with intent to sell.

Gulity!


3) possesion of weed within 1500ft of a school.

Guilty!

4) possesion of tabacco by a minor in a public place.

Will be thrown out!

1-2-3 is basically almost the same thing as the prosecutor and the attorney will work it out where your lil buddy be charged just maybe 1 or 2 counts... he is a juvenile and will be consider as such! although, its a felony for 2 possible counts, he is still a minor and the worst is a juvenile sentence or even boot camp..
 
Yes he is a first time offender with these charges but he's gotten arrested like 5 years ago for egging a house or sum shit. He also told me that wen he got arrested and brought to the station, the cops wer chill and even threw out an extra rolled j they found in his cigs....anyways the cops said said he would probly get into more trouble for the ciggarettes rather than the selling or possesion. I don't agree with the skool expelling him for a full year becuz they are destroying his education and basically throwing him out on the streets to smoke and sell more pot and eventually move onto selling harder drugs cuz he can't get a goddamn job. And the worst part is that he is one of the best people I kno. He gets good grades, plays sports, and has a great life but he's never given up weed or selling ever since he started a long time ago in another country(Albania). He made a mistake but he's only 15. Plus he has amazing shit and hooks me up free! If he goes down I'll b stuck smoking dro.

5 years or at most 10 years??? lets remember that the person is a MINOR... .. i haven't heard of any case law in any state that handed a sentence like that to a minor for "just marijuana"... secondly, he is just a 10th or 11th grader so he receives certain juvenile protection under the law (both federal and state).. third, most states don't have the law in place where they can transfer him from an juvenile facility to an adult detention because it is consider unconstutional in some cases.. (there is a few state that can do this .. ie california "California Youth Authority"... the max detention there is age 25.. only if the charges was very serious and the minor was charged as an adult, then i can see the possiblity... other than that, lets not scare everybody about covering the asshole...if one conduct himself properly in detention, then one should not worry about being poked!

advice: have a good lawyer represent the kid... not that he is going to get away with troubles, but by having one, the plea bargain will be much better than versus if you just have a public defender!

well, i agree for the most part cause i just barely read that the kid (if true) is his first offense... my 2 1/2 cent tells me that it will be a slap on the wrist as well.... ------> along with probation and perphaps some community services.... i can't see the judge turning a blind eye, if he is convicted of bringing 4oz to school...who knows, its possible...

Yeah I would say slap on the wrist with some drug classes and screenings. I had a buddy with the same thing minus the tobacco. I wish him best of luck though if he can he needs to avoid the drug classes,those will fuck him over later in life.

you're wrong. possession and possesion with intent to sell can be grouped into the same indictment. that way if he's found not guilty of intent to sell, the lesser charge of possession will be deliberated on.

and he was caught with weed in school. there's no slap on the wrist.

it all depends on how much bank and pull his folks have. if it's not much, he's fucked.

he was in conneticut?? that state carries a MANDATORY MINIMUM SENTENCE of 7 years. that's right 7 YEARS.

Redivider:: those guidelines are for the adult court system... he is just a minor... the law and guidelines will be different for him as it will handle in his state juvenile court system which has its own guidelines for determining his sentences..
 
Ite thanx guys this gives me sum idea. I shoulda had a poll asking wat people thought he was gonna get. His court hearing is this Friday so I'll keep u guys posted.
