Friend of mine living in Mendo had a garden going, couple hundred and some drying. I live out of the country and happened to be visiting at the time. Cops came and said he was over the limited and took everything. Took names and details of the people there, took the plants, did a search and found no guns, drugs, money... My friend was on probation (for MJ possession) and was not there when the cops came, but his wife was. They asked me if I was involved and said no, just here visiting with my wife for a few until our return flight back to Asia out of SFO. DA and my friends lawyer worked out a deal, told him to pay $70k and everything would be over. Now before the deal is made the DA wants me and the other couple people that were there to each agree to accept a misdemeanor possession charge of more than 1 oz., do 100 hours of community service, and have informal probation for 1 year. I'm afraid if I don't cooperate it will make things more difficult for my friend, but at the same time I was not involved with what he had going on and don't want to admit to anything.

In my opinion if I just need to send them a little money for probation fees (which my friend says he will cover), do my community service outside the country where I reside, and the DA agrees to expunge from my record if I don't have any trouble in the next year, then it doesn't seem to be much of a hassle... But if I want to fight it then the whole deal could change for my friend... Any advice? :-(

Are you SURE the deal would change for your friend? It sounds like he's pressuring you to take the deal, which, I can't completely blame him for if that's the case. But drug charges follow you for life. And how do you know you can trust them to expunge your record in a year?
No no no, it doesn't pass the smell test my friend. It sounds like you're gonna need a lawyer dude. Also, 100 hours of community service is a lot of time. I know guys on their 4th dui who haven't gotten that much time. Sounds like them wanna charge you with something serious. Did you ask them what the basis of the charges were?
The laws in Cali may say that you being there makes you guilty, so idk but I'd say get a lawyer, and fight this.

Yea it all seems a bit weird to me. Right now he just says this is what his lawyer discussed with the DA. They are supposed to be sending me the police report that has my name mentioned in it. So still at this point I don't really know anything more than what my friend told me over the phone. We will see once that gets here. I have not lived in the US for five years, was back to visit family and stopped in SF to check out the coast before flying back to Asia. I'm back in Asia now. When the police came they talked with me and took all my details, I told them I was only visiting with my wife and then we were flying back home. I have not been contacted by them. So really me now being involved in this is strange.

Just be careful they dont have the same "joint enterprise" law that we have in the UK....basically if 7 ppl go out and 1 of them stabs someone then all 7 are charged with the offence for simply being there.

WTF never heard of DEA negotiating fines and charges on scene right after the bust. Something is wrong with this story.

Dea. Won't ...but he said police..so assuming. It was local..and that happens. On Cali..they want $ to go away, not all that uncommon ...you should help your friend. Out n play ball....I have a few. Friends that I wont visit incase something like that went down.

i'm sorry, but i completely disagree.. why on earth should this dude risk facing charges of his own to help a buddy out?? that's some bs if you ask me..
i'd surely be on the phone talking to a lawyer though.. imo, eff your buddy, you were there for a visit, make them prove that you had any clue that he had an illegal grow going on imo..

....i hope u didnt admit to it....U my friend will be on the no fly list for life...no country especially the usa will let u in..period.

It is a local country issue, not state or fed.

I told the police I was not involved and they weren't really interested in talking with me after they knew my story.

I have proof I just entered the US for travel, have cc receipts showing I was out there travelling. Seems easy to prove I was not a part of an operation.

Seemed it was no concern for me at that time and now even more than 50 days later I have not been contacted by anyone, just heard about what my friend, his lawyer, and the DA have discussed. I'm thinking that possibly his lawyer has devised a plan to involve more people so its not him stuck with all the trouble. In reality I had nothing to do with it, so if this is the case seems I would just be asked to help out and take some blame, but I have not been... Maybe he is just trying to pressure me to take some of this heat so he doesn't get hit so hard since he was already on probation.

Agreed.

Friend also did say it would only be a misdemeanor possession of more than 1 oz., he said more less a ticket...

But the way he has downplayed it all and now I'm suddenly involved just seems strange..

yah, eff his buddy.. this guy did nothing wrong but go and visit a friend.. i still say make them prove he knew that he had any clue his buddy was growing.. dude doesn't even live in this country, how on earth could he know his buddy had an illegal grow going?

and yah, i still stand behind eff his buddy, why should this guy face charges because his friend was an idiot and grew large numbers?? that's the most retarded thing i have ever heard.. i'll be damned if i'm talking the fall for any of my friends..

Well as suggested I will def be discussing it with a lawyer before I talk or sign anything.

Right now just waiting it out to see if I'm sent some papers explaining what is happening and how I'm involved.

I feel like if I'm suddenly involved it was because his lawyer brought me into the picture to help out his client. I have a bit of feeling like he is trying to trick me into taking some blame so its not as bad for him, he says he worked out the deal with the DA but now the DA just wants to get some more charges on his personal record. Do you think the DA would just be after the guy behind it all and not worried about some other small charges to involve more people? Or would going after the main guy and giving a few other people misdemeanor charges somehow help the DA's person record by charging more people? My friend just says its simple, the DA wants to involve you guys because it looks better for his record.

Also this friend that was growing, actually I was there visiting him because I grew up with his wife, and through her I know him. So its not like this guy is a close friend to me although I have known him for 6-7 years. Which means he could easily not be all to concerned with me when considering his own position...

The cops show up and you are on probation and you have a illegal grow at your house and the cops don't even need a warrant to search due to probation. Dude find smarter friends that is dumb move for anyone on probation. There is nothing you can take fall for unless the house is in your name.
