Charged with a cultivation felony charge in florida tampa

Hey,
I was arrested on the 7th with a charge of cultivation and a charge of paraphernalia (for the fertilizer).

I just had one plant between 2 and 2 1/2 feet. I am a 20 year old student with 3.5 GPA. This is my first offense.

I argued that the plant was a male since I had males last semester and still had marijuana pollen on the ground. To be honest I don't know what my plant was; it was too early to tell.

Where the cops screwed up was that 8 cops showed up and detained me without arresting me for over 3 hours. My Myranda rights were never read to me.

I hired a lawyer and I am waiting to be formally charged by a judge. My lawyer did send the prosecutor a letter asking to drop all charges but I have no clue if that will work.

Did something similar happen to anyone? Does anyone know what the outcome could be?

I am an activist with NORML in Florida. We have worked very hard to reduce mandatory sentences, decriminalize possession and allow personal growing. We work especially hard to prevent dis-information particularly from people not familiar with our state.


It was only 5 years ago that growing any amount of marijuana was a felony and then anything over 300 plants was mandatory 5 years. Now,after much hard work, it has been reduced so that anything up to 25 plants is simple possession (non-felony).

just wanted to let you know since your a member of norml, your state by state laws for florida needs to be updated, the way its written it makes it seem like any amount being grown is a felony still.

hey there im a tampa boy too, sorry to hear about ur troubles man, you should either get your charges dropped because of the miranda rights violation or just some probation time, one plant isnt too bad, atleast u didnt have 25 or more or else you would be in serious shit
