Caught with Paraphernilia

Im 16 and got caught with Paraphernilia and i'm probably gonna pass my drug test, and the cop knew we were smoking, and im sketchy about what their gonna do in court and they said I might get probation, and the bowl was empty and I had just gotten in 5 mins. before I got caught, I know, it sucks. But will they do anything cause they knew we were smoking? Will they charge me for smoking too? Or just the bowl? :leaf:

What country are you in? In the USA consuming is not a crime, the possession of a substance and paraphernalia is. If the use was a crime they would be jailing people over a failed drug test.
Was the empty bowl "clean like new" or had resin from past uses? If it's dirty and the resin tests positive, they can get you for possession of the substance.
At your age, I doubt you have much to worry about, probably probation and community service.
One thing to keep in mind if your in the US. If you get any drug charge, you loose all access to government loans for college. If that is a concern, you will want to fight everything with a lawyer.

Yea it had resin but just a little not much to worry about, the only thing I worry about is how long it's gonna stay on my record it's only a misdemeanor 3, and will my record be clean when I turn 18?

Why not give advice to someone who needs help?

Yes, talk to an attorney, and a good one. Its better to pay alot to a lawyer and get the charges dropped then pay alot to the state and have the charges stick.
Find a lawyer thats well known throughout your town. And you'll probably be geting a bunch of letters from different attorneys around your city. Dont choose them.

That is partly true, but not entirely. In the US, if you get a felony conviction against you, then you lose all access to government loans. It must be a felony, and you must be convicted. In the past I have been convicted of a misdemeanor for possession and another of a misdemeanor for paraphernalia and I recently was approved for a government student loan. It was made clear to me when I applied for the loan that if the convictions were not felonies then I would be alright as far as that goes.

I would still get a lawyer though, I definitely agree with that.-P

I was once charged with possession of paraphanelia in Michigan. Paid a $150 fine and it was over. An attorney would've cost way more than that. That was MY situation. It's certainly not a bad idea to talk to one, though.

Your going to court to quick. You should get an attorney and prolong that mess. Find someone that's busy with more important shit like murder or scandal. Often times they won't be able to represent you and your case will keep getting new dates. Sometimes this can lead to the state giving up. Not to mention they'll make the prosecutor get his ducks in a row.
