Is it legal to grow marijuana in Canada?

If not then what are the penalty's?

Also does it matter where the plants are grown in Canada?

Are you seriously asking this question?
Growing cannabis is illegal in every province across the entire country of Canada.

If you get caught, it is really up to the prosecutors what is going to happen. The federal canadian government passed a law not to long ago, removing the mandatory jail sentence for growing up to 1 plant for personal use...

Pretty much if you are growing for personal use, you can get away with probation/community service... but if you are growing any more than 4-5 plants you are likely to go to jail.

Weed is illegal in every province in Canada

The conservatives are currently trying to pass legislation for a mandatory minimum 6 months sentence for a single plant.

Mandatory minimums (US style law) are apparently very popular with the people... but people assume it is for violent crimes... and Harper says his party doesn't look at any peer reviewed studies on these matters(!!!) where the studies conclusively show that mandatory minimum sentences don't reduce crime but add more costs and increase the prison population. There is a reason why America is back pedaling from these types of policies, but the PM needs to increase his popularity, and I guess he thinks he can do it this way, by appearing to be 'tough on crime'.
