Can you be arrested for suspicion of growing maryj?

Example:

Domestic dispute occurs. No violence but both parties are very loud and angry.
Cops are called by neighbors.
Cops come to the door and it is answered by one half of the domestic dispute.
The person is angry and complains to the cops that the other person is/was growing marj.
Let's assume both people own the house.
Cops then ask the angry party if it is ok to search the premises.
Angry person gives the green light for a search. Other person says NO but cops don't listen.
Cops find lighting equipment, nutrients, R/O system, pots and ducting all stored away in boxes and not in use.
Cops see patched holes on the ceilings in 2 seperate rooms which are not fully repaired.

No drugs or paraphernalia are found but one half of the "domestic" dispute says that those particular items were used for growing maryj and accuses the other half of growing.

Lets say these things happened in this order. Just assuming it could happen, and we all know it can. What would be the worst thing that could happen?

Can they arrest you on suspicion of growing? They have the word of the other person and all the items in front of them.

But there is no other evidence in the house. What are the possibilities here?

Wouldn't hold up. No plants, heresay and what would be presesnted as an illegal search in court. Any lawyer who was worth their salt would have you out with a written apology from the cops.

I think the one whom was mouthy to the police needs a lesson in "street Justice"" and maybe a new place to live .....

This is just a "for instance" type thread. Don't assume anything except that it could have been a bf/gf or man/wife dispute. Just take the evidence presented as the cops would say it was. Don't change anything

No, you should be fine, all that equipment is legitimate indoor growing equipment, as long as they don't find MJ seeds or your stash, pipes, bongs etc. you have nothing to worry about.

It should of helped that it was all boxed up, you could have said no to the search without a warrant but you let them in a that just shows you didn't have anything to hide.

Hmmm. The hearsay thing can be disputed because he/she could not prove what was actually grown.

BUT

All the items are there in boxes. That's why I was wondering if they could actually arrest you just on the evidence that was there plus the word of the offended party.

hehehe, once again, this is a hypothetical situation which "could" happen.

Remember in this instance it was the "angry" partner that gave the ok to the cops. Let's assume that he/she is part owner of the house. Can the other person say "no, it's not ok"? Who would the cops follow in this situation?

pigs can't do jack shit... if they try... get yourself a cheap ass lawyer cause he would know whats up "legally" bunch a bullshit!

even if part owner of the house, they can let the cops in without your permission, that is if they do talk heresay on you

Of course it would be disputed, the conversation would be thus:

"Dude's growin' weed, no foolin'."
"Nuh-uh!"
"Liar!"
"Prove it, bitch!"

Besides, they can only arrest you for committing crimes not some circumstantial evidence and word of an angry lover.

You should be fine. But, that other half should understand that if they are both owners of the house and stuff is found and property seized, its the other halves house to that gets seized. Not necessarily a smart way about "getting even". There are far better ways.

I would have claimed that the materials belonged to the other person who brought them into the house to set you up. You had no knowledge of the materials until the other person invited the cops to search.

It is no more proof that trying to prove that just because you are on this forum that you are a grower. You may be here for entertainment purposes. I find the tips here very useful for my understanding of botany and all of these tips will be useful for my tomato garden. Perhaps you had the equipment for your tomato garden.

Police are sometimes understanding and will look at the situation of the "lovers" and see that it is just an argument between lovers and see that the second party has or will again be growning something but unsure of what in a house. you could be growning orchids for all they now so don't panic unless of course they find other effidence of stuff. However i personally have pre paid legal so as to any problems that arise with any officers of the law i have 70 plus lawyers to help me defend myself, a great financial choice if i may say so myself. i suggest if you have access to this type of thing to do it. it is also pretty cheap and you can use it for all kinds of deffence. We have our 215's and we got this as a precautionary, to help protect ourselves.

if there is no illegal substances on the premises you probably wouldn't get in trouble just say all the equipment is for tomatoes or something and i think they would be off yo back

thats why dont just grow weed grow what ever you like ever tried to clone a pineapple?

they would use that to get warrents and try and catch you later in the act or something of that sort but right now that isnt enough for any charges
