can police get a warrant for smell?

im venting thru a duct into my back yard, and the smell is bumpin long time. if a wind kicks up and a neighbor smells something, what can come of it?

okok, but check THIS scenario out. the police come to my house on a report of smells, and i just show them my medical marijuana card (its true). do you think that would be enough to have them be ok with the pot smell, or would they want to see plants, do you think?

the smell by itself is not probable cause. what's enough for probable cause is the smell and that the cop thinks he hears you destroying evidence inside.

so basically yeah, the smell is enough. the cop already knows the language he needs to include in the report to manufacture probable cause so yeah.

put a filter on that bitch before you go to jail.

and there's cops that respect legal grows, others don't give a shit..... so don't think that card is like a magic shield protecting you from the power of LEO... it's not.

There are tons of fine points to argue here, but it's always better to be safe than sorry. Agreed?

That said, regardless of whether the smell is a legitimate PC, a determined cop or P.I. could quite simply sit outside until you spark something. Now, having likely SEEN you in action, he has PC...then a warrant.

If you're simply smoking though, and are doing it casually (as opposed to looking nervous/suspicious in your own home for fear of a raid, for example) I'd imagine you wouldn't exactly set off any 'alarms' within their department.



..........then again, I'm in Canada. It's lenient here.

In a medical legal state you have to follow your states laws. If your not in a legal state but have a card from a legal state... The police can knock on your door, smell it growing and guess what, screw the warrent, they have probable cause " right now " to come in and search. Just like a screaming women, a gunshot, or your wife flushing th toilet, ( flushing the toilet and they allowed to bust in your door even if you didnt answer). A 100 dollar carbon filter will squash any warrant.Get a filter and proper ventilation and theres no worrys
+1. Next to not telling, not smelling is probably the most important security measure one can take.

Though the OP lives in a medical state and has a card. I thought medical states permit the growth of a specified number of plants; he should be home free?

In theory, but in practice you still have the federal government to deal with, theft from "friends" or by people who know about the grow or at random, and all the general problems associated with several thousand dollars setting under a light bulb. :) Better nobody knows about it at all to begin with and hide the grow to begin with properly.............

Your safest option is to treat this like it's illegal and take every precaution to avoid detection.. That said, fully understand what you are allowed to have if your setup is legit (same as knowing setencing guidelines if it isn't)..
Alot of cops don't think twice about manufacturing exigent circumstances when they know they'll get away with it..
