OROVILLE >> Opponents to Butte County's recently passed medical marijuana cultivation ordinance delivered petitions with 12,262 signatures on them in hopes they will lead to the abolition of the rule.
The petitions, which were brought into the Butte County administrative office in Oroville, arrived just two hours before the 5 p.m. deadline Wednesday. If the petitions had not arrived by the deadline the entire drive would have been voided.
If at least 7,605 of the signatures are certified as valid, the petitions will force Butte County's supervisors to either on their own vote to rescind the ordinance or to place the referendum before county voters.
The county has 30 days to certify the signatures. During that time the ordinance is not enforced.
On Feb. 11, the supervisors unanimously approved an amended marijuana cultivation ordinance. The ordinance didn't set any limits on the number of plants that could be grown in outside gardens, but it restricted the size of the gardens and required they be placed a certain distance from property lines.
Under those regulations a garden on a lot of more than a half-acre but less than five acres could have only 50 square-feet of growing space, which must be at least 50 feet from the nearest property line.
The allowable garden spaces grew with the number of acres in the property and topped out at a maximum size of 150 square-feet on a parcel of 10 acres or more. A garden on that big a lot had to be 150 feet from the nearest property line.
At that meeting Andrew Merkel, a medical marijuana advocate who helped craft an earlier cultivation ordinance that was passed in February of 2013, warned the supervisors they would face a referendum over the new rules.
Wednesday Merkel was one of half a dozen people who delivered the signed petitions to the county offices.
He said the petition supporters had paid a professional firm about $65,000 to get the necessary petitions signed in the allowed 30 days.
He said the 30-day drive was a challenge, because of weather and alleged interference by people who opposed the referendum.
Denice Lessard, who carried the box containing the petitions into the county offices, said she was a "patient" signer of the petition.
She said she got involved because she was "afraid of people taking away my ability to get my medicine."
Ron Halvorson, a former Assembly of God pastor, said, while the ordinance does not prohibit the growing of marijuana in the county's jurisdiction, the garden sizes were too small for people to be able to grow the marijuana they need.
If the petitions are certified by the county elections office, the matter will go to a future meeting of the supervisors for action.

now that you have a chance to vote on something you dont want, why not also move to put together something to vote on that you do want?
and if you are going to go to all the trouble to do the second act, then why not make it something that non discriminating against cannabis growers?
in other words why not make something that relates to all humans and their natural rights?

As i understand it: plenty of signatures to petition there super lame amendment. But was/is there enough signatures for the new referendum(that i signed also), which practically won't change much anyways, if it were to go to us voters?

I honestly have no idea, bro... Very little is being said about this and the outcome, almost no publication at all, even all Google searches are coming up empty. If you have any new info regarding Butte County, please post it! If the Ref goes to a vote, it could make large parcels a thing of the future. ;) I do not know for certain but I know previous Refs were aimed at large-scale grows and I know of one which sought to remove the ability of a person on less than 0.5 acres to grow outdoor meds... We, the liberal student body at the 2 colleges put that fucking bill to shame.. :)

If I recall correctly, it was anyone over 40 acres can grow 99 plants and anyone on less than 0.5 acres can grow ZERO. The problem was the, "less than 0.5acre" that made us pissed off.. We don't want to buy from large-scale growers, WE WANT TO GROW OUR OWN! This bill was written by large scale and commercial growers who do not want the average citizen to be able to grow-their-own.

Hopefully, if a new Ref goes to vote, it will NOT make that mistake again because, I know myself and 10,000 other students will be pissed off and vote another big, NO.

As far as I know, it's in limbo. I have not seen ANY choppers this year and it looks like its a free-for-all. lol.. Just don't get the cops called on you for anything.


Additionally, I believe the Code Officers are only going after very large and commercial type grows who make too much noise.

with 50sqft outdoor, I can grow 10 lbs.. i`m not even going to try and grow a plant for 8 months in order for me to maintain a six plant limit. Fuck that... With YES on A, I can grow 99 plants in 170sqft, (50sqft outdoor)



with measure A, I can have 99 plants in a 10'x12' room, that's 120 sqft, PLUS, the 50sqft outdoor, that's 170sqft. So, drug dealers.. let me repeat myself, TAKE YOUR 6 PLANTS AND FUCK OFF.

catch my drift? Measure B is what the drug dealers did to fuck people like me, the "grow-your-own" medical toker - fuck them. They are NOT getting MY money for cannabis.

But if you do live in Chico, a YES vote on measure A, will NOT change/overide this:

Chapter 19.77 of Chico municipal code allows outdoor, residential cultivation of 50 square feet per parcel, regardless of the number of patients. Plants must be enclosed, screened, and 5 feet from the property line. Indoor cultivation (under 50 square feet and 1200 watts) can take place only with a permit stating outdoor is not possible and the building owner approves. States all marijuana grown must be for personal use only.

Paradise is dam near the same:-(

Now, how many people in chico or paradise follow those rules? A permit? Yeah! 50sqft and only 1200 watts? Come on.
I don't care how many fucking plants you fit under 1200watts. 1200 watts IS the limiting factor;-)

Chapter 19.77:

"Any permit issued to allow indoor cultivation shall be subject to the following conditions:
a. An area no larger that 50 square feet may be devoted to the cultivation of the marijuana. This restriction applies regardless of how many qualified patients are living on the property.
b. The lighting used for the cultivation shall not exceed 1200 watts."

Are you possitive measure B puts plant limits on the indoor? I don't see it that way. But, I have emails out trying to clarify. I'll post if/when I hear back.
Either way, who gives a shit how many plants you rock indoor(keeping under 100 has always been a good idea, because of the Fed). How will anyone know? A vote yes on measure A allows ANYONE to complain, B doesn't.
Vote yes on A, and they can then limit your wattage.......because they can, and will(watch, if A passes). A yes on B, they cannot just pass some shit. Which BTW, You seemed pretty against that sort of thing in your first post! ;-)

You know, allot of people can't grow indoors. They either suck, can't afford a power bill, or..........

Passing measure A, will fuck anyone with their rec at another location(multi-rec garden). Not everyone can grow their own, outdoor, where they live. I personally know many in this situation. It is their only source for Meds.
So many things can go wrong with an outdoor crop. You only get one shot at it. To think that a 50 sqft area of outdoor, is plenty for the whole year for everyone/anyone, is well, selfish! (Think 4 pot smokers living under one roof)

If measure B does indeed limit the indoor plant #'s, and passes: Grow trees indoors, if you want to fully comply. I do both, it's no biggie. I'll give you some pointers/help. I can yeild the same per light, weather sog or scrog or whatever.....If not, continue to grow your sea of green, and chill. Nothings gonna happen. It's NOT even punishable by jail time! Basically, YOU could change things up a bit. Other people couldn't, and would get fucked.

I don't think you understand, at all, how many "regular" marijuana growers/smokers/users will get fucked if Measure A passes.

It does, measure B was shit.. It limits indoor and outdoor for everyone except large-scale commercial pot dealers. I just voted NO on both A and B.


"drug dealers" remind me of "tax evaders", "organized criminals", and most I have met were "sleeze-bags". Sorry, power to the people who rock educated careers and support the "drug dealers" ability to weasel through the cracks, welfare checks, cash aid, and social security should be plenty for the "drug dealers".


... and to answer your question - I`ve never sold weed. I have given plenty away to people who were in serious need to use as medicine.
