I just feel sick..... The "Man" is taking over the MMJ business away from us PATIENTS and all us little growers will be either criminals or Money rape victims in the next year..... Either way i dont like it

Maricopa County Attorney Bill Montgomery understands that voters passed a law legalizing medical marijuana in Arizona, but he still wants to bust patients, caregivers and dispensary operators. Montgomery said this week that his interpretation of the Arizona Medical Marijuana Act is that anyone growing marijuana, whether or not they are registered with the state, can be prosecuted. Likewise with people selling marijuana, such as the operators of a dispensary.
"I'm drawing a line," Montgomery said. "If people don't want me to draw that line, they need to choose somebody else."

Billy boy can draw all the lines he wants but the fact remains the law is the law. He can charge people with whatever he wants but the cases will be thrown out of court. The State AG cant charge people with Federal Crimes. The only way he's going to have any success is if he finds someone at the Federal level who starts charging people with Federal crimes which unless your making reality tv shows about yourself and your operation is highly unlikely at present. I will say if Romney gets elected all bets are off.

Spoke with the legal team yesterday and here is what I took away:
Do not be the first few to get entangled in the fight. Even though it seems that this guy is over stepping state jurisdiction it does not mean a court will instantly toss the case, there is an underlying plan here. He obviously intends to prosecute and the ones who do get charged will be spending some good time and money fighting the case. Inevitably, yes, a win is favorable because growers in compliance are protected by the state. This does not mean the case cannot get dragged on incessantly. Also, it would be very surprising if our judicial and legislative branches allow someone to continue to flaunt written/ state law as Montgomery is doing, so it is surprising that he is taking this stance.

With that said, everyone just be cautious, and obey the law as it was written. If you are confused about something take the time to read the laws or contact an attorney.

The state does not want medical marijuana whatsoever. The powers at be are trying to secure their spot for next election. They have to play this card because if Dispensaries never come all the people who voted for 203 because of the 25 mile rule will be pissed. They need to satisfy their typical voters. Also Jan Brewer wants the program stopped regardless of what she has said recently. Horne and Montgomery are just the dirty henchmen who are willing to take the blame. I'm sure Brewer has promised them something if they take this stance. To be honest all that needs to happen is for Janice to stand up and tell these punks they are violating state law and citizens rights. But let's get real...

You know what, fuck this guy. We have a law voted in by majority saying that he can not do this. I am fucking mad and am not gonna stand for this. I will be writing a letter and posting it on change.org. I will try and spread this letter and have it signed by as many voters as possible. If you are as fucking mad as I am and you refuse to take it anymore then chose to take a stand with me and sign this letter. Let's tell these fuck bags who they work for and that we are refusing to be pushed around and bullied by our own state. Fuck this shit anymore I am done putting up with this crap!!!!

The way az law is written, once a dispensary opens within 25 miles of a patients home, that patient is no longer authorized by the state to grow and would face felony charges and nl protection under the Arizona medical marijuana act. So that's why he cares for this very reason it makes every small home grower care.

"25 Mile Rule" is Unconstitutional

What happens to patients cultivation rights when a dispensary opens within 25 miles of a patients address? How will the patient be noticed? How long do they have to stop cultivation?
Please explain the plan!!
When the first dispensary OPENS near me I will file a LAWSUIT against that dispensary and The State of Arizona.

Section 13. No law shall be enacted granting to any citizen, class of citizens, or corporation other than municipal, privileges or immunities which, upon the same terms, shall not equally belong to all citizens or corporations.

Each qualified patient will be notified upon their annual renewal if a dispensary is open within 25 miles of where they live. If you renew with a request to grow and there is not a dispensary open within 25 miles you will be able to continue to grow. The final rules for the dispensaries are still being developed so you will want to check back to our agency website for new developments. At this time we do not have a date for the completion of the final rules and no dates for when the Department will be able to license dispensaries.
The 25-mile rule was part of the Initiative passed by the voters, as such is set in law.
