ADVICE PLEASE! Roommate walked in on a bust with a box full of clippings.

i posted this in the legal edge forum but i figured ide get a more active response from residents with more local legal knowlege.

so my roommate was bringing a bunch of unrooted clippings to a friend to root them for us. he rings the doorbell and the guy is an undercover cop whose busting the place. apparently our friend isnt following the law in regards to growing medicine in Colorado. the cops then snag my roommate, question him, etc. they didnt issue him a ticket, but they took the clippings.

they said they might contact him down the road as the investigation with our friend plays out, and they also seemed to hint that my roommates medical status might be in jeopardy, but he hasnt been charged with anything.

my question is, is he going to lose his card simply because we were trying to get help rooting clones and we werent using a legitimate legal caregiver? the cops did say that you can bring clippings to a dispensary to root them for you but that was news to both of us. we were completely under the auspice that our friend was totally legal and that as long as clones are in the proper sized medium and under 8 inches they dont affect plant count. any help is appreciated as i dont want my roommate to lose his card, thus lowering the house plant count.

I would be more concerned about them wanting to look around your place, make sure all paperwork and plant counts are in order.
You have one huge thing going for you here, they were clippings not clones. Until it has a root system of its own it is going to be very hard to claim that it is its own plant. He should be fine as he didn't break any laws, just was associated with someone who was.
If they do threaten to take his card, i would fight it, no reason for him to lose it based solely on someone elses actions.
Just my thoughts though, good luck hope all goes well for you.
Also, no where does it say that you MUST posses a red card, but if you don't you fall into the affirmative defense category.......

much thanks man, yeah first thing we did once he got home was remove anything of questionable legality. plants are always up to count, he spoke to a lawyer and said that there shouldnt be anything to worry about and that it wouldnt be tough to fight regardless.

i went straight into fucking panic mode when he called me and told me what had happened, as this sort of bull shit never seems to end in my life. but i doubt anything will come of it.

there goes about 50 afgooey cuts and 15 bubba kushes. FUCK!!!

pot heads? maybe the pot head is u. u cant root ur own clones? dont u read this forum or do u just ask stupid questions. if u spent more time reading u could find a way to root ur own

You can root cuttings in a damn window sill , there is no need to get like that , the problem evolved from you involving somebody else in your stuff , if you rooted your own the problem would not have occured would it!!! to say you dont have space for a few cuttings is a cop out , they need minimum light and how much space do 65 root riot cubes in a tray really take up ?

Dude its not rocket science, keep a cover on them and a little water in the bottom bam!!! Roots 10-14 days gel/powder HELPS BUT ITS NOT REQUIRED mine is like 10yr old powder still works great it was my gpas.. Lol. I have some sittin on my kitchen table with no light but the one from the ceiling fan and window, and nearly all ofthem rooted

Changing a caregiver takes one sheet of paper and 30 days. My friend has his paperwork in order, landlord calls the cops and cops show up, they were like why did you call me? You should of just told him to leave. He's like you want to check them out, he only had 18 plants. "No we know about the grows in the area, have a good day." But if you've got 65 when the max is 30 for private caregivers, then that's where attention is brought to. Stick to the laws, still make money, don't be greedy and you won't get caught. bongsmilie

I hear what you are saying about usa rules and a cutting being a plant , but surely this is a lesser of 2 evils rather than involve someone else in your business , i would never enter a clone into my growspace that someone has rooted , who knows what pests/fungi could be introduced , his problems were easily avoidable is everyones point i think.....
