A Moratorium Has Passed What Does That Mean For A Caregiver?

Please help, i am pretty worried. I just read in my local newspaper that macomb township has issued a medical marijuana moratorium on "issuance of permits, licenses or approvals for the sale or dispensation of medical marijuana."

Im a caregiver, does that mean i have to immeditatly tear down everything, and look for a job?

well, most of these cases of counties Instituting their OWN rules are illegal. one you are protected by FEDERAL HIPPA LAWS, which is your right as a Patient or Care Giver to be protected by Medical Information Protection via the Dr/Pt confidentiality proponants of the HIPPA laws.

So by saying you have to be on a LIST of PTs/Cg in the county your in, is a violation of the HIPPA laws, and illegal for them to do.
also, if they are going to look at your grow, then they have to have the same type of inspections on ALL grows, regardless of what veggitation is grown, including but not limited to, Annual and Perenial Flowers, Home Gardens where edible vegitation is grow like Tomoatoes, corn, squash, cucumbers ect.... anyone using any non natural form of grow equipment.

i wouldnt worry about it, but if your making money, put a lawyer on retainer. I suggest Matt Able there in the Detroit area, or Micheal Komorn out of GrandRapids. both are MMJ Specific lawyers and know the LAWs here in Mi.

yes, Medical Marihuana is Medical. HIPPA protects Medical Information from ANY entity gaining access to it. For any LEO to get access, a Judge, with DAMN good reason, would have to Force the LARA/MDCH site to disclose that information thru a court order/warrent.

for instance, 2 guys in Ann Arbor or Kazoo area opened a dispensory. sounds like they were dispensing more than just MMJ. got busted. PA and LEO (not sure if Fed was involved but i think so) wanted to get a look at these guys MMP records held at the MDCH, but to date, best i have found out, they still have not been allowed access to these two guys MMMP records or anyones records at LARA/MDCH.

fyi, LARA, which is Uncle Schnieders new Corporogovermental agency, is now overseeing the MMMP (Michigan Medical Marihuana Program) and implementing the MMA 08 laws and regulations.

if you visit the Mi.govs MMMP site, you ll see it is now under the LARA heading opposed to the MDCH (Michigan Department of Community Health). And infact the MMMP is now actually handled by the Medical Licensing department, which is the same department that allows Doctors to obtain Licenses to Practice Medicin in the State of Michigan. Interesting huh? now the agency the controls what drs are allowed to practice Medicine, now has the info on what Drs are "Recommending MMJ" to patients.

If i were a Dr that offered recomendations here in mi, i woulc setup a CMA (COVER MY ASS) file and be sure to have a great lawyer on retainer

thank you for the response! I feel a lot better. I actually met with Matt Able a while bac when I was getting started to make sure everything I was doing was legal. Hes a good guy and seemed to know the laws quite well.

Also in Macomb, what paper was it in, i would like to read it...

This is to make sure dispensaries don't start popping up in MacombTWP, not for private caregiver/patient relationships.
