3 day notice from Landlord with no Charges?!?!?

Ok so i had a little set up in my room ive been renting, the landlord turns in my grow room (instead of asking me to terminate my shit). Ok so im walking home and i see two squads in my yard. Im like ok im not going home right now, i think ill head to the library. In about 5 minuets i get a private call. Surpise, its a detective. Basically we work out a deal where if i come and destroy my plants no charges will be made.I really could have flaked on em cause they had no search warrent but i decided to work with them, i mean no charges sounded reall good.

They were good for there word, so that was clean. But i just got a 3 day notice to leave. IS this LEGAL? can i be evicted with no charges?

Be happy with no charges and move on. Your life could be so much more miserable if the situation were reversed.

only was i see it not being legal is if ur a medical patient then u werent breaking the law but if u werent then yep since u used the property in breaking the law but if ur have a med papers then u should at the very least get ur prorated rent and deposit or can sue

Most leases are "at will" and can be terminated by either party according to the termination clause(usually it's lore like 30 days, 3? that's lame). Get the fuck out(hope you have a place to go), seriously.

lol yeah i would gladly but he doesnt want to give me my security deposit. There was no contract whatsoever...?... i did have him sign that i did payed him a security deposit. I just did some research and i found out that if he changes the lock on me that im entitled to 100 dollars a day post lock because legally he has to take me to civil court and deal with it that way, even if im not paying rent, haha punk landlord. He kicked a previous tendant out without giving him his security just about a month ago, and plus he tried to raise rent 50 bucks for utility a month after i moved in, the deal being 500 plus utilities. MY roomie is getting the same treatment and he plans on suing him. i guess its a vialation of the tennants handbook, or aka the law, so he will have to pay for his BS. He (my roomie) has a attorney and gave me the tip that the landlord cant kick me out if there were no charges... So i will stay intell my month is used than ill take the bastard to court to get my security.

Ok so my security is my main concern as of now. The only thing that it can be used for is damages if i know what is to be known about security deposits...:confused:

only reasonable damages u caused and he has to prove them in court so he cant say well i had to replace carpet and not have a reciept. take pics of how the room looks when u leave so in court u can say look the room looked great and he lying and wont give me my money

An answer to your questions requires a lot more info.

Mainly, what State you are in. To me, it sounds like you lucked out and should go away without making a hassle.

On the other hand, if there were no charges against you, and no official documentation from law enforcement of any wrongdoing, then you may be able to stay.

In my area of California, once you live in a rental for over 2 years, the landlord has to give you a reason to terminate your tenancy - even if it's month to month. In other words, they have to have "cause" to terminate your tenancy. That's not always easy to do. In California they have to go through a legal eviction (unlawful detainer) process through the court system, which can be a pain in the ass.

And yes, in California landlords have to document the damages being claimed.

You are a very lucky man if no charges were placed. My research shows cops set you up by the "let's make a deal and nothing will happen" cop lie. Goes with the - everything you say can and will be held against you right = cop friendly until he has enough info. to bust you then he just does his job and busts you leting you deal with mr. judge on the facts...You must have had such a small grow they wanted to check and see if you were big time and didn't want to deal with small stuff. Hey, many are turning to the side that weed isn't a huge crime for personal small stuff unless your the dealer. you won the lottery in this case...

did the landlord give u 24 hrs notice b4 going in your apartment? they cannot just go in anytime they want w/o your permission or giving u 24 hr notice. u could of beat the charges if so. the landlord cannot consent for a cop to enter w/o ur permisiion. the cops cant just walk up knock on the door and say the landlord consented to a search and walk in your place unless the landlord had given 24hr notice they were gonna be there looking around. and found it and called the cops.

they are trying to get him to snitch probally. been there myself...."if u help us out getting the real bad guys we will let you go scot free. we dont care about the small time guys like you" ......"they get really really mad when u make up a bunch of total bs and send them on wild goose chases, lmao. ie-"well, tonight their will be a kilo of coke brought up at someplace and time." i made some pretty crazy shit up and they were buying it hook line and sinker

Hey Dark, curious how long that continued on the goose chases etc. and did they turn and bust you for not finding mr. big time for them? wondering in your case if they busted you for the original issue or are they still holding it over your head and calling you for help? fill us in so we can learn from the experience?

they had already promised they would only give me a warning b4 i agreed to *help* em. i told em b4 hand i wasnt 100% sure on any of the info i'd give and the detective who i was talking to said he'd write the warning beforehand so i knew they wouldnt screw me and still press charges even if the info wasnt the most accurate (none of the info i gave was even remotely true lol)

talking to me??? i gave em nothing true at all for 1. the 3 times were about 1 day apart each.....the first time they talked to me, the 2nd later at the station with the detective who offered to write the warning and 3rd time after he wrote the warning. i got in no trouble at all. that happened 6 yrs ago. i never snitched on anyone, i was leading the detective around in circles w/false tips, im not dumb enough to let myself get fucked over by the cops by just believing promises....i need everything in writing first. in summary...i didnt snitch and i didnt get in any trouble, whats your problem with it? i dont understand

Nice work Dark....I got no problem with that....They asked and you gave. Like when I am fishing and someone sees my big fish and asks where did you get that from? Without beiing an ass I say, you go over to the covey point and fish all up the left side about 10-20 yards out and i bet you find a real big one....Both happy.....not even close to my spot....

My gf gotted busted smoking pot by a forest ranger when we were camping. I swear to this this day that bitch sucked him off cause on the sitation said that "they" were picking up and removing foliage from a national forest and using for a campfire. This just so happens to cost about the same as a pot ticket. But it will not get scholorships taken away. We had a 3 yr relationship but after that incident she turned hard the "they" just in case she told me, i did not acoust her about it so i will never really know...at the time i was just glad not to be going to jail over her dumb ass......but she was freaky and that whole weekend on to the next week no sex, and never any more bjs!

Ya no charges were pressed. I think the reason i was able to get off was they came over right after they found out with no search warrant, i dont think my landlord actually knew now, he just peaked in my window and saw intense light emiting from my closet and was spooked. He probably thought 'hey this is probably illegal so ill call the cops and have hime kicked out so i can keep the deposit because thats what i did to the last tenant' I think this because he was kinda suprised when i opened the cabiet. So the cops were there and they knew i might sneek up and find out what was going on so they worked a deal with me. I was SUPER sceptical my self, and probably should of told them to fuck off without the search warrant, but idk it was pretty messy.

IT was pretty funny actually because they were like what are these, why are they so small? (i started with seeds) so i told them i started from seed. Then with a seriously intuitive face the dective asks me why i didnt start with clones? It made me giggle.

But anyways i found out that if he kicked me out with no charges, or in any case, with a 3 day notice, which he cant do in either case (he has to go through the court to legaly evict me) that im entitled to 100$ a day if the lock is changed. So basically all he could do was ask me to leave. Research pays. ive yet to read all posts, thanks for the comments though.
