i am not a legal scholar, just a layperson. so i don't know if it's too lenient, but it is definitely more lenient on white people and more harsh on blacks. that does explain some of the discrepancy we see. other things also explain it.

Blacks generally do not come from the upper middle class suburbs and never learn much white collar crime, so they turn to more direct types of crime for the quick buck and a hustlers attitude. Things like robbery, drug dealing, murder for hire, muggings are much more common in those poorer communities. These crimes are usually so heinous in the minds of most people due to their physical and violent nature that the citizens demand action due to fear that it might happen to them. People don't protest as much or grab the pitchforks and torches when some Con artist white man commits embezzlement and puts 20-100 people in the poor house. People don't fear those kinds of deals because they figure they will be able to avoid such pitfalls. Much easier to catch a murderer who left finger prints behind than an insider trader using dark pools to make trades illegally.

i honestly never actively considered that aspect to explain the discrepancy between arrest and incarceration rates. i just figured there was nothing about skin color that made a person more or less inclined to crime.
