Canada Post says packages are intercepted if they are not from authorized medical pot producers

A Vancouver Island man says he is caught between new rules and an old system still working through the court system after medical marijuana he tried to send by mail was seized.

Last week, Ryan Malazdrewicz of Ucluelet, B.C., tried to ship a small package containing pot to his wife who is away visiting family in Alberta.

Malazdrewicz said both he and his wife received licences several years ago to produce and possess medical marijuana, and they use it to treat pain following a car accident.

But Malazdrewicz said his package never left the Ucluelet post office. When he asked why, he said staff told him it had been seized.

"Right now they are stopping my wife, a law abiding citizen, from accessing her cannabis," he said.

In a statement, Canada Post said there are controls for shipping marijuana because it is a prohibited substance outside of prescribed medical use.

If marijuana is detected in a package that does not come from an authorized distributor, it is intercepted for further investigation, the postal service said.

New regulations
Health Canada brought in new rules in 2013 for the production of medical marijuana.

Under the Marijuana for Medical Purposes Regulations there are only six companies in B.C. that are authorized distributors.

But the rights of existing licence holders such as Malazdrewicz are still before the courts, and he said it is frustrating that his package was seized.

"I would like to see the RCMP actually work on what I would consider to be crime," he said.

Malazdrewicz said he either wants his package returned or sent to his wife in Alberta.

RCMP have yet to comment on the matter.

i guess if you're sick and don't bring enough, you are made to suffer.
i think i am able to send pharma across the country with no fear of seizure.
i look forward to this being over and we can be treated as "regular folk"...well i'll never be normal or regular but it sounded goods

He needs to file an official complaint and get his own case started. He might just blow it wide open for everyone!

you can't..well you can but it won't be successful because the law says you can possess it but you can't ship it to anywhere but the "legal" address and it can only be shipped from a DG or LP.
no thought at all about the patient.
our Government was forced to do this and it really shows! they are making it as difficult as possible

Then the law itself is a case of discrimination. If I can send myself oxy's, legally, I can send another controlled substance. Canada post accepts shipments of weed from LP's, so denying someone the ability to ship that same legally obtained product is not going to fly. I predict buddy will have his meds returned quietly with a stern warning not to do it again.He can then take that letter and use it to argue against LP use of Can post. They are a crown corp., we own them, they need to have one rule for everyone.

@dishes is right, only LP's and DG's under MMAR can ship via Canada Post (legally). I hold a DG pink (and PPL), I always shipped in sealed Mason jars with no issues ever.

Just curious? How does one legally send oneself Oxy's in the mail? I'm just wondering how Canada Post would react if they found a bottle of Oxy's in the system?

As long as it's in a prescription bottle with your name on it, it is your legal property. I don't see any reason you couldn't ship it or what crime you might be charged with if you did. Canada post isn't interested in Oxy's being shipped, or weed if it comes from an LP... they are still acting on the Harper CONs directives to target mmj patients I think. There seems to be at least one marijuana story per day in the news lately, maybe it will cause Phalen to remember he is supposed to release his judgement.

I don't disagree, I'm just saying if they ran across a prescription bottle of oxy's you can almost guarantee they would seize it....just to look into it if nothing else.

This individual needs to file a application for a human rights tribunal. Considering Canada Post is a federal crown corporation it wont look to good on them...
I've also had a package seized
Called they said no way to pick up a post office and show license because Canada post doesn't allow cannabis thru mail system
But never received a seizure letter like I have in the past when my seeds were seized by customs thru the mail !
Someone is keeping these packages!

We must hold them accountable!

seeds are not seized through the mail They're legal to deal with in Canada!
if The post takes anything they report it to the rcmp...if they have taken something and you report it to them...
it gets reported to the rcmp again and they do an internal investigation as well.......
it does not happen often because of this!

you are only allowed to ship from the production site to the residential address of the patient.
please check it out. i have had the argument with HC as well as CPC. there's no one with common sense. only how to fight back and do the absolute minimum

I'm not saying you're wrong...just they are. If there is no such restrictions on other medicine, someone needs to challenge it. It would be easy enough to say it must be shipped registered mail so only you can sign for it with ID. I sent it to my residential address, sort of, but it was a box # and in a different town than what HC has on file. I moved. She should have said that is her temporary residence, and as HC has refused to administer changes, she hasn't broken any laws.
