Should the US grant Political Asylum for MM users?

A Japanese man who has been residing in California and is fighting Crohn's disease says his time in the United States is up and he must return to Japan. He has been using cannabis to treat his ailments but upon return to Japan will no longer be able to treat himself this way. He says going back to japan is sentencing him to a slow and painful death.

Kenichi Nalita (Narita) is the first medical marijuana patient to fight for his rights to medicate with marijuana in the Japanese Courts found his way to the US after years of reaching dead ends in Japanese avenues of research, education, and government.

Why the hell would anyone grant him political asylum for using marijuana when 800,000 people are arrested on marijuana charges every year in this country and sick people are having their homes trashed over tiny plants and small bags of pot *In states where they aren't even breaking state law.
