Senate Passes Bill – Only Governor Chafee Can Stop Bill Now
Posted on June 21, 2014 by joanne145
Late last night, the Senate passed the House’s bill, H 7610 SubA. The bill passed 32-2 with only Senators Miller and Walaska opposing. This vote was in spite of the vast numbers of calls made by members of the MMj community. Only Governor Chaffee can stop this bill by exercising his veto power. He can be reached at 222.2080. Call soon before he signs the bill into law.You can leave him a message urging him to veto H7610 SubA. Without his veto, this law will take effect September 1. A significant amount of patients and caregivers will have to decrease their plant counts, move to new spaces, or close their gardens altogether before that date or be subject to arrest. We understand that the Attorney General wants to eliminate abuse in the Program but this bill will also eliminate or reduce the amount of medicine currently available to some of our most vulnerable patients. To read the bill, click: http://webserver.rilin.state.ri.us/BillText/BillText14/HouseText14/H7610A.pdf

This was such a blatant display of RI corruption, it boggles the mind. Introduce it with 2 days left, no debate, go on break and spend the $$$ that the dispensary owners gave you in a black bag.

As long as this is laat ammendment to bills before they legalize. Its not as bad as i thought... one big issue is if this passes and they make people report locations which 'may' be verified by state police... they will soon make everyone report grow rooms and names will soon be generated on a list

If it gets passed/signed, I am speaking to an attorney right now for potential stoppage due to hipa law violations.

Not really. The original bill (that cut plant count down to 3 I think) had plenty of comment from the public, and died. This amendment was sprung 3 days before the session closed, skipped all committee meetings where comments can be made, and was railroaded through. Dispensary lobbyists handed out envelops full of cash -- and say what you want about the corrupt assholes in government here, they stay bought once they take the cash.

It also says on there that they can confirm you have a card by your registration number OR NAME...

So they can just call them without any cause and see if you have a card.

I love the fucking geniuses that think you have a privacy right under HIPAA. So you know, HIPAA is a federal law. And using medical marijuana is against federal law. Hope you don't spend any money on lawyers to go down that path. I read the bill and it's not too bad. People need to get over themselves and clean up our program. Get the large scale drug dealers out and let the patients/caregivers continue to grow with set terms.

The issue is, its biased rather than fair... they know the cardholders cannot keep up with dispensaries enough if they take away veg plants to stay perpetual with a co-op. Also, they know co-ops will not be able to get inspections in reasonable time and will not submit to police there location... cardholders plant count is not dispensaries issue. Its their own problem they created. Not saying cardholder want to keep up with dispensary but thats most likely hw they view it.

Is there sonething the state police give you to show your registered with them?

How will fire department know inspection is good enough? What guidelines do they have to follow?

I could be wrong but seems like they just added grey areas. People having to add sprinkler systems to rooms which landlords wont like and cops showing up to 'verify' location. There is possiblity of coutless things that could come of this.

I do agree with you to a point though... its just not fair to the roommates who want small setup for personal use.

Rules pinpoint EVERYONE like they running bad places. Makes no fair to normal people to have shit gone through.

Also, allows plice to confirm with name only is bad idea. Allows a list to be made without police knowing a person is actually doing something illegal. I do agree they could be worst but when iy comes to laws nothing should be 'good enough' thy should be perfect.

HIPPA covers medical information. Period. Just because there's someone federally illegal going on, it does not suddenly invalidate that protection. In fact, this is *exactly* the kind of thing that HIPPA was passed to protect against -- private medical information being used against you.

The state will be gleefully sued for this, probably by the ACLU (who named it one of the worst bills of the year), but if not, by a greedy trial lawyer. If the improbable *does* happen and the gov vetoes the bill, it will not be because of any "be kind to patients" motivation -- it will be because he (or his AG) recognize that it's an expensive lawsuit waiting to happen, and one that will be litigated in federal courts that he doesn't control (unlike the kangaroo RI benches). Even if the state won the initial suit, it would undoubtedly go through another expensive appeals process. It's just bad business to sign into law. Sadly,as the 38 Studios thing shows, "bad business" is the way this state operates.

Thanks TryN. You and the rest of the legal scholars on this page must be right. Have fun in federal court making a medical marijuana claim.

The state police and Feds can and do get information regarding prescriptions already. They can generate a list of patients that a Dr. Prescribed a certain opiate or allergy medication for. This all falls within HIPPA without breaching Dr. patient confidentiality. As long as all people with access have been trained annually and sign off they are covered. I don't get the HIPPA approach.
