Raided and not charged over 6 months later?

That's fucked. Seriously, dropping out of college for 6 months and moving some where else would have been a waaaaaaaaaaaaaaay better idea than sitting tight and wondering what'sup. Felonies are no joke. No arrest warrents=no problem with moving. Now if he moves, he'll be held in contempt of court and he'll have a warrent out for his arrest. Best of luck to him, and yourself. Now is the part where they start checking in with all his buddies. A guy that sells a QP knows where there is a guy that has pounds. What I recommend to you: Hold very little weed, stay away from friends that you and your buddy share, and carry only small amounts of pot with you. Seriously, don't buy anything over an 1/8th. If for some reason the cops come to your house and you have even a sellable amount of weed, than they may try to implicate you as well. Normally cops start with your buddy and they work their way up the ladder from him, rather than down the ladder to people that sell ounces half ounces. The cops are now looking for his hook up for pounds. However; if they bust some small fish in the process (hoping that the people that they bust have pounds, but if they only have ounces, meh, they'll charge you too and see what you know). Keep all of this in mind and trust nobody, a guy with a qp is a big deal-Believe it. It is not considered a waste of resources when someone is selling 4 ounces of chron.

i just thought of something too, make sure they bring up the college part and ask for probation/dismissal so it wont effect the guys studies. -just some food for thought-lol

IF he had left the state they would have had a warrant released FOR that state....it doesn't GO AWAY just because you move like your suggesting, bryguy420.. And an illegal drug is an illegal drug, if it be 1 gram or 112. You will be prosecuted, I don't understand why someone would try to justify an amount. Its illegal. period.
ANYWAY, freakfrom1134...I would heed his advice in dealing with others, just be careful who you associate with. Especially while the investigations are still open. Like I had stated, we knew it was only a matter of time before they came with the warrant.

Ok, after reading 3 pages worth of speculation, I figured I'd actually give the TC some real advice.

This is a common tactic by police officers. They have way bigger fish to fry than your buddy with the QP. They have him on a paper record, DO NOT DOUBT IT. They filed his evidence away, so there is definately paper work on him. He may think that they are watching----They are not. Oh sure, they'll drive by on routine runs throughout your town (if you normally noticed officers drive by occasionally before the raid went down) AND if the officer that is driving by is familiar with your situation than he might give a passing glance---(they do this to keep a tab on what cars are parked in front of your house regularly. They are searching for high traffic that would re-indicate that your buddy is back in business)---

If your buddy shows up to get booked, which the police are hoping that he is dumb enough to do, than he may give a confession and do all the hard work for them. They have up to one year to act on any charge. What the police like to do is wait for as long as possible---make their suspect sweat. Make him nervous, and when he (your buddy) thinks the coast is clear, they hope that he will start selling again, or at least start smoking again. They will be back. It may take 8 months, it may take the full year, but that's what the police want you to think (that you never know when they will be back) Just keep in mind that they will come for him.

This all happened to a buddy of mine back in February. Same story, only they found an ounce and some lights instead of plants and pounds. My friend gave the police every oppurtinity to charge him. When my buddy called his lawyer up and found out that after 4 months that he still hasn't been officially charged nor did he have warrent out for his arrest---did he decide it was time to pack up and move. He moved from my state to Alaska. Your buddy might not have to move that far, but I do recommend that he definately MOVES. Out of state would be the best idea, but at the least out of whatever county that you guys currently reside in. That way this doesn't follow him and he can avoid the arrest. If the police come back and your friend isn't there, they will file everything away and in the end, they only keep his stash. Cheers and good luck to the future.

You ever heard of someone being extradited?
Thats what happens to a criminal when they have an outstanding warrant in a different county, state, country. Depending on the criminal activity and flight risk, the arresting agency in conjunction with the warranting county, state, country...will make the decision to send you back to serve out the warrant.

if you pass the statute of limitations, and you were never charged, you're in the clear. no record, no nothing. the "evidence" won't come out in a background check because you were never found guilty of any crime. chances are that "evidence" has already been photographed and cremated (or sold back to the street, crooked pigs) so I'd say you're in the clear....

look that up, it might help you....

if you're in Cali I'd say fuckit...

pay 20-30 bux for a background check from some service, that way you'll be 100% sure....

the story has progressed a ways now and in a terrible note his friend got arrested for it,the cop asked him where his shoes were and he said in his roommates room (who wasnt there at the time i believe) so the cop went into the other guys room and saw a pipe sitting on the counter and then said that was probable cause and searched the room and found his shrooms. so both ended up in jail.

I am fully aware of the extradition process. The fact still remains that if he left the state and flew under the radar, then he'd be fine. The cops won't just show up at his door step one day, and a qp really isn't worth trying to track someone down that could be ANYWHERE in America. If he got out of the state before he was processed, he might not even have had a warrent out for his arrest. I mean, he might, but who's to say it would show up if he got a speeding ticket in Ohio instead of whatever state that you are currently in now. Even if he did have the warrent, assuming that he did everything he could to avoid the police, he probably would have been fine. He just would never be able to go back to his home state, without the risk of the po catching up to him. Shitty situation though. I only hope that I never have to weigh out such crazy options.

Fine for the moment I suppose, but running from something that may seem so small to you (a QP) has huge consequences..I cannot justify up and leaving my fam tryin to run from the law over something like this...just not a viable solution. Ride it out and get some more plants in cycle to start paying the court costs off and plan some time before sentencing to spend with the loved ones. Dude is lookin at 2 felonies and a misdemeanor, probably end up with just 1 felony or 2 misdemeanors. Depending on the state he can file for appeal after sentencing and everything is paid off, to have it dropped from records (after years). Anyway, just sayin this because I'm in it, dealing with the reprocussions for the next 2 years..

wait, that really happened? or is it like a 'what-not-to-do' story?

on a general note: when the cops show up, never go back inside the house... why do you need shoes at a police station, or a shirt and pants for that matter? esp. if you know there's a pipe, or a nug, or shrooms, or a meth lab, or illegal pandas... it's like people are just hoppin' in line to self-incriminate...

damn, i think these guys almost deserve this...

let's call one of them Dave, one of them Alan...

Dave and Alan are roomates. Dave gets arrested for dealing drugs. The cops take long to charge him, and goes to the house, to "get his shoes". Alan has shrooms, and pipes, weed, seeds, etc. Alan lets the cops in the house, they find all his drugs, and he's also arrested.

I mean, he (Alan) should've just walked up to a cop and kicked him in the nuts, since he apparantely WANTED to get arrested.

Why the FUCK are you gonna let a cop inside? no matter how buff/mean/intimidating they may sound, they can't go into you're house.

speechless.

Social Darwinism at work....

before you start doing something like this you should at the very least know about search and seizure. ... good luck with the whole court thing...

Welp, heres a twist to that...if he was already in custody (in handcuffs) they CAN go in the house to obtain belongings....just not search. IF there was paraphernalia in plain sight that can be probable cause to arrest Alan.
Where Alan fuct up was allowing these things to be exposed for the police to see.
His roomate, Dave, should have been arrested, shut up and gone to jail in boxers.. sad thing is this could have all be prevented...

They can't go into your house if your arrested. He probably asked them if he could get his shoes, cops said fine but I`m going in with you. He let them in the house and bam busted..

This similiar situation happened to me, I was waked up at 6am to the police with a warrant. I opened up the door without thinking and they nabbed me. I was wearing just boxers and gym shorts. They asked me if I wanted to go inside and grab something. I said sure, he started following me I turned around and told him to wait outside..Once they arrest you, they can't let you out of their site. So I went to jail in the winter in a pair of shorts.

they can search anywhere the person who was arrested had access to at that moment(hard to say it right, bear with me) if he had been sitting on his couch they could search the immediate area he could of hid shit in or whatever, they could search his seat and the door area if he had been in a car. if im wrong on this and i misunderstood what ive read let me know, lol, but no flames please

yeah, but the thing is that it's his immediate area, apparently the cops showed up an knocked on the door to get the shoes, not the "POLICE! SEARCH WARRANT!". i don't think a "no knock warrant" applies in the case, for the guy didn't have weapons, and apparantely he's a low-baller.....

they might get a warrant for the house he lives, for common areas and his room. but what these guys did was just plain STUPID.
 
I mean the door to the roommates room was shut so the cops had no right to go in there however I do agree my friend should have just said yea I'm going to jail with no shoes. While you may think that my friends are dumb (which at times its hard to disagree with) the cops were far worse. The roommate though did hear the cops when they came in and managed to hide some of his stuff before they got into his room (his bong, a pipe, and an eighth of weed in a zip-lock bag) between his bed and the wall. When the cops started their search they called in a k9 unit (which wasn't even done the first time the place was raided). And the k9 found nothing! the only thing that I can think of is that cause the whole place smelled so much like weed the dog didn't know what to do. Cause this all happened at like 11am and they didn't get released and get home till like 5pm and at 5pm their place still completely smelled like ganja from whenever the last time they blazed was.

Besides the dog missing the bong, pipe, and eighth of weed the cops also searched the fridge. In the fridge they found mushroom chocolates but because they mushrooms were powdered up so much they couldn't figure out what it was. They even crushed some of them on the counter to try and figure it out and finally they just threw them away. They also took out a piece of weed fudge, looked at it, and put it back in the fridge. And they found a bag of weed seeds that they left as well.

my hometowns 1 k9 unit is like retarded or something too, lol, i know of at least 5 times(3 of them i was there personally and i know the other 2 are true though i wasnt there) when it failed to pick up on bud, i couldnt believe it the first 2 times it happened, i thought i was going to jail for sure. lol. so the guys roommate was home when that all went down? i assumed he wasnt home when it happened, if he was there he should of had enough time to at least tossed his peice in a drawer or anywhere else not in plain sight and just refuse to let the cops go through his room w/o a warrant. did the cops just walk right in or did they knock on his door first? if they didnt knock they are fcked, any good lawyer should be able to get it dropped.

Any time someone runs from one state to another to avoid things like this you just end up flagged on a computer and nothing is usually done about it until you have the misfortune of running a red light or some other stupid shit. Then they'll see the warrant and at a minimum your car will be towed, you will be hauled into the local jail, and you'll sit there a while while they contact the other DA to see if they want to extradite you.

And just because it's small means nothing, it's all up to the DA or whoever and you know how they feel. It could be 20 years later, doesn't matter, they just get angrier with you if they see you've avoided prosecution for a long time.
