I'm new here (obviously, note the post count) and I figured I'd kill two birds with one stone by introducing both myself and the petition I recently started.

It's called "End the Prohibition of the Peaceful Trade and Activity of Cannabis Consumption" and isn't worded as a typical petition would be.

I'm sure all of us know that petition means a formal, written request or plea. However, this petition is worded more as written declaration rather than a request. The text of the "petition" is as follows.

The will of the people shall be the basis of the authority of government - (UDHR Article 21) As all governmental and police powers come from the people who inherently hold these powers it stands to reason that we the people do not need permission to carry on peaceful activity and trade, just as we do not require permission to carry on peaceful worship. The collective voice of the people wish to carry on in the peaceful activity and trade of cannabis consumption of both the psychedelic and non-psychoactive varieties. It thus stands that as the will of the people shifts from the manufactured consent and illusion of separate government authority into the realization of inherent political power that any governmental police power acting in opposition to the will of the people is unlawful.

The original wording that I had worked out had to be trimmed down to fit within the websites character limit. Although much is left to be desired and the thoughts conveyed are only the tip of the iceberg I do feel that it is a good starting point.

Many people do not know that for those of us in the United States of America the assumed policing power and enforcement of cannabis comes from the "general supervision and control" clause found in most health codes. In it, unelected officials (yes, people who are appointed to power, not elected meaning they received no actual consent from we the people in the form of a vote) assume "general supervision" and "control over all matters of health" regarding the citizens. The wording differs from federal and state statutes, but the fact remains that same that those who hold no official elected status are given supposed authority over our health.

This is a staggering implication as the United States Congress continues to exercise an overreach in power. This claim to authority over the health of individuals is far from what the framers of our Constitution and the Founding Fathers had in mind. Thomas Jefferson wrote: "The care of every man's soul belongs to himself. But what if he neglect the care of it? Well what if he neglect the care of his health or his estate, which would more nearly relate to the state. Will the magistrate make a law that he not be poor or sick? Laws provide against injury from others; but not from ourselves. God himself will not save men against their wills." It is clear that those who drafted and ratified the Constitution of the United States of America never intended for government to have such widespread powers to enforce health mandates.

That is why I am taking steps to confront our corrupted governmental officials, who without the consent of the people, gave power to unelected officials over the health of individual citizens. For those who have yet to look up the Controlled Substance Act, it can be found in Federal and State Health Codes.

Many individuals whom I have had opportunity to discuss and debate often note the fact that two states have already legalized cannabis and many others have allowed for medical marijuana. While this is all fine and good the greater implications are much more important.

In the Federalist Papers X James Madison outlines the ways in which to quell the uprising of factions within the union; either remove the causes of faction or control its effects. He states that destroying liberty would work because "liberty is to faction what air is to fire" but also states that liberty is essential to political life. The second way is to create a society all holding the same view as the faction. Neither of which are logical responses in our form of society and government, thus Madison concludes that you can only control the effects that the faction has.

It is interesting to note that the government is currently operating outside of its constitutional defined powers and as people continue to call foul the government reluctantly gives in. Cannabis however has been an uphill battle since day one. What's my point in all of this? Quite simply that we should not be appeased because the government is finally striking down laws which it never had authority to enforce to begin with. By considering this a victory for the people we are in fact admitting that they and only they have the right to give to us and secure our rights. This is an erroneous assumption as to the workings of our government. Until we revoke consent to having our lives and our healths regulated by these people whom we did not elect into office I do not consider it a win for the people.
