Hi, I was just wondering how the whole legal process grows. I now how the application and everything works but as of right now its like the law doesnt even exist. I have spoke to some local authorities that say they have been instructed by senior officers to arrest ANYONE in posession of marijuana cardholder or not. how long does it take for the authorities to come to terms with the law. The state is suppose to have provisions for getting the apps and everything setup by april 4.

Thats a bit disturbing to hear!! I'm waiting for the Southfield Clinic to call me with my appt date, hopefully early next month. I was told the clinic will go over all of the laws but what good are they of the police won't follow them?

thats my point exactly. as of right now there is still a loop hole in the law that states you are able to posess seed or clone but it is still illigal to obtain them. so how do you get them without breaking the law. their are a lot of people that would be qualfied caregivers but most of them are scared to get involved. also a lot of doctors dont want to get involved because of the possible reprocussions. I still dont understand alot of the senior officers take on the situation. there is a group of people that meet in the state to help inform possible patience and it made the news with an officer stating " the nerve of these people we should bust the meeting and all involved". this is B.S. how can you have a state mandated law that is not properly followed by the people the tax payers pay to serve and protect the people. how long will the ignorance be tolerated before something is done about it is my question.

I was told the same bull shit! Michigan is just looking for revenue and if they can bust you that is just money they are making! I am also looking into getting my card but the parranoia wont let me....

I saw on the news a few weeks ago a lawyer was saying that if you become a MMJ patient here then you might as well hand over your drivers licence because we have DUID laws here. I can't remember exactly what he said the reason was but it was basically that after smoking pot because THC stays in your body for a day and a half that under our law you can't operate a motor vehicle for that amount of time or be arrested. And obviously if you are medicating with the herb then you are gonna use it more than that so it's like you can never drive again! Isn't that bullshit? This state is filled with fucking idiots!!

Your exactly right. Michigan is one of a few states that has DUID or "driving under the influence of drugs." If you get into a traffic accident or any other traffic related violation that they decide to drug test you on, and you have ANY traces of anything in your system, you loose you license for a year.

That is bull but I guess we have to start some where! I am seriously looking into it myself. I just am A very parinoid person, Has anyone looked into the whole care giving further? Here is another thing is were can you get your strains? Is it still illegal to order beans and have them shipped?

I have started to get things ready to be a caregiver and am looking for patients in the mid michigan area. I will be getting my cert from oaksterdam next month. I havent started any growth yet cause I dont have anyone interested thus far. If anyone is interested in a caregiver let me know. once we talk and come to an agreement then I will start the cycle which will take 3-4 months before harvest.

There are not any 'loopholes' in the LAW. You can't write a law that conflicts with federal law, and supplying seeds would conflict with federal Law. That is for after the meeting, not during.
Instead of coming in here whining about what some dick said, read what the law says so you can be part of the education team......OR you have let some underinformed asshole accomplish their purpose.
THE LAW SAYS any law that conflicts with this new law is changed to reflect the new law. The duid has to change to reflect this, internal possession of Marijuana is in the definition of the Medical Use of Marijuana. What LEO would have to do is prove that at the time of the arrest, you were under the influence of Marijuana. Since your Lawyer has advised you the only test you are required to submit to is a breathalyzer, you are sorry, you will not be taking any other tests.

You need to get edgamacated. Learn what to say. 63% of the voters, that is over 3 million people, voted for this law. It passed in EVERY COUNTY in this State. 3 million voters said they want LEO to stop harassing Medical Marijuana users. They told us they were just following the law, if you don't like it, change the LAW. We did that, the LAW has changed.

I have been stopped by LEO 3 times in the last two weeks, no one has messed with me. Of course being a 60 year old white man may have helped too.lol
In case you missed it, the law can be applied to any pending Marijuana case if the defendant can get a recommendation from a DO or MD.

Now caregivers is another matter. You could cover yourself with an affirmative defense if....you have signed agreements with qualifying patients to provide them with Medical Marijuana. According to the Prosecuting attorney for Berrien County, you could buy Marijuana on the street and as soon as you possess it, the Marijuana is legal, the person selling it may not be, but unless you tell us.....
This 'Fear Mongering' will only stop if we get ourselves educated. We have to know what the law says and why it says it. I like the one were they mention seeds, how do you get em. You go on the internet just like a million other folks do and order them. Do a search for Marijuana seeds, there were 39,000 plus when I did that 3 years ago, I bet there are 50,000 by now. Or send me an address, use the PM's that is what they are for, and seeds will magically appear in your mail box.

I currently live in Mi and I have yet to apply for a card because i keep reading that it does nothing. Cops are still righting tickets and arresting people for having a card and pot. The police budgets are so low right now that if they stop busting people for having pot then they would be losing a crap ton of money. I think they are not following the laws that the state laid down. Bull shit to the fullest IMO. . . I plan on being a care giver if the police will start to follow the laws. Has anyone gone to the place in southfield?

I think the way it works is if you are the care giver then you are able to grow the 12 plants and have 2 1/2 oz per patient. You ask for donations on what your grow. There is a donation price that you can set to help with the cost. At least that the only thing I could see working since selling pot is a federal law. . . :shock::twisted:

Well......you are not allowed to sell it, because that would conflict with Federal Law. You can however, recover your costs, and doing so does not constitute sale of a controlled substance. Letting law enforcement get away with saying it doesn't make any difference would be a tragedy. The clinic in Southfield is THC-foundation, they recently saw patients in a couple of other cities as well. 30 people in an area, they will try to schedule something. Over 700 have turned in applications for the cards since April 6th. There are four dofferent clinics or Doctor's listed on our website, all of the information is available there. Do not be lazy, read it. Do not let intimidation by LEO stop you. VV

VV- when you say recover your cost how do you mean? Also does that mean only A select few can get there cards? I know I am able to get mine without A problem, but is it limited to A certain number? Were is it that it shows the list of clinics?

I wish I could afford to get my card. The cost of getting all my med records and everything else is very expensive since I have to go through 2 hospitals to get my stuff. I no longer have insurance so Its going to cost about 400 plus my MRI's are over 3 years old if not more so the place in Southfield may count those out.

Your Medical Records are just that, you own them. You don't have to have a current mri, call and ask. VV

Most of the clinics are in the South-East corner of the State, make sense because 1/2 the population of the State lives in the Wayne,Oakland, and ?? tri county area( sorry temporary brain fart). The are threads about all of them in the MMMA forum, goggle Michigan Medical Marijuana, the first listing is our website. Lot's of confusion about what the rules are, some may be decided in court.
The first thing anyone needs to do is read the law. You can get a lot of information from www.qualifyingpatient.com , all of the information about what a lawyer says the law is, that has studied it and supports us.
This Law is a lot stronger for protecting Medical Marijuana than anyone except PeanutButter has talked about. The definition of 'Medical Use Of Marihuana', the often overlooked 'Definition of Terms', gives some really 'broad protection' as long as you can 'logically show' that your possesion off MJ was for assisting a patient. We were planning on testing that theory, things changed, we still believe he could have prevaled. One pending case from 2007 got dismissed, another from 2008 became a 'littering charge', he threw the bag out the window and then proved the medical so the possession charge was dismissed.
There are four pending cases I am aware of and all of them are being discussed in that forum. When we know about a case, we show up to support the victim, lawyers advertise, etc.
Not much growing information there, a lot about Michigan Medical Marijuana. Being registered patient/caregiver you could be protected for up to 72 plants and 15 usable oz. VV
