It look like you may be overwatering, in that pot, at the size of that plant, it should be able to go many days without watering. I do think you may have a pest issue too. Use a loop/magnifying glass and take a good hard look under the affected leaves.

What about captain jacks ready to use neem oil, and shouldn't I wait for the sun to go down first or could I just put it in shade for rest of day if i do it ?

Yes, neem oil can work. And yes, Spray in the evening or early morning when they arent in direct sunlight.

After some research I think ur right on the leaf miners..I have a new thread with new and better pics of everything...hoping there's no root issues
Yep after some research it looks like it's put some DE on effected leaves and stalk and sprayed em with neem last night.. do you think I should cut effected leaves if they get worse?
