Leaves Eaten Small Flies.. Pics

Not sure what kind of insect this is but it is eating my leaves! Help, anyone know a safe solution? Here are some pictures..

It is, very likely that is a fungus fly. they're eggs come with most soils, and they appear when the soil stays moist. The easiest and about only way to keep them under control is to use mosquito dunks. The only way i've found to get rid of them permanently is microwaving the soil before you plant. But you may want t hurry. Not only do they eat leaves, they're larva feed on your roots.
