Judge rules for House GOP in ObamaCare suit

A federal judge on Thursday ruled in favor of House Republicans in their lawsuit against the Obama administration over ObamaCare.

In a major ruling, Judge Rosemary Collyer, an appointee of President George W. Bush, said the administration does not have the power to spend money on "cost sharing reduction payments" to insurers without an appropriation from Congress.

Collyer's decision doesn't immediately go into effect, however, so that the administration can appeal it.

“This is an historic win for the Constitution and the American people," Speaker Paul Ryan (R-Wis.) said in a statement. "The court ruled that the administration overreached by spending taxpayer money without approval from the people's representatives."

This is pretty simple. The administration can go ahead and challenge it but ultimately the Congress has the power of the purse.

If the Executive branch was suddenly able to appropriate money and spend it as it wished the legislative branch would become irrelevant.

Not a matter of interpretation here.
 
And Obama pushed the act thru late night before Congress had a chance to digest the thousands of pages it was. Air head Pelosi really cracked us all up - "we have to pass it to see what's in it."

Your laser sharp analysis has certainly convinced me. Here I always thought those 1940's through 1960's southern Democrats evolved into the modern southern Republican base after the Civil Rights Act of '65...

Inside the bill was a requirement that funds be appropriated by congress for a specific program.

Congress did not appropriate those funds.

Typically that would have ended the program. The congress would have been able to exercise the power of the purse.

However, Obama illegally re-directed funds earmarked for another program into the one he wanted.

It was illegal and the judge upheld congress on the issue.

Before Obama can spend the money on something, Congress has to approve the theft to begin with.

That raises this question...

Where do the individual people that call themselves "Congress" get the right to steal the money in the first place?

The people collectively gave them the right by voting. You understand the answers to some of these questions.
