Looks like its going to trial. Owner is a piece of
shit and I don't shop there but I still hating seeing
people getting fucked by pigs.

http://www.livingstondaily.com/story/news/crime/2015/05/13/marijuana-grow-bindover/27263859/

Here's a nice quote from the article summing up how
fed slime feels about states rights and cannabis:

"On cross-examination, the three co-defendants’ attorneys
questioned the witnesses about whether they knew if the men
were medical marijuana patients and/or caregivers under the
Michigan Medical Marihuana Act.

One DEA agent replied he “wasn’t concerned” about the MMMA
paperwork because he was operating under a federal search warrant
and seizing marijuana."

Odd reporting. Neither the "drug-related charges" nor the defendants MMMA patient and/or caregiver status is noted. Those seem like pretty important facts of the matter to me. It looks like our media wasn't concerned with MMMA rights either ...

LOL, I was thinking the same. Can't say I'm shocked
with the Livingston paper reporting it the way they did:bigjoint:

I have no idea but I'd be willing to bet that some or all
of them have their cards. It would have also been nice
for the article to note that a caregiver in the state of
Michigan could have up to 72 plants depending on the
number of patients they care for. Kind of makes the
whopping 40 plants they found look like some peanuts.
I wonder what that entire operation cost the taxpayers?
Rumor has it that our fine state might have some roads
and bridges that aren't quite considered "perfect", too bad
no money can be found to do something about the problem...

It sure would have been nice to at least report exactly what Livingston County District Court Judge Carol Sue Reader found to be the "probable cause" to finally bind over these charges two years later. Unlike the DEA agent quoted, Judge Reader along with Livingston County prosecutors and law enforcement cannot claim that they are not bound by MMMA Section 4 protections/rights granted to patients and caregivers. We really need a public conversation here to shame these asshats into submission, as sadly no penalty of law has been established for such transgressions of state power against MMJ patients and caregivers that have been occurring constantly state wide for the past 7 years regardless of it's clearly written prohibition. I'm sure getting this family law judge to go forward with such a complex circumstance of criminal law wasn't a product of judge shopping ;)

Let's contact Livingston Daily justice reporter Lisa Roose-Church at 517-552-2846, [email protected] or Twitter @LisaRooseChurch to see if she'll truly consider reporting this story.

The thing to remember is Federal Cases in Federal Court are out of State Jurisdiction.
The only Possible Redress for these cases, is if the Jury Abstains to Judge, Nullify and Acquit.

Even when we Repeal and Decriminalize Michigan in 2016, we will have to rely on Jury Nullification in Federal Courts.

"On Tuesday (5-12-15), Livingston County District Court Judge Carol Sue Reader said there was probable cause to bind over the charges lodged against Grow Green MI owner Jeffrey William Mote, manager Anthony Charles Portelli and alleged "marijuana farmer" Richard Lee Riley to Circuit Court for trial. No new court dates were immediately set."

This is clearly not a federal criminal case as probable cause was just found years later to bind them over in our state's 44th Circuit Court this month to try them in our 53rd District Court located in Howell, Michigan who knows when.

The confusion and quite frankly the questionable integrity of this matter comes from a DEA agents testimony heard within Michigan's 44th Circuit Court from July 2014 to April 2015.

"One DEA agent replied he "wasn't concerned" about the MMMA paperwork because he was operating under a federal search warrant and seizing marijuana."

If true, that the DEA actually solicited and received that search warrant to raid these locations and seize Grow Greens Michigan business records along with MSP (executed 5-7-13) from a federal judge, how the fuck did they end up years later before a Livingston County Judge successfully claiming to be above the law that the court and proceedings are clearly bound by? Did the results and reality of whatever "probable cause" they had presented to that federal judge whom would sign such a search warrant get them tossed out of that federal court?

Something really fucking stinks here ...

MMMA 333.26424
4. Protections for the Medical Use of Marihuana.

Sec. 4. (a) A qualifying patient who has been issued and possesses a registry identification card shall not be subject to arrest, prosecution, or penalty in any manner, or denied any right or privilege ...

If the truth can actually be extracted from this court (44th Circuit Court & 53rd District Court), this just may be the case to sue the State for redress of our rights under the law (MMMA) ...

It is a natural progression, especially in a quasi-legal marketplace, for business owners to fraternize with large accounts. That "fraternization" will sometimes flow in both directions... The authorities know how to address those situations, as we see here. BTW, there is likely a "trap" placed on their website, don't visit the link, and would the OP please edit and delete that for the safety of all...
Not a bad idea to give the grow:weed:green link a rest.

man13 may wish to remove it fro his post, but it's a buyer beware world we live in!
I already clicked on it shit!!

Meet the Cliff Notes of the 4th Initiative. The language is nearly complete. I should have it ready to submit in a week or 2.

"STATEMENT OF PURPOSE:

(1) Abrogate all codes, laws, policies, remove penalties for all cannabis

(2) use/associations.

(3) Removal from Michigan Controlled Substances Act in perpetuity.

(4) Cannabis/cannabis associations no longer actionable offenses

(5) against any persons in any manor whatsoever by Law Enforcement,

(6) Private, Local, or State Agencies/Agents. Strike all

(7) relevant Public Health/Criminal Codes and shall be kept in perpetuity.

(8) Allow cannabis use for persons 18+, minors with parental/guardian

(9) consent, for all treatments, research, medical, businesses,

(10) educational, industrial, manufacture, development/deployment, like

(11) other plants, plant products into any forms.

(12) Retail taxation/regulations conform to standard state tax codes.

(13) No Sin Taxes in perpetuity."

THIS is the only redress for 2016 and for Michigan. FULL REPEAL OF PROHIBITION ON CANNABIS, just as our Grandparents and Great Grandparents did in 1933 when they repealed the 22 Amendment. Then picked the pitch forks right up to STOP the Government Legalization of Alcohol right after prohibition was repealed.

Join us on Facebook if you want to actually end the Insanity here: https://www.facebook.com/groups/1579620145653960/

I also have a Website/Forum on the way. Couple weeks out on that right now too, but by July First. It should be on like Donkey Kong.

Only Question you have to answer is, Do you only want Legalize Recreational Dope by doing just the right NOW Thing (this nonsense of baby step bullshit). Or do you want to do the RIGHT THING and Neuter the Fucking Government?

That is exactly what the language does. no fine no fee, only regulations is what is sold commercially/retail, no special fees, licences, limits, gov administration, 6% sales tax only on new non food non medicinal items. Common sense legislation. Verbiage to protect the legislation from being changed by any way shape or form except by a later Peoples Initiated Constitutional amendment.

Language is pretty tight and right I think. And on that note, its 4:20 am.
have a good one! lol

The case of three local men charged with growing large amounts of marijuana illegally has been bound over to circuit court. 49-year-old Jeffrey Mote of South Lyon, 50-year-old Richard Riley of Brighton, and 41-year-old Anthony Portelli of Whitmore Lake have all been charged with delivering or manufacturing between 5 and 45 kilograms of marijuana, the equivalent of between 20 and 200 plants, as well as a generic charge of delivering or manufacturing marijuana.
