got busted and need some help....

In state of california and if your a medical marijuana member and let say you drove 5 hour to your co-op and purched let say 2lb of dry weed and some clones and this is within your medicial certificate allowed. On the way home you get pulled over (maybe for speeding) you are straight up with the officer and even present your certificate (should always have a copy stashed somewhere in your car) but the officer confiscate your clones and all your smoke,(driver is not arrested, your let go however without your medication) there is really nothing you can do. This has been enough of a problem that the cannisbis clubs like cal normal, other affiliated groups made an appeal to the state to allow certified medical user to be allowed keep all there marijuana and not have it taken. The state agreed to try to have the officer try to show little more leniency, which says that the officer can use thier discretion as to take all of it or they can leave with approx 1/4 oz at the most, or not sweat you at all. Thats alot of money lost and your time and most important your medical medicine is gone. Important to remember just because you have your current certificate doesnt mean they can not conscificated your stuff.and if they do the worst thing you can do is cause a scene, be professional you may get arrested but not from posseion but for your conduct. If you were to get pulled over Its up to you if you want to tell the officer that you are transporting cannibis for medical purpose and maybe with your calm conduct the officer my just let you go, now if you or your car smell of cannibis you just need to be straight up with them, there not stupid. If your tranporting, should always follow the road rule do not bring attention to your self. Probale cause could be anything like if you have anything hanging from your rear view mirrior no matter how small that gives them proble cause (called obstrution of view) transport your stuff in the trunk or at least not under your seat or within your arm reach radius, meaning that while being in your driver seat in extend your arm out and do a complete circle, and officer can search your car within your arm reach without probale cause. When your transporting you should always have your driver license and registration & insurance card in a central locatin in your car so your not haveing to open unnessary compartments, I keep mind on top of the center council, dont have any illegal paraphernalia in plan view, that is an automatic vechicle search. The marijuania reform is still farley new just be patient things will iron out. The point of all this is use your head, you may have your stuff taken dont get upset and do something stupid to get arrested, be professional and fight it in court. Driving under the influience or having a joint while driving is an automatic arrest even if your a passenger you cannot smoke while the vehicle is in operating, just dont do it period. I rather have the thought of getting home in couple of hours then thinking of going to jail in cuffs. Give them respect no matter, if you happen to get an officer thats having a bad day you dont want to upset them anymore, remember we are now on there turf there highways. Radar detetors are good investments, they keep me looking at my speed odometer with all the faults alarms.

Even though admitting you smoked was a bad idea, and you made several mistakes, all the officer needed for probable cause to search the vehicle was to say they smelled marijuana. Glad you got off with a warning. Now ditch the shrooms.

Ok bud there is something you need to know about cops, especially female ones:THEY CAN DO WHATEVER THEY WANT, WHENEVER THEY WANT, AND WHATEVER THEY SAY GOES AS LONG AS NOBODY BUT THE VICTIM IS THERE TO SEE IT. In other words, you just got screwed over. That cop was not allowed to search your car without your consent. Have your friend be a witness, but most likely the court will take the cop's word over yours..

It's sad that cops can do this. The only thing you can really do about it is... well start a riot or leave the country. Sorry, USA has asshole cops and you just met one.

im not sure exactly what your college situation is, but i know if i get a um i lose all fafsa aid for a year. If you get fafsa then i think its the same. so obviously the upm is the most important (if you recieve aid) you should go into court aand plead not guilty and ask to go to trial. theyl give you a new court date. the next time you go in theyl call you back into a room to plea bargain (negotiate) with the d.e.a when you talk to him its important to not disclose any imformation that would convict you, dont admit anything! odds are if you tell him your a college student and the upm will terminate your fafsa for a year he will drop the charges. most dea's dont like to make kids drop out of school. if he rfuses to chage it to a different, non - drug charge, ask him for an ajournment, to seek legal counsil. Fortunitly for me he plead it down right away, so i didn't have to ask for this. But if you live in america, he has to give it to you. At this point you have to go and employ a lawyer, but the odds are good that you can get the charges dropped by yourself with out spending a penny.
Also i havent faced an open bottle charge, but it is possible that an alcohol charge would effect your fafsa. If it does, just tell the DEA, he'l probably drop that to. Like i said they dont like to put you out of college, and they know that most any lawyer will have a field day with it anyway.

edit to add * be prepared to do some community service, i got 15 hours and parking on the highway for; upm, violating my conditional, and no tail lights. I got to keep my license and stay in school

1. never ever admit to anything... ANYTHING.

2. Kicking it at the parks is one of the worse ideas you can have.. especially if you are confined to roads (meaning you aint on foot).. Police... Jackins... anything could happen... I would think parks would be dangerouse places at night.

3. Always take the keys out of the egnition and stand outside of the vehicle when your partying...

4. Clean up your dumb ass acomplices.
If you are having people putting empy beer cans in your car and hiding them... and then not taking them out when you are safely at home or near a trash somewhere. then you are riding with people that dont give a shit about you... you say you dont drink... then your gonna end up in jail or prison getting it in the ass for something you didnt even do...

5. Pay the fine and learn from this.
Getting a lawyer wont do shit for you.. a. you told on yourself giving her access to the property you have access to. If you would have been chillin at the bench they arent gonna go searching your car. b, the fine vs what a lawyer will charge is going to be a big diference.

Man you need a girlfriend that will let you smoke and chill at her pad and drop the loosers that arent looking out for you...
