Ok... I have not lived or worked in CA in four years...
However, a job I bid [my SS# was attached to the bid-6 years ago] was wired and completed by a friend...in 2011...
The company contracted with sent my SS # a 1099... when it should have gone to friend....
This friend paid his taxes earned on this job. The 1099 issued to me on this approx $10,000.00 contract, was attached to friends tax return...

Now, FTB is sending bills to friends address, with my name on it...
He's been just "Throwing them away"

Friend sends one to my former accountant, and Accountant, Makes out a tax return for me/1099 to Friend for same amount [un wanted] and bills me...
This might have corrected the issue, except, I was worried about non payment or even a late file fee... so I said "No Thanks"

I send it back tell him, I will not admit to making any money in CA when I didn't [fraud] ... I feel like this would have opened a can of worms, and my gut said no... ...accountant gets pissy....

So, I told friend to send me the info...

Should I try to help the FTB out her, with a phone call ?

$430.50 Fine
$103.91 interest

I'd call a CA Tax Attorney and have them write it up and mail it in CRRR. Shouldn't cost much but at least the CA FTB will stand down. I'd expect my friend to pay for it after throwing away notification for years! If I paid they would not be my 'friend' anymore.

The thing is, I didn't make any mistake...
My friend really didn't make any mistake...except throw notices [I told him to]
I just don't feel like I or my friend should have to pay anything...

If as an employer I sent you a incorrect 1099 to your SS# to an address you never lived at...
You would be liable?


As a foot note:
I always paid my taxes, and filed always on time never an extension, or late...
I just am not a tax payer any more...
If I filed in CA... Then I'd need to file Fed?
I now live in another state...
CA is messed up...

I spoke to a real nice lady at the Franchise Tax Board...
She told me that I needed to have company that issued the 1099 to wrong person [me]
Issue a new one to the Friend... and Fax her a copy.
I am waiting for company to get to office...
If they will not send the corrected 1099, to the correct person....
Then they will be liable for any future issues...
We'll see
