A man accused of assaulting police officers with a baseball bat during the January 6th Capitol riots says he should be let out of jail before his trial because there haven't been any additional violent pro-Trump rebellions for the last six months.

Via NBC 4 Washington investigative reporter Scott MacFarlane, accused MAGA rioter Rob Gieswein's attorneys argued in court on Tuesday that he was "unlikely" to engage in another insurrection because the circumstances surrounding the January 6th riot were unique.

"There has been no repeat of January 6, or anything like it," Gieswein's lawyers wrote. "While the assessment of future conduct mandates individualized study, the contextual circumstances of January 6 are shared, and as such, the conduct of other defendants who have been at liberty should inform the forecast for Mr. Gieswein, too."

Gieswein faces some of the most serious charges of anyone arrested for participating in the MAGA riots, as prosecutors allege he assaulted officers on the scene with a baseball bat and with bear spray.

A criminal complaint filed against Gieswein cites statements he made in which he said he wanted to intimidate politicians who have allegedly "sold out" the United States to Israel and the Rothschild family.

Judge rebukes GOP for downplaying US Capitol riot as he hands out first sentence in insurrection

(CNN)A Trump supporter who spent 10 minutes inside the US Capitol during the January 6 insurrection was sentenced to probation Wednesday, avoiding jail, becoming the first rioter to learn their punishment in the riot investigation.

At a hearing in DC federal court, Judge Royce Lamberth said the insurrection was a "disgrace" and forcefully rebuked the "utter nonsense" coming from some Republican lawmakers and other right-wing figures who are whitewashing what happened.

"I don't know what planet they were on," Lamberth said of the GOP lawmakers, without mentioning any names. Recent releases of videos from the attack "will show the attempt of some congressman to rewrite history that these were tourists walking through the capitol is utter nonsense."

Anna Morgan-Lloyd, 49, from rural Indiana, had pleaded guilty to a single misdemeanor for trespassing inside the Capitol as part of the crowd on January 6. She was also assessed a $500 fine.

Lamberth said Morgan-Lloyd avoided jail time because she didn't participate in the violence and condemned those who did. He issued a warning to other defendants that he'll likely sentence them to jail time if they continue defending their behavior at the Capitol.

"Some of these defendants are not going to do what you did. They're not going to say they did anything wrong. They, to this day, would still participate in the demonstration," Lamberth said. "... I don't want to create the impression that probation is the automatic outcome here, because it's not going to be."

Still, the judge said what happened on January 6 was "a serious crime" and a "disgrace" to the country. He praised the media for its coverage of the assault and pointed out that "much of the public remains outraged at what occurred."
"This wasn't a peaceful demonstration... it wasn't an accident that it turned violent," he said.

Benchmark moment in investigation
It's a benchmark moment in the massive federal probe that has ballooned to comprise nearly 500 defendants from 43 states.

As the sweeping investigation approaches its six-month mark, the Justice Department has moved to resolve a few of the hundreds of federal cases. Prosecutors had secured seven guilty pleas as of Wednesday afternoon and have more scheduled for the coming weeks, giving some insight into negotiations happening behind the scenes and how dozens of defendants likely could be facing years in prison, depending on their actions during the siege.

The initial set of plea deals and the sentencing are likely to serve as a warning shot as the national dragnet continues in what the Justice Department has described as one of its largest investigations ever and a major law enforcement effort to address domestic terrorism. Also Wednesday, an Oath Keeper conspiracy defendant pleaded guilty.

Wednesday's sentencing for Morgan-Lloyd won't set the standard for most of the riot cases, as Lamberth noted. But hundreds of other rioters are charged with felonies for assaulting police, taking weapons to the Capitol, destroying property or -- if they went into protected areas of the building -- obstructing the official congressional proceedings to certify the Electoral College vote. Prosecutors so far appear to be unwilling to wipe away that level of charge.

One man who went inside the Senate chamber for 15 minutes faces a recommended 15 to 21 months in prison, according to court records. Another man who allegedly posed for photos with his feet on a desk in House Speaker Nancy Pelosi's office, carried a taser and stole an envelope from the office, could face nearly six years or more in prison, prosecutors have said.

First to be sentenced
Morgan-Lloyd was initially accused of four federal crimes, but court filings indicate that she reached a deal with prosecutors, who recommended three years of probation, a $500 fine to cover damages to the Capitol complex and 40 hours of community service.

The Justice Department laid out several factors why incarceration isn't warranted: Morgan-Lloyd didn't plan or coordinate with others before January 6; she didn't get violent during the riot; she was only in one hallway for 10 minutes; she immediately cooperated with investigators when they came knocking; she expressed strong regret; and she doesn't have any criminal record.

On the day of the attack, Morgan-Lloyd posted on Facebook that it was the "best day ever," according to her court filings, but in advance of the sentencing she submitted a letter to the judge saying she had reshaped her political views since her arrest and was grappling with a family member's Holocaust denialism.

She said she has spent her entire life in a "very small town" in southern Indiana, which gave her a "sheltered life" that made her out of touch with "what life is like for others in our country." She claimed she had gone through a political transformation after her attorney urged her to learn about racial inequality by reading books and watching movies.
It is common for defendants in criminal cases to tell judges before sentencing that they've experienced changes of heart, in bids to get light punishment. Morgan-Lloyd made that case in her letter, apologized for her crimes and disavowed the rioters who had attacked police officers and trashed the building.

"I felt ashamed that something meant to show support for the President had turned violent," Morgan-Lloyd wrote to the judge. "This is not the way to prove any point. At first it didn't dawn on me, but later I realized that if every person like me, who wasn't violent, was removed from that crowd, the ones who were violent may have lost the nerve to do what they did. For that I am sorry and take responsibility. It was never my intent to help empower people to act violently."

Now that is interesting and also one of the reasons why religion doesn't belong in the protected classes. All religion is, is a belief, an idea, something a person thinks. From a rights perspective, nobody's thoughts are more valuable than anyone else's and mistakenly adding religion as a protected class opens the door to be protected from anything a person thinks, be it flat earth, sasquatch, pedophilia, anything. I'd say that as long as it's illegal to ask about someone's religion, it's also illegal to ask about being a Trumptard.

WELLINGTON, Ohio — When Rep. Jim Jordan took the stage at Donald Trump’s first post-presidential rally, he trumpeted the former president’s possible 2024 election bid. And then someone screamed “2021!”

The fantasy that Trump could reclaim the White House later this year (some named August 2021 as the time) was a common theme among the droves of attendees at the “Save America” rally Saturday in Wellington, Ohio.

It’s not going to happen, and explanations for why it could are rooted in lies and misinformation. But some people think he never stopped being president.

“Honestly I think he won,” Anita Lee, 45, who happened to be visiting from St. Louis, Missouri, told BuzzFeed News. “He’s our true president and I don’t think he’s eligible in 2024.”

Most Trump supporters came in their usual form: Red hats boasting “MAKE AMERICA GREAT AGAIN” paired with a pro-Trump t-shirt (or anti-Biden one) and some representation of the American flag. But in 2021, after the president and his allies have consistently championed unsubstantiated voter fraud, there’s a new crowd favorite — t-shirts that say “Trump Won.”

Pam Niner, 65, traveled more than an hour from Centerburg, Ohio to her third Trump rally after one in Circleville, Ohio last year and another in Delaware, Ohio during the 2016 election. And while she’s eager to hear him announce a bid for 2024, she’s convinced Trump didn’t lose the last election.

“I know he won,” Niner told BuzzFeed News, her oversized “TRUMP WON” shirt nearly reaching her knees. “There’s so much evidence out there it was stolen,” she said before admitting only one thing could convince her otherwise. “Jesus Christ would have to come down and tell me that Biden won before I would ever believe it.”

Robert Clegg, 47, said “of course” when asked if he thought Trump won the election. He hasn’t thought about Trump as a 2024 candidate. Instead, he told BuzzFeed News, “I’m hoping he gets back in there before'' and added “with the overturning of the election.”

A May Ipsos/Reuters poll showed more than half of Republicans think the election was rigged and 53% of Republicans think Trump is the actual president. But the statistics alone don’t show how intense those beliefs are for such a large segment of the electorate. The rallying cry “Trump won” erupted several times Saturday and the attacks on President Joe Biden and Vice President Kamala Harris have become more visceral.

London Roche, 26, and several of his friends wore white t-shirts with black letters that read “BIDEN SUCKS KAMALA SWALLOWS” on the front and “FUCK JOE & THE HOE” on the back. They said they paid $25 for the shirts but it’s unclear if they bought them from the man who was selling the same t-shirts outside the venue.

“I just want to show support for our real President Donald Trump,” Roche said. “We all know he won the election.”

The rally’s speakers consistently raised false allegations of widespread voter fraud from the stage, including Trump, who began raising doubt about the election results last November and has continued making unfounded claims ever since.
“We won the election twice,” Trump said to the crowd. “And it's possible we'll have to win it a third time.”

Some speakers who addressed the audience parroted the same rhetoric. Douglas Frank, a math teacher in the state, gave an exhaustive presentation of his 2020 election results analysis involving algorithms he claims prove the election was stolen. The exhibition included graphs and charts that were projected on two big screens flanking the stage. Frank earned a pants-on-fire rating from Politifact, a fact-checking website, in April for the same analysis. The Michigan state Senate’s new report on the 2020 election specifically faulted Frank for analysis that is “not sound for several reasons.”

Rep. Marjorie Taylor Greene also chimed in with false claims that Democrats pilfered the election when she took the stage.
“President Trump is my president, too,” Greene said. “And he should be our president right now but the dirty, rotten Democrats stole the election.”

About 400 feet away, Catherine Mehalic, 58, stood on one of the many food truck lines and speculated on what she sees as Trump’s best way back to office. She didn't say when.

“I think the audit is gonna take all of it down,” she told BuzzFeed News, referring to one of the non-binding audits Republicans in several states are running to try and prove something about the election. “It’s gonna expose what exactly happened. Everybody knows he won.” And then again with more emphasis, “Everybody knows he won.”

Trump won 8% more total votes than Biden in Ohio and flipped Lorain County, where the event was held. A plane, paid for by Senate candidate Jane Timken, circled the fairgrounds with a sign “OHIO IS TRUMP COUNTRY.”

Just one person out of nearly two dozen people BuzzFeed News interviewed at the rally said they understood Biden won the election. Barry Clodwick said he watched the polls on Election Day “to make sure nothing went wrong” but ultimately was disappointed with what he understood to be the results.

“Unfortunately, Joe Biden won,” he said.
