Does a Police officer or Deputy have the authority to dismiss a marijuana citation?

Dog sniffed my car through a check point, and long story short I got a Tix in New Mexico for about a 8th of weed and paraphernalia. Suck worse is I was in the process of applying to med schools, so trying to keep my record clean is important ( even though a failed)



I talked to a lawyer and he told me write a letter to the deputy saying my goals, how I am sorry ect. ect. Include my transcripts, letter or recs and family photo, and he may be inclined to drop the case. Do officers have that choice, or is it on the Sargent or lieutenant to make that call?

I have not gone to court yet, but plan on pleading not guilty to buy time.

I believe the sergent can possibly do it. however, the lieutenant is too high of a rank to be bother with in your sitituation. if the report is already being made, your chances of getting rid of the cititation is very very slim to none. Just think about this; imagine all of the hassle that the officer who citited you have to do; sign off on paper which is already filed in their database and authorized by a higher ranking officer. In addition, they don't even know you, so why would they help you...therefore; most likely they won't do that for you. Secondly, why would they do it for you??? Give the lawyer opinion a try because it can't hurt you but be prepare to spend extra time writing it out and sending all of the appropiate info to the corrected place and agencies. Your best bet is to prepare that in court and if you want your records to be clean, then what you want is a "DOJ". You pay the fine and perphaps do a little community service and be clean for half a year or so (being clean of course) then the citituation will clear up within a time frame that is in compliance with your state law (every state got their laws so it varies).. hope that help because one of these day, i might need you to save my life =) .... Nope. The d.a might, but you still have to go to court, watch never get busted and you'll walk next time.

. It's a minor charge so med school shouldn't be a problem...
