Cops unlawful search of my house

So my house was unlawfully searched last night. They had no warrant no consent to search, and there was no emergency. My roommate asked they had a warrant and they said they did not need one. My other roommate got a citation and has to appear in court for stems. I don't know what to do about this I want to come after them but how far will I get? Any ideas?
 
Call a lawyer
Did they say they had probable cause. If they get a call or walk by the door and smell marijuana, once you open the door they can enter. Fight it, if thats all they found, say you may have been set up.

Even if they say they smell weed they still dont have the right to search without your permission untill they get a warrant. You could simply say "sorry officer I dont smell anything" or something more clever. Either way they dont have the right to search a home without the owners permission or a warrant. Sometimes cops say shit like that just to get in the door so they can find something else to bust you with.


If I was you id get a lawyer and do as much research as possible. Doubt they will fire the cop but he will most likely get suspended with no pay
 
Educate yourself,
Never open your door to LEO, tell your roommate.
If they demand entry and you don't want them in your home tell them you will dial 911.
Ask if they have a warrant, if they don't and they have no probable cause they are not going to kick your door in.
On the other hand if they do have probable cause they will kick the door in.
Before they do they will threaten to.
Just tell them thru the door that you want to confirm the actions they are taking with a supervisor. Don't open the door....
Turn on shower, turn up music then it's the time to flush, run your disposal.
If you don't have a disposal Get one.
Nothing get rid of weed faster.
Toilets clog....

Now call a lawyer and ask for help and throw that roommate out IMHO.

You might as well just say I HAVE NO IDEA WHAT I'M TALKING ABOUT!!

An open door does not imply consent to enter a residence.

Plain view doctrine is what you are referring to with seizing illegal property in their field of vision.
