CO Medical Patients Considering Moving to RI

What's up everyone? I'm a medical patient currently residing in Colorado. I'm seriously considering moving to RI with my girlfriend (also a patient) and our daughter. I have spent the past several days researching and thoroughly reading through the RI MMJ laws, but I still have some confusion in a few areas and some questions. I was hoping some patients/caregivers/growers in RI might be able to help me out.

1) Here in CO, patients can possess up to 6 plants (3 mature, 3 immature) and up to 2 ounces of usable marijuana at any given time. However, doctors can recommend more plants and/or ounces, allowing patients to raise an affirmative defense in cases of prosecution. In general, police respect these doctor recommendations and do no arrest patients who stay within their doctor-recommended limits. My girlfriend and I each have a recommendation from our doctor for 24 plants (12 mature, 12 immature) and 8 ounces of usable marijuana, an amount consistent with our usage and needs. If we moved to RI, would our doctor recommendations still allow us to possess up to 8 ounces, or would we have to stay within the default RI limit of 2.5 ounces?

2) Here in CO, under the new Amendment 64, anyone 21 years of age or older can possess up to 1 ounce of usable marijuana. However, anyone over 21 can also grow up to 6 plants (3 mature, 3 immature) and can possess all "of the marijuana produced by the plants on the premises where the plants were grown". In other words, the law in CO recognizes that the amount of dried bud that an individual plant can produce is highly variable and somewhat unpredictable, so it allows a person over 21 to possess all of the bud his/her plants produce, even if the amount produced exceeds the normal limit of 1 ounce. How does this work in RI, where a patient can have up to 12 mature flowering plants, but can only possess up to 2.5 ounces of usable marijuana? In my experience growing, even a single plant, started from seed and flowered immediately upon reaching sexual maturity, can produce well over 2.5 ounces of dried bud. What is a patient in RI supposed to do if his/her plant(s) produce(s) over 2.5 ounces? I read in the Hawkins-Slater Act that a patient can legally sell bud to a compassion center and/or give it away for free to other patients, but is this referring to overages? Because it seems like it says a patient can't ever have more than 2.5 ounces no matter what, which doesn't make sense to me. Let's say, for example, I harvest just one plant and hang it up to dry. After the plant is dried and processed, I weigh the bud and discover the plant has produced 6 ounces. Am I instantly in violation of RI MMJ laws? If my house happened to be raided at that moment, would I be arrested and charged for possessing more than 2.5 ounces, even though I only harvested one plant and had no idea that it would end up yielding more than 2.5 ounces until it was already dried and weighed? What am I legally supposed/allowed to do with the excess bud? Am I legally protected as long as it's still on the premises on which it was grown? Can I save it for myself for future need? Am I allowed to transport it and sell it to a compassion center, 2.5 ounces at a time? Am I supposed to just destroy it immediately? Do I have a certain amount of time in which to look for a needy patient to give it to? This is an extremely confusing and worrisome aspect of the law to me, as the strains I grow routinely yield more than 2.5 ounces per plant.

3) I require a steady supply of medicine, but I typically only harvest once every 2 months. Can I harvest all 12 of my plants at once, every 2 months, set aside a 2 month supply to last me until the next harvest, store it in a locked container, and then just allot myself 2.5 ounces at a time? Or are we pretty much obligated to stagger plants in flower, allowing for more frequent, single-plant harvests? And again, what am I supposed to do if I only harvest one plant at a time but still end up with more than 2.5 ounces once it's dried?

4) Lastly, who decides when a harvested plant becomes 'usable marijuana'? The text of the Hawkins-Slater Act defines 'usable marijuana' as "the dried leaves and flowers of the marijuana plant, and any mixture or preparation thereof," but it doesn't define the word 'dried'. Who decides whether or not the herb is completely 'dried' and therefore at its final weight? For example, let's say I have 2.5 ounces of totally dry medicine in a jar and then harvest a plant to begin drying it, anticipating that the plant will be dry just as I am running out of medicine from the jar. What if my house happened to be raided while I still had medicine in the jar, plus a halfway-dried harvest. What, if anything, would prevent police from calling the halfway-dried medicine 'usable marijuana', putting me over the 2.5 ounce limit? This gets even more confusing and worrisome if curing is taken into consideration. In order for cannabis to be healthy to smoke medicinally, it must be fully cured. Therefore, dried (but not yet cured) bud, although defined as 'usable marijuana' in the text of the law, is not actually usable to medical patients. Curing herb can take anywhere from 2 weeks to 2+ months depending on the strain, so how am I supposed to ensure that I have a constant supply of fully cured medicine without going over the 2.5 ounce limit? For example, let's say I require 2.5 ounces of medicine per month to treat my chronic pain. And let's say I have a strain that I can get to yield about 2.5 ounces per plant if I flower it small, so I plan on harvesting one plant and putting one new plant into flower each month. Let's say the strain takes exactly 2 months to flower, half a month to dry, and another half a month to cure. So after the first 2 months, I harvest my first plant. One month later, the medicine from the first plant is fully dried and cured, and it's time to harvest the second plant. I harvest the second plant, and half a month later it is fully dried and ready to start curing. However, I still have half of the medicine from the first plant left. So now I have 1.25 ounces of cured medicine plus 2.5 ounces of dried but still uncured bud. Only the 1.25 ounces of cured medicine is actually usable to me as a medical patient, but the 2.5 ounces of uncured bud is dried and therefore considered to be 'usable marijuana' as well, thus putting me over the 2.5 ounce limit. How is this situation possibly supposed to be avoided?

We are seriously thinking about moving to RI because the rent is more affordable than here in CO, we miss the ocean and the beach and the east coast in general, and because it's the medical state that allows home cultivation closest to our family in the Southeast. We're also excited at the idea of exploring New England since both of us have only been there a few times before.

However, before making the decision to move, we definitely want to make sure we are going to be able to continue to grow and possess/use enough medical cannabis, extracts, concentrates, and edibles to adequately and legally treat our conditions, just as we have been here in CO, and that we have a legal means of getting rid of the excess medicine and hopefully at least recouping our expenses. We definitely do not want to be at risk of being arrested and having our daughter taken from us. That would be an absolute nightmare, obviously. It seems like the RI laws have been written really well and are very reasonable except for the apparent rigidity of the 2.5 ounce rule. I'm just a little worried about that because, as I said, the strains I grow typically yield significantly more than 2.5 ounces from a single plant, and I'm unsure from reading the laws if I'd be allowed to have more with a doctor's recommendation or, if not, what exactly I would be legally able/obligated to do with the excess. I certainly would hate to have to destroy it. That would make me very sad :cry:, and would feel like a huge waste of perfectly good high-quality organic medicine that I put a lot of love, time, energy, and money into growing...:weed:

Any information/help/advice will be greatly appreciated, preferably from patients/caregivers/growers who actually live in RI and are very familiar with the law.

Rhode Island will recognize your co med card but will still have to obey by ri laws.i personally would just get a ri card as soon as u moved here.the whole 2.5 ounce rule is tough when u harvest.there will always be a time where u r over.best thing is as soon as ready make extracts with overages or just get creative in a work-around.you could also sell to slater compassion if u have clean good meds and don't mind selling for wholesale price.
From what I've been seeing here is the only people getting busted are the people abusing the system.showing too many people,selling meds to under covers,stealing electricity and running too many plants.only way they would even find your overages is if they got a warrant and searched your home.and if they have a warrant then u already screwed up somewhere.

Thanks for the feedback. Sounds like the law needs to be amended to take into account overages, seeing as nearly every patient who grows at home is inevitably going to be over at some point, probably every single harvest. I wonder what it would take to get a clause added allowing patients to possess as much as their plants produce (as long as they have 12 plants or less) and/or allowing patients to sell everything their plants produce in excess of 2.5 ounces to the compassion centers...

Anyway, would I have to make slater one of my caregivers to sell to them? Or can any patient sell to a compassion center? What about greenleaf, do they buy from patients as well?

Also, another question for RI patients & caregivers.. Where should we live? What are some cool towns in RI? My gf and I are in our late twenties and have a daughter in kindergarten and a baby on the way, so an area with young families would be good. Obviously we're both medical patients and love to blaze, so an area where there are other patients and growers and where the other residents are cool with it would be best definitely. We love reggae and chill electronic music and enjoy going to shows, so being close to a venue would be cool too (I guess everything in RI is decently close to everything else though right?). And we love going out to eat, so an area with good restaurants would be crucial. And if possible we'd like to be near the beach. In general, we're laid back, spiritual, natural folks who enjoy chillin at home with our family but still like to get out and have a good time here and there too. We'd love to get the inside scoop from some people who live in RI (especially other patients/caregivers in their 20s/30s with families) about what areas we should check for a spot to rent. We're going to be looking for a 3 bedroom with a basement and fenced yard in the 1000-1650 range. We obviously would like to be in an area with little crime but hopefully not too suburbia... Haha we appreciate suggestions!

Rhode island reconizes your card so you can possess meds. Not grow them or anything else...

In order to grow them you need your RI card. You will always have overages as you already know which makes you always at risk. Im more fond of warwick IMO police an other people leave me alone and i dont worry about my house when im not here. You dont need the disp. To be registered as a caregiver of yours to give them excess meds so when you have your card here you should concentrate on growing your own before signing someone to make sure you want them.

So I should look around the Warwick area? Any other cool places to check out? A friend of ours who lives in SoCal but is from RI told us to check out North & South Kingstown, Narragansett (?), Newport (she said mostly too expensive but some affordable areas?), and maybe Barrington (?) or something like that...

Anyone have opinions on these places or any other suggestions?

We are getting pretty serious about making this move and it's hard to search for housing availability on craigslist and such when we aren't familiar with RI at all.

I realize some will think we are crazy for not visiting first and doing some exploring in person, but that would be a significant extra expense in addition to the move, and we feel we can pretty much be happy anywhere as long as the schools are good, the medical laws are good, and we find an affordable house in a cool neighborhood.

Doing research, it seems like the schools are good, and looking on craigslist, the rent in general is definitely more affordable than Boulder, CO, where we live now, and there seems to be some nice neighborhoods (we just don't want to end up in a neighborhood that is too nice, where we don't fit in and are bored lol).

Plus, with all the beaches in RI (and CT, MA) and with Providence, Boston, NYC, Portland, and other cool cities easily accessible, we feel excited at the prospect of exploring a totally new area of the country and don't really feel like we'd definitely need to visit first...

We're just really hoping to get some tips from other med patients, caregivers, and other ganja friendly folks in the area. Any and all suggestions/advice will be appreciated! Give thanks

i'm not a patient so i don't know specifics but i am a RI resident AND a grower and i am actually considering doing the opposite, RI sucks, it's way too expensive and the state is run by fools and thieves.

btw, i don't know what the rents are in Colorado but they are expensive here in RI, i rent a 2 bedroom in Cranston and i pay $900.00 a month plus all utilities. (my electric bill runs almost $200.00 a month as well and i live alone and my flower op is only a single 600HPS.

i am currently saving money to buy a piece of land somewhere and southern Colorado or northern New Mexico are looking pretty good, ...i want to build an earthship and go off grid and start keeping the lions share of my money rather than having to spend 3/4 of it just to keep a roof over my head.

A decent 2 bedroom with room to grow in Boulder runs between 1200 and 2000+, and the electric is definitely over 200 a month if you're growing, so RI is definitely cheaper in that regard (not necessarily cheaper than all of CO, just Boulder and the surrounding foothills, which is the only area we really like).

We have a child and another on the way so we need 3-4 bedrooms plus a basement or garage for growing, so here in Boulder, we can't find places for less than like 2200, and that is on the cheap side. On craigslist, we were finding places in RI with 3-4 bedrooms and a basement, walking distance or a short drive from the beach, for like 1250 and up, and they looked nice...

I'm all about those earthships and living off the grid and hope to do the same someday when my home state of NC legalizes and when I can afford to buy some land. Until then, we are stuck renting in medical states. So far, I've spent significant time in CA and CO and both have their awesome aspects, but both are super blown up (with growers, dispensaries, and all kinds of related businesses already cornering every area of every market) and extremely expensive, both for housing and electricity...

Soo, we've been looking into other medical states, especially those back on the east coast, and the state closest to the southeast (where our family is) that allows home cultivation is RI. Other options are CT, MA, and ME, but it seems like Mass is only allowing home growing temporarily while they work out the state-run system and I just always got the impression CT was a little too richie rich for us (correct me if I'm wrong though)...

If RI truly sucks, then we definitely don't want to move there, but I've heard some more positive opinions...

Anyone else care to chime in?

Northern New Mexico is cool though, I must say. We went to a Midnite show in Taos and camped for a couple nights and it was beautiful. I would totally live there, but my girl isn't really into the high desert climate... I'm not 100% into it either really, but I could dig it for a while. Truly, I love the mountains, forests, and waterfalls of western NC best, but the state legislature completely killed the medical bill in 2013, and it will probably be many years before it finally becomes a medical state and even longer before it fully legalizes... :/

Older head here...I'm not from RI, though I lived in CT for years (also have family still there) and use to runover the state lines to Westerly RI.to get booze on the weekends..(Conn package stores/Liquor stores)..They all closed at 8 pm Saturday night =no booze till Monday morning (unless state lines/bootlegger) bootlegger meant high ass prices/so you'd head to RI which sold booze longer and later than Conn...I use to go into Providence also Newport..Newport is very nice close to the water,lots of different things going on there ,especially in the Summer (Newport Jazz Festival) is one that comes to mind.I'm like this do what you want and can in life ..Please yourself 1st(family included/hey you're not alone/smile)..I hope the best for you and your family on whatever decision you'll make...Peace Always..Hey who know I may be asking you a similar question in the future...hehe..Peace always.....

If you are moving here, you absolutely need to look at the area first. Most of RI is way to over populated and the schools are horrible. Some cities here do not have school buses and require that the children ride the city bus to and from school. This is crazy and dangerous because the bus drivers here are bad drivers and are very rude. My gf works in the emergency room at one of the local hospitals and she told me about a young kid that was on the city bus taking it to school and the bus driver slammed on his breaks and the kid went flying and hit his head and got really injured.

My point is, you can read online and learn about the areas and such, but you really need to take a look at the area you will be placing your family in to see if it fits your lifestyle. Stay in warwick or south of warwick, North or south Kingston is one of the nicest places without being to expensive. hope this helps

My personal opinion on where to live all depends on whether you want to live in the city, or the country, or maybe in between. I am a Narragansett resident, and owning a house in RI may be expensive but the big problem is taxes, Narragansett is probably the cheapest on taxes and has great school systems, and prices on houses are semi-reasonable while rent is only fairly priced. South Kingstown is very expensive all around and the school system kind of sucks now. I have lived in RI most of my life, and while this state is ultra corrupt, I still love it here, although I could use some mountains out here! If you need more info about the state, or anything else, look me up on my website (www.naturalsolutionsllc.org), which is still not finished.

Just stay out of Woonsocket,central falls,Pawtucket.RI is funny because even though the state only takes about a hour to drive the whole state.there are real nice parts and a variety of living.dense city? In the woods?ocean livin? It's all here just pick the right city or town.

Pretty much this^^... Warwick is probably the best place to live of the more affordable places imo. You're right in the middle state. it's a solid rural area not too far out in the sticks, and not too much traffic. 25 mins of driving will get you anywhere in the state from the beaches to down town Providence. Warwick also has some of the best schools in both the public and private sectors via Tollgate and Hendricken.

Warwick is definitely a very good place if you have a family. I'm a patient in Warwick and have lived here most of my life.
